07-28-2025 AgendaNEDERLAND CITY COUNCIL AGENDA NOTICE is hereby given of a regular meeting of the Nederland City Council to be held Monday, July 28, 2025, 6:00 p.m., at the Nederland City Hall, 207 North 12th Street, Nederland, Texas, for the purpose of considering the following agenda items. The City Council reserves the right to retire into Executive Session concerning any of the agenda items whenever it is considered necessary and legally justified pursuant to Texas Government Code, Chapter 551. Members of the public can participate remotely via Zoom Teleconferencing. Citizens may join the Zoom Meeting by clicking on the Virtual Council Meeting https link on the City of Nederland’s website or calling the Zoom Call in Number and entering the Meeting ID# on the City of Nederland’s website. Citizens will address the City Council from the podium after providing their name and address. REGULAR AGENDA NEW BUSINESS a. Attached are the minutes of July 14, 2025, regular meeting. b. Attached are the June 2025 Departmental Reports for review c. The 2024-25 total adjusted tax levy is $7,878,588.45 and the amount of collections as of June 30, 2025 is $7,272,027.46 which represents 92.30% of the total tax levy. The 2024- 2025 current year adjusted tax levy is $7,447,228.19 and the amount of collections as of June 30, 2025 is $7,212,628.42 which reprsents 96.85% of the current year tax levy. In comparison to prior year, the amount of property tax collected as of June 30, 2024 was $7,480,659.57 which represented 92.75% of the total tax levy and $7,389,948.18 of the current tax levy which represented 96.82%. Below is table showing how the percentages are calculated between the current tax levy and delinquent levies. Rob Woods, Public Works Director, will review the 2024 Annual Water Quality Report (Consumer Confidence Report) that was recently posted online for all customers. In accordance with EPA regulations, all water suppliers are required to issue the CCR to all their customers on an annual basis. The public will have an opportunity to provide their comments regarding the Report. No action is necessary. e. Deshaun Armstrong, Customer Service Manager of Entergy, will discuss Entergy’s storm readiness. In addition, Mr. Armstrong will also discuss Entergy’s app and how to report and check outages. f. City Council will receive comments from Logan Hebert regarding garbage cans being left at the curb. Requested by Mayor Pro-Tem Ortiz. g. The City Council will discuss and take action regarding procedures for appointing members to various city boards. h. Board and Commission Appointments i. City council will discuss appointing members to the Planning and Zoning Board. ii. City council will discuss appointing members of the Nederland Economic Development Board. i. David and Jennifer Nguyen; proposed owners of property located at 1837 N 18th Street submitted a request for a specific use permit to allow for a vehicle detail shop to include ceramic and vinyl wrap and window tinting. The current property owner is aware of the request with the sale to Nguyens contingent on the approval of the specific use permit. The Building Official explained that the request is not for services such as engine repair, maintenance or overhaul, body repair and painting. The property is currently zoned C-2 neighborhood retail. This item was presented to City Council at their regular meeting on July 14, 2025. City Council postponed the request pending additional information to include the Specific Use Permit Application and supporting documentation. The Chief Building Official and Planning and Zoning Commission recommend approval. j. Attached is Ordinance 2025-12 authorizing the suspension of the effective date for an additional (90) days beyond the effective date proposed by Texas Gas Service Company in connection with its statement of intent to increase rates. In June 2025, Texas Gas Service Company submitted a statement of intent to increase rates within its Central-Gulf Service Area, West North Service Area, and Rio Grande Valley Service Area, by approximately $41.1 million per year, with a proposed effective date of August 19, 2025. The 90-day rate suspension will allow time for a review of Texas Gas Service’s rate proposals. I recommend approval of this item. k. Police Chevrolet Tahoe PPV 4x2 Purchase - Staff requests authorization to purchase a Chevrolet Tahoe Police Pursuit Vehicle via Goodbuy Contract 28-8F000 (purchasing cooperative) for the Police Department. The vehicle purchase price quoted by Parkway Chevrolet is $53,537.00 and Motorola Equipment totaling $15,764 for a total purchase price including vehicle and equipment of $69,301. A budget amendment was approved at the July 14th regular council meeting to provide budgeted funds in the Equipment Replacement Fund – General. The Police Chief recommends approval of this item; I concur with his recommendation. REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF NEDERLAND 6:00 p.m. July 14, 2025 1. MEETING The meeting was called to order at 6:00 p.m. by Mayor Darby at the Nederland City Office Building, 207 N. 12th Street, Nederland, Texas. See attached for quorum. The following statement was posted: “PURSUANT TO SECTION 30.07, PENAL CODE (TRESPASS BY LICENSE HOLDER WITH AN OPENLY CARRIED HANDGUN), A PERSON LICENSED UNDER SUBCHAPTER H, CHAPTER 411, GOVERNMENT CODE (HANDGUN LICENSING LAW), MAY NOT ENTER THIS PROPERTY WITH A HANDGUN THAT IS CARRIED OPENLY.” 