NEDERLAND CITY COUNCIL AGENDA NOTICE is hereby given of a regular meeting of the Nederland City Council to be held Monday, October 27, 2025, 5:30 p.m., at the Nederland City Hall, 207 North 12th Street, Nederland, Texas, for the purpose of considering the following agenda items. The City Council reserves the right to retire into Executive Session concerning any of the agenda items whenever it is considered necessary and legally justified pursuant to Texas Government Code, Chapter 551. Members of the public can participate remotely via Zoom Teleconferencing. Citizens may join the Zoom Meeting by clicking on the Virtual Council Meeting https link on the City of Nederland’s website or calling the Zoom Call in Number and entering the Meeting ID# on the City of Nederland’s website. The City of Nederland's Council meeting will be live on the city's Facebook page (https://www.facebook.com/CityofNederlandTX) and the city's YouTube Channel (https://www.youtube.com/@CityofNederlandTX). PUBLIC COMMENT ON AGENDA ITEMS. Citizens may provide comments regarding the items listed on the Consent or Regular Agenda. Citizens will address the City Council from the podium after providing their name and address. CONSENT AGENDA All consent agenda items listed are considered to be routine by the City Council and will be enacted by one motion. I would recommend acceptance of all the below-listed items. a.Attached are the minutes of the October 13, 2025 regular meeting and October 6, 2025 special meeting. b.Attached are the September 2025 Departmental Reports for your review. c.The 2024-25 total adjusted tax levy is $7,871,046.39 and the amount of collections as of September 30, 2025 is $7,366,289.09 which represents 93.59% of the total tax levy. The 2024-2025 current year adjusted tax levy is $7,442,555.49 and the amount of collections as of September 30, 2025 is $7,290,283.39 which represents 97.95% of the current year tax levy. In comparison to prior year, the amount of property tax collected as of September 30, 2024 was $7,586,270.28 which represented 94.07% of the total tax levy and $7,477,777.94 of the current tax levy which represented 97.97%. The Finance Director recommends acceptance of the September 2025 Tax Collection Report, I concur with her recommendation. The end of year reports for fiscal year ended September 30, 2025 from the Jefferson County Tax Assessor Collector are also included. Nederland Little Dribblers requests usage of the Nederland Recreation Center for practices on Tuesdays and Thursdays from 5:30p.m. to 7:30p.m. Usage will begin November 3rd and conclude February 5th. Insurance will be submitted by Nederland Little Dribblers. The Parks Director recommends approval of the request. I concur with his recommendation. REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF NEDERLAND 5:30 p.m. October 13, 2025 1. MEETING The meeting was called to order at 5:30 p.m. by Mayor Darby at the Nederland City Office Building, 207 N. 12th Street, Nederland, Texas. See attached for quorum. The following statement was posted: “PURSUANT TO SECTION 30.07, PENAL CODE (TRESPASS BY LICENSE HOLDER WITH AN OPENLY CARRIED HANDGUN), A PERSON LICENSED UNDER SUBCHAPTER H, CHAPTER 411, GOVERNMENT CODE (HANDGUN LICENSING LAW), MAY NOT ENTER THIS PROPERTY WITH A HANDGUN THAT IS CARRIED OPENLY.” 2. INVOCATION AND PLEDGES OF ALLEGIANCE The invocation and the Pledges of Allegiance were led by Pastor Drew Weber, Wesley Methodist Church. 3. CITIZEN COMMENTS Michael Mitchell, Water Treatment Plant Supervisor, provided an update on recent water quality violation notices sent to residents regarding elevated TTHM and HAA5 levels detected in June during a free chlorine conversion. He explained the violation was due to sampling timing issues and that current water quality is safe. The violation will continue for 1-2 quarters due to the locational running annual average calculation. More information will be posted online and residents can contact the water plant with questions. Charlie Hallmark, 614 N. 26th St., expressed concerns about drainage issues in the easement behind his property that have occurred since 2015 when the city repaired a sewer line. He requested the city address the problem, as it is causing flooding in his yard and increased flood insurance costs. Mayor Darby directed staff to develop a plan to address the issue. 