May 20, 2024 REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF NEDERLAND 4:30 p.m. May 20,2024 1. MEETING The meeting was called to order at 4:30 p.m. by Mayor Albanese at the Nederland City Office Building, 207 N. 12th Street,Nederland, Texas. See attached for quorum. The following statement was posted: "PURSUANT TO SECTION 30.07, PENAL CODE (TRESPASS BY LICENSE HOLDER WITH AN OPENLY CARRIED HANDGUN), A PERSON LICENSED UNDER SUBCHAPTER H, CHAPTER 411, GOVERNMENT CODE (HANDGUN LICENSING LAW), MAY NOT ENTER THIS PROPERTY WITH A HANDGUN THAT IS CARRIED OPENLY." 2. INVOCATION AND PLEDGE OF ALLEGIANCE The invocation and Pledge of Allegiance was led by Mayor Pro Tern Sonnier. 3. CONSENT AGENDA - All consent agenda items listed are considered to be routine by the City Council and will be enacted by one motion. There will be no separate discussion of these items unless a councilmember so requests, in which event the item will be removed from the Consent Agenda and considered separately. A motion was made by Mayor Pro Tem Sonnier and seconded by Councilmember Guillot to approve the Consent Agenda Item"a thru c" as presented. MOTION CARRIED. Tax Assessor Collection Report—April 2024 4. REGULAR AGENDA a. The regular meeting was recessed and a Public Hearing was called to order at 4:32 by Mayor Albanese for the purpose of discussing and receiving comments regarding the installation of"NO PARKING DURING SCHOOL HOURS" signage at/near the Gary Avenue and 12th Street intersection. Chris Duque, City Manager, stated that a property owner had contacted his office regarding concerns with the school parking impacting the neighborhood and traffic at this intersection. As the school construction was ongoing the issue was much more severe. With the construction completed,the severity is not there anymore but there are still issues with this area. This signage would allow drivers to safely enter/exit Gary off of 12th Street. Police Chief Porter reviewed the issues and recommends the installation of "NO PARKING DURING SCHOOL HOURS" signage approximately Minutes continued, May 20, 2024 30 feet south and east from the intersection. The ordinance for the signage could be placed on the June 10th agenda and installed in early August before the start of the 2024- 2025 school year. Britton Jones, 1132 Gary, spoke in favor of the installation of "NO PARKING DURING SCHOOL HOURS" signage at/near the Gary Avenue and 12th Street intersection. No action was necessary. There being no further questions and/or comments the Public Hearing was adjourned and the regular meeting was reconvened at 4:35 by Mayor Albanese. b. The regular meeting was recessed and a Public Hearing was called to order at 4:36 by Mayor Albanese for the purpose of discussing and receiving comments regarding the proposed annexation by petition of 2.069 acres of land as described as "a 2.069 acre tract of land, being out and a part of a called 152.965 acre tract of land conveyed to Sunoco Partners Marketing & Terminals L.P., being more fully described and recorded in Clerk's File No. 2012042125 of the Official Public Records of Jefferson County, Texas. Said 2.069 acre tract being situated in the Ogister Montee Survey, Abstract No. 117, Jefferson County, Texas." Chris Duque, City Manager, stated that the annexation of this property is necessary to relocate the green waste site. Ultimately, it is Energy Transfer's intention that this property will be deeded to the City. In accordance with state law, the City and Energy Transfer have agreed to a services plan (only requested public safety services), and the City has notified the school district of the proposed annexation (no impact to NISD). The second public hearing will be held on Monday, June 10th at 4:30PM at the Nederland City Council chamber. No action was necessary. There being no further questions and/or comments the Public Hearing was adjourned and the regular meeting was reconvened at 4:38 by Mayor Albanese. c. A motion was made by Mayor Pro Tem Sonnier and seconded by Councilmember Guillot to authorize the tennis court and pickleball court repairs and improvements. MOTION CARRIED. A motion was made by Councilmember Root and seconded by Councilmember Duplant to authorize the solicitation of Requests for Proposals for the City's fiscal year ended September 30, 2024 audit. A motion was made by Councilmember Root and seconded by Mayor Pro Tem Sonnier to award bid for debris monitoring services to Debris Tech. MOTION CARRIED. A motion was made by Mayor Pro Tern Sonnier and seconded by Councilmember Root to award bid for debris removal services and emergency products, equipment, and services to Ceres and Crowder Gulf. MOTION CARRIED. AYES: Mayor Albanese,Councilmembers Duplant,Root, Sonnier, and Guillot. NOES: None. 5. COMMUNICATION City Manager's Report: a. Miscellaneous: • The Library and Parks departments are working on their summer activities. • The Nederland Swimming Pool will open on June 1St • City offices will be closed Monday in observance of Memorial Day. Garbage service will run one day behind schedule. • The Memorial Day Program will be held next Tuesday,May 28th, at 10:00AM at the Veteran's Park. • Voting will be held at City Hall on Tuesday, May 28th. • Solid Waste has ended the overtime on the debris pick up. • NISD graduation night is next Thursday night. Chris congratulated the 2024 seniors and wished them a safe and happy graduation and summer. Councilmember Duplant wanted to recognize the garbage truck driver who helped on his street during the storm/street flooding. 6.