2. INVOCATION AND PLEDGES OF ALLEGIANCE The invocation was led by John Ortiz and the Pledges of Allegiance were led by Mayor Darby. 3. CITIZEN COMMENTS Kenneth Young, 2419 Avenue G, stated he has a house on 2411 Avenue G which is now taking on water from the surrounding property. There are no culverts in his driveway and water puddles on his property. He also stated there is a liquor store on 23rd and Nederland Avenue that has a billboard advertising liquor and tobacco which is blocking driver’s view and is also near a school/church. Jolei Shipley, 8765 Holmes Rd., stated she has found building plan sets that have not been signed by our building department and all plans need to be approved by the city. Angela Fanette, 1016 N. 31st St., stated she has received no update on the smoke testing within the city. Mayor Darby requested smoke testing and ditching digging updates for all future council meetings. 4. REGULAR AGENDA NEW BUSINESS a. A Proclamation recognizing James White was presented to his family. His family thanked the city officials. b. A motion was made by Councilmember Sonnier and seconded by Councilmember Jones to approve the Minutes of the June 23, 2025 regular meeting and the June 13, 2025 special meeting. MOTION CARRIED. Minutes continued, July 14, 2025 2 AYES: Mayor Darby, Councilmembers Duplant, Jones, and Sonnier. NOES: None. ABSENT: Mayor Pro Tem Ortiz. (Mayor Pro Tem Ortiz joined the meeting via Zoom at 6:26 pm.) c. Appointments: i. Infrastructure Committee: Councilmember Sonnier made a motion to appoint Robbie Smith. MOTION CARRIED. AYES: Mayor Darby, Councilmembers Duplant, Jones, Sonnier, and Ortiz. NOES: None. ii. Planning and Zoning Board: Councilmember Sonnier requested to postpone this item until the July 28, 2025 meeting to allow time to determine if appointments must reside in a specific ward or can be at large. iii. Construction Board of Appeals: Councilmember Sonnier made a motion to appoint Emmett Hollier. MOTION CARRIED. AYES: Mayor Darby, Councilmembers Duplant, Jones, Sonnier, and Ortiz. NOES: None. iv. Nederland Economic Development: Councilmember Sonnier requested to postpone this item until the July 28, 2025 meeting to allow time to determine if appointments must reside in a specific ward or can be at large. d. A discussion was held regarding the approval of the purchase of four radio consolettes for the Nederland Fire Department. AYES: Mayor Darby, Councilmembers Duplant, Jones, Sonnier, and Ortiz. NOES: None. e. A motion was made by Councilmember Duplant and seconded by Councilmember Jones to approve Ordinance No. 2025-10, amending the Code of Ordinances by amending Chapter 102-Traffic and Vehicles, Article II.-General Traffic Regulations, Division 7-Operation of Vehicles, to Establish a School Safety Zone. MOTION CARRIED. AYES: Mayor Darby, Councilmembers Duplant, Jones, Sonnier, and Ortiz. NOES: None. Naiesha Gallon, 703 Boston, commented she appreciated the passage of this Ordinance as her son was involved in a vehicle accident in this area. f. A motion was made by Councilmember Jones and seconded by Councilmember Duplant to approve Ordinance No. 2025-11, amending the fiscal year 2024-2025 budget. MOTION CARRIED. AYES: Mayor Darby, Councilmembers Duplant, Jones, Sonnier, and Ortiz. NOES: None. g. The regular meeting was recessed and a Public Hearing was called to order at 6:33 by Mayor Darby for the purpose of discussing and receiving comments regarding amending the zoning text by adding a new land use Events Centers to table 13.2 “Schedule of permitted uses” with the appropriate parking group. Minutes continued, July 14, 2025 3 George Wheeler, Chief Building Official, stated the amendment will be adding needed language to the building code. Councilmember Duplant stated the EDC is considering the construction of an events center but is only in the discussion phase of this project. Angela Fanette commented the city should refer to the Code of Ordinances, Section 1, regarding promoting the health and safety of the citizens and feels the city needs to review our resources before building any event centers. She stated the city needs to have a