4. REGULAR AGENDA NEW BUSINESS a. A motion was made by Councilmember Sonnier and seconded by Mayor Pro Tem Ortiz to approve the Minutes of September 22, 2025 regular meeting and September 16, 2025 special meeting, as presented. MOTION CARRIED. AYES: Mayor Darby, Councilmembers Duplant, Jones, Sonnier, and Ortiz. NOES: None. Minutes continued, October 13, 2025 2 b. A motion was made by Councilmember Sonnier and seconded by Councilmember Duplant to approve an amended agreement with Westwood for the 2025 Sanitary Sewer Rehabilitation – Western Section project, subject to legal review. MOTION CARRIED. AYES: Mayor Darby, Councilmembers Duplant, Jones, Sonnier, and Ortiz. NOES: None. James Roberts of Westwood Professional Services presented an amended agreement for the 2025 sanitary sewer rehabilitation Western Section project. The revised proposal totals $651,000, an increase of $68,000 from the original proposal, due to underestimating the time required for the project scope. Council members asked questions about the reasons for the cost increase and timeline. After discussion, a motion was made to approve the amended agreement, subject to legal review. c. A motion was made by Councilmember Sonnier and seconded by Mayor Pro Tem Ortiz to postpone consideration until the October 27th meeting regarding an engineering agreement with Westwood for the Wastewater Treatment Plant Facility Assessment project, to allow time for review of the proposal and potential cost reductions. MOTION CARRIED. AYES: Mayor Darby, Councilmembers Duplant, Jones, Sonnier, and Ortiz. NOES: None. d. A motion was made by Councilmember Jones and seconded by Mayor Pro Tem Ortiz to accept donations from the Nederland Heritage Festival to the City of Nederland. MOTION CARRIED. AYES: Mayor Darby, Councilmembers Duplant, Jones, Sonnier, and Ortiz. NOES: None. Donations were made to various city departments totaling $38,184.14: - $2,477.04 to Animal Control for a dart gun - $9,012.88 to Fire and Rescue for escape air packs - $11,853.22 to Parks and Recreation for gym floor covering - $14,841 to Police Department for e-bikes e. Kay DeCuir, Executive Director of the Nederland Economic Development Corporation, gave a presentation on the EDC’s Fall Market Day and Fall Concert Series. f. A motion was made by Councilmember Sonnier and seconded by Mayor Pro Tem Ortiz to approve a request from the Nederland Rotary Club to utilize Doornbos Park for the annual Hooked on Fishing, Not on Drugs (HOFNOD) event. MOTION CARRIED. AYES: Mayor Darby, Councilmembers Duplant, Jones, Sonnier, and Ortiz. NOES: None. g. A motion was made by Councilmember Duplant and seconded by Mayor Pro Tem Ortiz to approve the closure of Boston Avenue between 15th Street and 17th Street and all intersections on Friday, October 31st for the Nederland Chamber of Commerce’s “Trunk-R-Treat” event. A motion was made by Councilmember Jones and seconded by Mayor Pro Tem Ortiz to approve a request from Windsor Stamey with Helena Elementary to utilize the Nederland Recreation Center gymnasium for a field trip for the Helena Singers. MOTION CARRIED. AYES: Mayor Darby, Councilmembers Duplant, Jones, Sonnier, and Ortiz. NOES: None. i. A motion was made by Councilmember Sonnier and seconded by Councilmember Duplant to grant an extension until October 31, 2025, to Johnny Powell to comply with city directives. A motion was made by Councilmember Duplant and seconded by Mayor Pro Tem Ortiz to approve the annual payment of the MCML Central Dispatch’s portion of the Regional Radio System costs. MOTION CARRIED. A motion was made by Councilmember Sonnier and seconded by Councilmember Duplant to approve the annual payment of the City of Nederland’s portion of the Regional Radio System costs. MOTION CARRIED. A motion was made by Councilmember Duplant and seconded by Councilmember Sonnier to authorize the purchase of a Trash Truck for the Public Works Department via HGAC or other state-approved contract. MOTION CARRIED. AYES: Mayor Darby, Councilmembers Duplant, Jones, Sonnier, and Ortiz. NOES: None. m. Steve Jordan with Schaumburg & Polk gave an update on the smoke testing. They have found 825 leaks on the municipal side and 1,534 leaks on the private service side. The testing is almost complete and should be finalized by the end of this week. The hydraulic analysis phase will begin. n. A motion was made by Mayor Darby to appoint Rustin Penland to the Nederland Economic Development Board. Discussion