06-24-2024 AgendaNEDERLAND CITY COUNCIL AGENDA NOTICE is hereby given of a regular meeting of the Nederland City Council to be held on Monday, June 24, 2024, 4:30 p.m., at the Nederland City Hall, 207 North 12th Street, Nederland, Texas, for the purpose of considering the following agenda items. The City Council reserves the right to retire into Executive Session concerning any of the agenda items whenever it is considered necessary and legally justified pursuant to Texas Government Code, Chapter 551. Members of the public can participate remotely via Zoom Teleconferencing. Citizens may join the Zoom Meeting by clicking on the Virtual Council Meeting https link on the City of Nederland’s website or calling the Zoom Call in Number and entering the Meeting ID# on the City of Nederland’s website. 1. There will be no separate discussion of these items unless a councilmember so requests, in which event the item will be removed from the Consent agenda and considered separately. a. Consider action re-appointing Darrell Bush to the Civil Service Commission. ii. Consider action re-appointing Kevin Smith, Mike Louviere and Michael Whitehead to the Zoning Board of Appeals. iii. Consider action re-appointing David Knight, Mitch Macon, Mike Spell and Ricky Root to the Construction Appeals Board. iv. Consider action re-appointing Dylan Fairly, Alex Rupp, Lance Howell, Scott Watjus and Mark Byars to the Planning and Zoning Board. b. Consider action approving Ordinance No. 2024-14, suspending the effective date for an additional ninety days beyond the effective date, proposed by Texas Gas Service Company, a division of One Gas, Inc., in connection with its statement of intent to increase rates within the incorporated areas of the Central-Gulf Coast Service area, Central Texas service area, filed on June 3, 2024. c. Consider action approving an amendment to the Clothing Allowance Standard Operating Procedure. d. Consider action approving Resolution No. 2024-08, ratifying the action of the Nederland Economic Development Corporation Board of Directors related to the incentive offered to AYG Foods dba Layne’s Chicken. f. Consider action approving Change Order No. 2 – Seattle Avenue and 27th Street Storm Sewer Improvements project. g. Consider action approving final payment and release of retainage – Seattle Avenue and 27th Street Storm Sewer Improvements project. h. Consider action approving Ordinance No. 2024-15, abandoning a 20’ X 100’ alleyway adjacent to 1023 Helena Avenue (0.0459 acre of land, part of a 20 feet wide alley in Block 4, Burson Addition, recorded in Volume 1, Page 125, Map Records, Jefferson County, Texas) and retaining an easement. i. Consider action approving a Real Estate Agreement with Energy Transfer regarding a 2.069 acre tract of land and a 20’ X 100’ abandoned alley adjacent to 1023 Helena Avenue. 5. EXECUTIVE SESSION (No Public Discussion on These Items) The City Council will announce that it will go into Executive Session, pursuant to Chapter 551 of the Texas Government Code, to discuss matters as specifically listed on the agenda, or as authorized by law. RECONVENE Reconvene into regular session and discuss and take action, if any, on items discussed in Executive Session. 7. APPOINTMENT a. Consider action authorizing the appointment of the City Clerk, Director of Finance, Police Chief, and City Attorney in accordance with the City Charter. b.