master plan and small businesses are having sewer issues as well. Kristin Robinson, 1311 Luling, stated she is in favor of building an events center in our city due to the economic benefits it will add to our community. Janna Bartz, 2411 Avenue F, stated our schedule for permitted use is outdated. She is in favor of building an event center as it would add catering opportunities for events here locally. Jackie Toups, 613 N. 14th St., stated there is no adequate parking for an events center, pedestrians walking at night could become a safety issue and she feels the city should consider this in more detail before moving forward. Jolei Shipley asked about the size of this building and stated that parking would be an issue. She suggested tabling this item and getting more specifics as to size. Renee O’Conner, 1131 Gary Avenue, questioned why the city wanted to change the building code at this point. Mayor Pro Tem Ortiz stated he is in favor of building an event center but wants to get more specifics on it and look at other possible opportunities. Mayor Darby stated he wants a definition of ‘Event Center’ and at this time, council is only discussing the addition of a new land use Event Centers to table 13.2 ‘Schedule of Permitted Uses.’ Don Albanese, 2305 Allan Court, stated we do have other buildings in our city, such as the Knights of Columbus Hall, that can be rented for various events Ray Herrera, 1120 Chicago, named several other halls in our area that can be rented out for events and suggested that the city utilize this land for some other venture that will generate revenue for our city. Patti Jones, 1011 Mimosa, stated that most churches have rooms/buildings for rent for special events. Keith Bass, 2415 Avenue E, commented that the city needs to focus on our drainage system and financial situation first. He asked about the city’s master plan and if it has Minutes continued, July 14, 2025 4 been updated recently. He stated there is no adequate parking for an event center and asked what was the purpose of this event center. Kay DeCuir, Executive Director of the NEDC, stated the event center would host trade shows, class reunions, bring in businesses to our area that are currently utilizing other venues outside of our city and promote growth. Our zoning needs to be updated in order for our city to grow. Maggie Guillot, 1519 Boston Avenue, commented she was in favor of the event center as it would attract tourism and help with our local businesses. There being no further questions and/or comments the Public Hearing was adjourned and the regular meeting was reconvened at 7:29 by Mayor Darby. h. A motion was made by Councilmember Jones and seconded by Councilmember Duplant to postpone amending the zoning text of table 13.2 until the August 11, 2025 meeting in order to receive further information on the definition of an ‘event center,’ the possible parking issues and size of the proposed center. MOTION CARRIED. AYES: Mayor Darby, Councilmembers Duplant, Jones, Sonnier, and Ortiz. NOES: None. Mayor Darby recommended adding ‘with a specific use permit’ language to the zoning text of table 13.2 also. i. The regular meeting was recessed and a Public Hearing was called to order at 7:36 by Mayor Darby for the purpose of discussing and receiving comments regarding the proposed request for a Specific Use Permit to locate an automotive shop for ceramic coatings, vinyl wraps and detailing at 1837 18th St. George Wheeler read the minutes of the Planning & Zoning’s June 10, 2025 meeting and stated this is a detail shop, not a paint and body shop. Jolei Shipley requested information about the size of the lot, size of the building, the exterior appearance and if this construction would affect the surrounding homes. Mr. Wheeler distributed a copy of the site plans for council to review. She requested that site plans on new construction be included as support documentation on future agendas. David Nguyen, 7645 Ontario Dr, owner of Glorified Detail, stated the street does hold water and this is a concern. This will be a 5,200 sq. ft. building that will have grading and a drainage engineer will submit plans to DD7 for approval. Ray Herrera commented this type of vehicle work does not involve many chemicals and is more environmental friendly. There being no further questions and/or comments the Public Hearing was adjourned and the regular meeting was reconvened at 7:50 by Mayor Darby. Minutes continued, July 14, 2025 5 j. A motion was made by Councilmember Jones and seconded by Councilmember Sonnier to postpone the proposed request for a Specific Use Permit to locate an automotive shop for ceramic coatings, vinyl wraps and detailing at 1837 18th St. until the July 28, 2025 meeting in order to receive further information on this issue. A motion was made