was held. Councilmember Duplant stated that he was in opposition of replacing Kasey Taylor on the board. Billy Neal, 1111 22nd St., stated he was in opposition of replacing Kasey Taylor on the board. Minutes continued, October 13, 2025 4 Kasey Taylor, R T Technical, 4484 Hodgson Rd, stated that the bylaws of the NEDC do not coincide with the bylaws of the city. She stated she has helped businesses in this town for 30 years and would like to continue to serve on the board. AYES: Mayor Darby. NOES: Councilmembers Duplant, Jones, Sonnier, and Ortiz. Kasey Taylor was reappointed to the Nederland Economic Development Board. o. The regular meeting was recessed and a Public Hearing was called to order at 6:41 p.m. by Mayor Darby for the purpose of discussing and receiving comments regarding the rezoning request from Nederland AC, Inc. to rezone four lots addressed as 1308 and 1216 South 27th Street being the split zoned lots with each lot having a front portion zoned C-2 Neighborhood retail commercial and the rear portions being zoned R-2 Duplex residential, each complete lot being requested to become C-2 Neighborhood retail commercial. Jolei Shipley, 8765 Holmes Rd., stated that zoning must be consistent with the city’s master plan. Nolan Tipps, 2707 Ave M, stated that he is in support of approving the rezoning of the church property to enable them to begin construction. Pastor Wesley Jackson, 1308 S. 27th St., stated that surrounding residents did get notification and there were no oppositions. There being no further questions and/or comments the Public Hearing was adjourned and the regular meeting was reconvened at 6:58 by Mayor Darby. p. George Wheeler, Chief Building Official, provided an update on code enforcement actions related to a property at 2120 Avenue H that is suspected of having unpermitted multiple dwelling units. The property owner has appealed the enforcement action to the Zoning Board of Appeals, with a hearing scheduled for the following day. Mayor Darby requested that a fire and safety inspection be completed on this property. 5. EXECUTIVE SESSION Minutes continued, October 13, 2025 5 The regular meeting was recessed at 7:12 p.m. by Mayor Darby for the purpose of conducting an Executive Session as authorized by Texas Government Code, Consultation with City Attorney – Texas Government Code, Chapter 551.071, Selection and contract negotiations regarding search firm for City Manager and Interim City Manager. 6. All 20 passed. 42 distribution residuals were taken with an average of 3.12 mg/L. A total of 180 turbidity readings were taken with an average of 0.103 NTU and a maximum of 0.275 NTU. 95% of our monthly readings must be below 0.300 NTU. Pickleball schedule is Tuesday, Thursday & Saturday from 10am-1pm. Wednesday evenings from 5pm-6pm for family/beginner play and 6pm-8pm for competition play. The Nederland Rec center was open to the public on September 1st for Labor Day. The Nederland Parks & Rec partnered with the Library for “Meet me at the Park” at Cropo Park on September 16th with 10 attending. The Nederland Parks & Rec celebrated “National Play-doh Day” at the Rec center with 4 adults and 6 children attending. Pickleball 101 was held on September 18th with 3 people attending at the Nederland Rec Gym. The Parks Advisory Board meetings are held quarterly. WORK INJURIES / SAFETY ▪ On September 4, 2025 a maintenance worker got in the way of another employee tossing asphalt and was hit in the knee. Employee went to Occupational Medical for treatment. He was put on light duty. Employee had a follow up visit on September 11, 2025. He was still put on light duty. Employee was released to full duty at his September 29, 2025 appointment. ▪ On September 2, 2025 a wastewater treatment employee rose up from the ground hitting his head on a piece of equipment causing a cut to employee’s head. First aid was administered. Employee did not seek medical treatment. ▪ On September 1, 2025 a police officer wrestled a suspect, attempting to flee, to the ground causing injuries. Employee saw the ER doctor. Employee established a treating workers’ comp doctor on September 2, 2025. He was placed on light duty. Employee was released to full duty at his appointment on September 9, 2025. ▪ On August 20, 2025 a maintenance worker was stepping out of a ditch and felt and heard his left calf area pop. Employee went to Occupational Medical for treatment