Approved minutes from May 13 2025 Planning and Zoning meetingDRAFT CITY OF NEDERLAND PLANNING AND ZONING COMMISSION MINUTES 5:00 p.m. May 13, 2025 1. MEETING The meeting was held Tuesday, May 13, 2025 at the City of Nederland D. Bob Henson Office Building, 1903 Atlanta Avenue, Nederland, Texas and was called to order at 5:00 p.m. by Chairman Scott Watjus. MEMBERS PRESENT: Scott Watjus, Alex Rupp, Dylan Fairley and Lance Howell MEMBERS ABSENT: None CITY STAFF PRESENT: George Wheeler, Chief Building Official, Jacob Pitts Assistant Building Official OTHERS PRESENT: Guadalupe Garcia, Mr. and Mrs. Bobby Simon, Mr. Brandon Monk, Scott Brackin, Mukhtiar Ali Khuwaja 2. APPROVAL OF MINUTES A motion was made by Alex Rupp and seconded by Dylan Fairley to approve the minutes of the February 4, 2025 meeting. All voted aye. 3. REPLAT REQUEST Guadalupe Garcia owner of the property located at 115 Hilldale Dr. described as tract 1-C, Block 2 of Hillcrest Terrace Addition is requesting a re -plat of Tract 1-C to make Tract 1-C-A of Hillcrest Terrace Addition. The Building Official explained that the re -plat was to decrease the lot size to 55ft by 110ft and leave a 12ft strip of land so he can sale the new 55ft by 110ft. lot and let the remaining 12ft just remain as a separate strip of land. The re -plat shows l Oft of the 12ft strip of land is easement and like with all other easements, the underlying land is still the property owners. The remaining Tract 1-C-A (new lot) has no deviations from the minimum standards but the remaining 12ft does not meet any minimum stands for a buildable lot. The neighboring adjacent property owners the Simons whom live at 208 Hill Terrance were present with their attorney Mr. Brandon Monk. Mr Monk spoke on behalf of the Simons stating that the remaining strip as shown on the re -plat, is the Simons property through adverse possession or until the judge determines otherwise. After a full discussion a motion was made by Dylan Fairley and seconded by Alex Rupp to recommend to City Council to deny the re -plat request due to the remaining strip not meeting the minimum standards for a buildable lot. All voted aye 4. PRELIMINARY PLAT SHEGUR SUBDIVISION Texas PWSK Enterprises, LLC, owner of the property described as Lot 16 Block 5 of Hillcrest Second Addition site of the proposed subdivision known as Shergar Subdivision request the approval of the preliminary plat as presented. The Building Official was present to describe to the commission that the preliminary plat involves the subdivision general layout, ROW width, easement size and lot size, etc. Approving this preliminary gives the developer the go ahead to start working on the construction drawings and final plat for submittal. Mr. Wheeler explains the deviations from our minimum standards shown on the preliminary plat are the ROW width from 60ft to 50ft and the front yard setbacks for lots 6, 7, 8 and 9 from 20ft to 15ft. Mr. Wheeler also spoke of a recommendation that the detention ponds be the property of and maintained by a homeowners association and not owned by and maintained by the property owner of lot 1 and respectively lot 14 as stated on the plans. There were spoken concerns from Jolie Shipley and from surrounding neighbors Catherin Tate 2912 Avenue 0 and Shelley Crain 2911 Avenue M about drainage, overcharging of the sanitary sewer system with problems already in this area. The developers' surveyor Scott Brackin spoke briefly about the concerns and Mr. Khuwaija developer spoke stating that he understands their concerns and will take into account their concerns. After a full discussion, a motion was by Lance Howell and seconded by Alex Rupp to recommend to City Council the approval of the preliminary plat request with the requirement that a homeowners association be created for ownership of the detention ponds with bylaws describing the perpetual maintenance of the detention ponds by the association. All voted aye. 4. COMMUNICATION Mr Wheeler introduced the new employee of the Inspection Department, Jacob Pitts Assistant Building Official. Jacob Pitts is the replacement to retired department secretary Beth Merren. Mr. Pitts will also be obtaining the required licenses and certifications to perform all field inspections. Mr. Wheeler also briefly explained the new process for public hearings for zoning amendments and district boundary changes. He explained that now the Planning and Zoning is required to have their own public hearing and regular meeting immediately following the Public hearing for action to send to City Council. The City Council will then have their own public hearing followed by their final action on the item. 5. ADJOURN There being no other business a motion was made by Alex Rupp and seconded by Lance Howell to adjourn the meeting at 6:30 pm. All voted aye. Scott Watjus, Chai an