by Councilmember Duplant and seconded by Councilmember Jones to approve Resolution 2025-09 authorizing the Mayor as the authorized signatory for contractual documents pertaining to the purchase of property located at 204 North 13th Street and 212 North 13th Street, described as Lots 16, 17 and 18, Block 17 of Town of Nederland, Jefferson County, Texas. MOTION CARRIED. AYES: Mayor Darby, Councilmembers Duplant, Jones, Sonnier, and Ortiz. NOES: None. l. A motion was made by Councilmember Sonnier and seconded by Mayor Pro Tem Ortiz to approve Resolution 2025-10 terminating the License to Encroach between the City and Johnny Powell and Jackie Powell related to Doornbos Park, and removal of structures. MOTION CARRIED. AYES: Mayor Darby, Councilmembers Duplant, Jones, Sonnier, and Ortiz. NOES: None. m. Discussion was held regarding the real property at 1123 Canal Avenue. Diane Young, 1408 N. 12th St., stated her lot has flooded after the construction of a building at 1123 Canal. She stated the building is not zoned for this area and she did not receive proper notice of the public hearing on this construction. Steve Gentile, 504 N. 34th St., who is the contractor for the church, stated the drainage has been engineered by Soutex and all water will be retained by the retention pond. He stated all due diligence was followed regarding the drainage and neighboring property owners were informed of the new construction. The land is sloped accurately and once completed, all runoff will drain properly. DD7 has widened the drainage ditch behind the property. Jolei Shipley stated this location is zoned R1 and cannot have a commercial building constructed here. Ryan Thomas, 3504 Terrace, stated Paul Baker is an elder of the church, no longer a Trustee. Ryan has been a member in this church since approximately 2019. The church has grown in the past years and needs more room. The church was bought from Pastor Ben Williams and at the time of the sale they did not know it was zoned R1. George Wheeler stated the new owners were issued an electrical permit at the time of the sale for a name change. Mr. Thomas stated the electricity was never turned off, just changed names. EXECUTIVE SESSION The regular meeting was recessed at 8:51 p.m. by Mayor Darby for the purpose of conducting an Executive Session as authorized by Texas Government Code, Consultation with City Attorney – Texas Government Code, Chapter 551.071, 1123 Canal Avenue. 6. RECONVENE The regular meeting was reconvened at 9:49 p.m. by Mayor Darby. 7. A motion was made by Councilmember Sonnier and seconded by Councilmember Duplant to postpone taking action on 1123 Canal Avenue until the July 28, 2025 meeting in order to allow time for legal review. An average of 2,653,000 gallons per day and a maximum of 2,944,000 gallons. A total of 20 bacteriological samples were taken to Sabine River Authority lab for analysis. All 20 samples passed. 41 distribution residuals were taken with an average of 1.26 mg/L. A total of 180 turbidity readings were taken with an average of 0.110 NTU and a maximum of 0.153 NTU. 95% of our monthly readings must be below 0.300 NTU. During the month of June, the Surface Water Treatment Plant (SWTP) converted to free chlorine. This was done as part of our annual distribution system maintenance. This involves the flushing of hydrants that are not part of our normal monthly flush list. We made sure that all of the parents knew they could go down to Pet Den and adopt a new pet after the show. **The Parks department had a princess themed family night on June 5th that got canceled. So that the food they had purchased for the night was not wasted, they called us and asked if we could put on a Princess High Tea and allow them to hand out sandwiches and lemonade. For a spur of the moment program, we’re proud of the turnout. Pickleball schedule is Tuesday, Thursday & Saturday from 10am-1pm. Wednesday evenings from 5pm-6pm for family/beginner play and 6pm-8pm for competition play. No Parks Advisory Board meeting this month. PAB meetings are held quarterly. The Parks & Rec dept. partnered with the Library for Afternoon Tea at the Library on June 6th. The Parks & Rec Dept held “National Go Fishing Day” on June 18th with 28 kids attending and 15 adults. The Nederland Pool will be open starting on May 21st-August 17th. At this meeting the P&Z took action on a recommendation to send to City Council to approve the SUP request with the allowance that the building permit be secured within one year and not 6 months of final approval. In our zoning ord inance for C-2 commercial zoning district section 12.3 height and area regulation chart doesn't require a maximum size limit for structures. It requires a minimum size and minimum lot size , front and rear setbacks and a maximum height of 35ft. The