for a calf strain. He was released to light duty, but the department could not accommodate light duty restrictions. INCIDENTS ▪ On September 8, 2025 a sanitation driver stopped at a stop sign and noticed a lot of water in the yard. Employee looked behind him but didn’t see anything. When he backed up, he backed into a Nissan Rouge, cracking the front grill and surrounding parts. A claim packet was emailed to claimant on September 9, 2025. This claim was submitted to TML on September 30, 2025. ▪ On September 11, 2025 code enforcement was traveling southbound in the 200 block of North 13 Street and turned east into the alleyway behind City Hall before sunrise. Upon entering the private drive, a bicyclist ran into the left front fender of the city vehicle. Police officer observed no light on the bicycle. The bicyclist was injured. REGULAR AGENDA NEW BUSINESS a. A presentation by Tina Martinez, Senior Vice Commander with the Veterans of Foreign Wars Post 4820 will speak on “Women in Veteran’s Service.” b. Michael Mitchell, Water Treatment Plant Supervisor will discuss the TCEQ violation notification letter sent to water utility customers recently and be available to answer questions. c. Attached is the final payment for the cleaning and reshaping of drainage ditches in Wards 3 and 4 via TIPS a state-approved purchasing co-operative. On March 24, 2025 City Council approved hiring Texas Drainage, Inc. for the first phase of the work for a total cost of $204,899.20 to be paid via the Street Department’s contractual services line-item (01-31-00-6393). The invoice for Texas Drainage represents the final payment after a punch list was completed and approved by the Street Department Supervisor. Texas Drainage’s superintendent and Mr. Lancaster reviewed the completed work. There was additional footage added as Nederland Avenue from S. 37th Street to Hardy Avenue, and Hardy Avenue from Avenue A to Avenue H was added due to the initially approved streets draining into the added areas. The cost for initial ditches was based on linear feet and actual feet increased the cost by $2,041.60, the additional ditches totaled $15,078.80 making the total project cost $222,019.60. I recommend approval of this item. d. Attached is the final payment and release of retainage for the 2024 HMAC Street Program project in the amount of $104,172.51. At the June 10th City Council meeting, the City awarded the 2024 HMAC (hot mix overlay) Street Program bid to Texas Materials, a CRH Company in the total amount of $1,797,090. The scope of work included: • Canal Ave from 27th Street to the HWY 69 frontage road (approx. 3,050lf) • Seattle from 18th St to the dead end (approx. 975lf) • 19th St from Queen to Seattle (approx. 525lf) • 21st St from Queen to Seattle (approx. 525lf) • 20th St from Queen to Canal (approx. 275lf) • Queen from dead end to dead end (approx. 600lf) Change Order No. 1 in the amount of $178,445.80 was approved at the September 23, 2024 City Council Meeting. Proposed CO#1 added re-surfacing of Atlanta Ave between Twin City Highway and 14th Street and the hot mix overlay of the alleyway between Atlanta Ave and Boston Ave from 13th St east to the dead-end and from the dead-end south to Atlanta Ave. The alleyway segment from 13th Street to 12th Street was reworked to help with alleyway drainage including the installation of new catch basins. The segment between 12th and dead-end had the brick walkway removed and replaced with 8” thick red tinted concrete with a herring bone stamped pattern. Intersections along Atlanta at 12th St, 13th St, and 14th St were not reworked under the scope of work. Both Atlanta Ave and the alleyways have a “chip seal” surface and were repaired. The contractor required an additional 30 calendar days to complete the work. Change Order No. 2 in the amount of $73,140.00 was approved at the December 9, 2024 City Council meeting. NISD had requested the open ditch north of Seattle to be replaced with culverts and to address the two drainage pipes discharging to the DD7 canal. The proposed work included installing inlets, 320 LF of storm pipe, and backfilling the ditch after installation. Soutex Surveyors & Engineers has provided the following: Contractor’s Certificate and Release, Contractor’s Certificate of Guarantee, Notice of Acceptability of Work, Contractor’s Affidavit of Payment of Debt and Claims, Certificate of Substantial Completion, Engineer’s