side yard setbacks are regulated by the building code. The building code list a repair garage as an F-1 type occupancy use. The maximum size of structures in commercial zones are regulated by the building code which sets the maximum area for group F-1 type use at 12,000 square feet without a sprinkler system and 34 , 000 sq . ft . with a sprinkler system installed. The code section regulating sprinkler system thresholds also sets the threshold for a sprinkler system install for this use at 12,000 sq . ft . So the 5200 sq. ft. is well below these requirements or maximums. Proposed land use -to conduct vehicle paint protection film installation, ceramic coatings, vinyl wraps and detailing. We are proposing to build state of the art facility for car enthusiasts to indulge and share a passion for the automotive lifestyle. Even though the business deals with vehicles, it will be based on a clean, organized and well-lit garage set up. Its focus is primarily cosmetic, as opposed to mechanical. The proposed land use will not conduct any type of transmission or engine repairs, tire changing or alignment services, brake repairs, spark plug or battery replacements, transmission or oil fluid changes, collision repairs, diagnostics, suspension repairs, heating and air condition repairs. Proposed site activities and operations • Hours of operations Monday -Friday 8-5PM with activities that include: o Paint protection film -application of a clear, thermoplastic urethane film that is applied to the exterior of the vehicle to prevent damage from rocks, bugs, and other road debris. It's designed to be virtually invisible once installed and has a self-healing component. o Ceramic coating -industry grade ceramic coating is a chemical polymer solution that is applied to the exterior of a vehicle to protect it from external paint damage. Typically applied by hand, it blends with the paint of your car and creates an additional hydrophobic layer of protection. o Colored vinyl wrapping -vinyl wraps are large sheets of vinyl material that are applied to the exterior of your car. Vinyls are mainly used to change the color of a vehicle without the need for paint. Vinyl wraps have a wide range of colors, patterns, and finishes, from matte black to chrome, and even custom designs. o Polishing -vehicle polishing is the process of removing minor clear coat damage ( scratches and swirl marks) using a polishing liquid to flatten the clear coat which increases the gloss-level. The polishing process can be performed by machine or by hand and should be followed by protecting the paint using a wax, sealant or coating. o Exterior detailing -cleaning and either restoring or exceeding the original condition of the surface of the car's finish, chrome trim, windows, wheels, tires, and other visible components on a vehicle's exterior. A wide array of detailing products and techniques are used based on the vehicle's surface type and condition or the detailers' or customers' preference. Products include, but are not limited to, detergents, surfactants, acid-free degreasers (to break down dirt and soil), detail clay (to remove invisible micro-embedded surface contaminates), waxes, and silicone-and non- silicone-based dressings for plastic trim and tires. Buffing compounds and polishes to resurface and improve the reflectivity of the paint finish, as well as a variety of applicators, brushes, and drying towels. Additional external detail work may include removing deeper scratches or imperfections in the paintwork. A liquid polymer may also add a protective layer to modern clear-coat automobile paints, making them more resistant to scratches and environmental damage. Exposure to sunlight oxidizes the lenses, and detailing may include restoration to remove cloudiness and revive clarity for the headlights. External detailing may also involve degreasing and cleaning the engine bay, making used internal combustion vehicles look newer and better maintained o Interior detailing -detailing the interior involves thoroughly cleaning all surfaces and trim of the vehicle's passenger cabin and trunk or cargo areas. Car interiors have included diverse materials, such as synthetic fiber carpeting and upholstery, vinyl, leather, natural fibers, carbon fiber composites, wood, rubber, plastics, etc. The variety of components in vehicle interiors necessitates various cleaning techniques and products. Vacuuming is standard, and upholstery stains may be removed using steam cleaning, liquid or foam chemicals, as well as brushes. The request is not for services such as engine overhaul , body repair and painting. If approved the motion should stipulate that the approval is for ceramic wrap, window tinting, detailing and shall not include engine repair and overhaul, body repair and painting. The permitted use chart in the zoning ordinance stimulates that a vehicle repair and maintenance shop must receive a specific use permit to locate in a C-2 neighborhood retail zoning district. The zoning ordinance fails to specify all services included with the use term , "vehicle repair and maintenance". The term vehicle repair and maintenance is defined in the zoning ordinance as establishments providing repair and maintenance services for passenger cars trucks and vans including painting and body work. I feel in this situation there is room for interpretation of whether the ceramic wrap of a vehicle is or should be classified within the term "vehicle repair and maintenance". With that being said , I determined that with this major investment of purchasing of the vacant land and complete construction of a new building both riding on the ability to legally have this type of business, I felt it be best that until further direction, I make the decision to require the specific use. This is a vacant lot so it doesn 't have any type of existing use. Please see the applicants submitted information on the services his business will be furnishing. In conclusion, I may add that when we were determining the property owners required to be notified within 200ft of the requested location, it took in some of the properties on Lindsey Ln which is actually out of the City limits. At the planning and zoning meeting two property owners from this area voiced their concerns. These property owners stated that it would generate to much additional traffic already overflowing with school traffic. It was discussed that this type of business would bring very little additional daily traffic compared to a restaurant other business types allowed as a use by right in this district. Mr. Nguyen commented that he is hopeful that the business will be able to turn out at least 30 vehicles a week. Vehicles are dropped off for service so traffic will not be in and out everyday traffic. All work will be inside the building with work hours being 8am to 5pm. The wash water will be discharged into a grit trap like a carwash and they use no added chemicals in the water. He added that this is not a paint and body shop. 3. (“TGS” or “Company”) filed a Statement of Intent with the City of Nederland (“City”) to increase gas rates within its Central-Gulf Service Area, West North Service Area, and Rio Grande Valley Service Area, by $41.1 million per year, with a proposed effective date of August 19, 2025; and WHEREAS, City has exclusive original jurisdiction over the rates, operations and services of a gas utility in areas in the municipality pursuant to Texas Utilities Code § 103.001; and WHEREAS, Texas Utilities Code § 103.021 requires a local regulatory authority to make a reasonable determination of rate base, expenses, investment and rate of return and retain the necessary personnel to determine reasonable rates; and WHEREAS, the City’s reasonable cost for regulatory expenses in ratemaking proceedings shall be reimbursed by the gas utility under Texas Utilities Code § 103.022; and WHEREAS, Texas Utilities Code § 104.107(a)(1) authorizes a local regulatory authority to suspend a utility’s proposed rate change for not longer than 90 days after the date the rate change would otherwise be effective; and WHEREAS, given the complexity of the proposed rate increase and the need to fully review the proposed rate adjustment, it is necessary to suspend the effective date for implementing the proposed rates until November 17, 2025, to allow the City’s rate experts sufficient time to determine the merits of TGS’s proposed rates; and WHEREAS, to maximize the efficient use of resources and expertise in reviewing, analyzing, and investigating TGS’s $41.1 million rate increase request, City’s efforts will be coordinated with similarly situated municipalities in TGS’s Central-Gulf Service Area; and WHEREAS, the City will join with other municipalities in a steering committee in order to coordinate the hiring and direction of counsel and consultants working on behalf of the steering committee and the City. The City employs The Lawton Law Firm, P.C. to represent the City with regard to TGS’s proposed rate increase before local and state regulatory authorities and any court of law and authorizes counsel to employ such rate experts as are recommended by the Steering Committee. Section 5. The Steering Committee shall review the invoices of the lawyers and rate experts for reasonableness before submitting the invoices to TGS for reimbursement. Section 6. TGS shall reimburse the City, through the designated representative of the Steering Committee, for the reasonable costs of attorneys and consultant fees and expenses related thereto, upon the presentation of invoices reviewed by the Steering Committee.