Certificate of Completion, Final Payment Application and Change Order No.3 for final contract price based on as-built unit price quantities. The final contract price is $2,006,953.45 which includes the three change orders. I recommend approval of this item. e. Attached is proposed Ordinance No. 2025-21, amending the fiscal year 2025-2026 budget. Unanticipated local donations/grants have been approved for the Police, Fire, Animal Control and Parks Departments. The budget amendment increases both revenues and expenditures due to the awarded funds. The Nederland Heritage Festival Foundation approved the following grants; Police-purchase of three E-bikes-$14,481, Fire Rescue- purchase of three escape air packs-$9,013, Animal Control-purchase of a dart gun-$2,477 and Parks-purchase of gym floor covering with storage rack-$11,853. In addition, the Motiva First Responder Grant was awarded to the Police Department for purchase of “Stop the Bleed Kits”-$2,500 and Fire Rescue for the purchase of an escape air pack- $3,000. I recommend approval of this item. f. Attached is proposed Ordinance No. 2025-22, regarding the City of Nederland’s Texas Municipal Retirement System (TMRS). The Ordinance authorizes a (1) non-retroactive repeating cost of living allowance (COLA) for retirees and their beneficiaries and annually accruing updated service credits (Updated Service Credit (USC) updates a member's retirement benefit to keep pace with changes in their salary or their city's plan over their career. The City’s fiscal year 25-26 budget includes funds to implement the enhancement to include a 30% COLA non-retroactive option to the City’s current retirement plan. The last time a retiree COLA option was adopted occurred in 1984 and no current retirees/beneficiaries are receiving benefits from that period Effective January 1, 2026, the City’s contribution shall increase from 7.92% to 11.27% of eligible salaries; the contribution increase is due in part to increasing salaries and the retiree COLA option. Overall, the City’s retirement fund is in a strong position. I recommend approval of this item. g. Ms. Dora Manriquez, owner of property located at 2005 N Peterson St and the site of 10 De Mayo Mexican Restaurant has requested a new tap for sewer service. The location is outside of the city limits and is currently receiving water service from the City with the Certificate of Convenience and Necessity (CCN). There are several properties along N. Peterson that are provided water within the City’s CCN. The restaurant is not open pending several items including sewer service. After research by staff, it was determined that the City has the sewer CCN for only that property on N. Peterson and staff believes the sewer line was tied into a force main sewer line owned by Sunoco/Energy Transfer on the south side of Canal Street. It is believed that Ms. Manriquez’s property has grinder pumps trying to push the wastewater to the force main and it is insufficient to handle the flow. City staff has determined the cost to continue servicing sewer service to the N. Petersen property would be cost prohibitive as it is the only property with a city sewer CCN on this street. City staff met with Water District #10 (WCID#10) representatives who had also been approached by Ms. Manriquez and it was discussed the possibility of WCID#10 accepting the sewer service if their board was amenable. Mr. Tommy McDonald, General Manager stated his board met on Thursday, October 16th and they were agreeable if the City approved and the property owner was willing to connect to their service line. Because the City has the water service CCN for several properties on N. Petersen, if the City agrees to amend the sewer CCN to remove this property, the City will need to provide water usage totals to WCID#10 to allow them the information to bill for sewage. Mr. McDonald with WCID#10 will be available to answer questions the council may have. I recommend approval of amending the City’s sewer CCN to remove the property located at 2005 N. Petersen St. Maximum Contaminant Level Violation MCL, LRAA / TOTAL HALOACETIC ACIDS (HAA5) The Texas Commission on Environmental Quality (TCEQ) has notified the CITY OF NEDERLAND TX1230006 that the drinking water being supplied to customers had exceeded the Maximum Contaminant Level (MCL) for haloacetic acids (group of five). The U.S. Environmental Protection Agency (U.S. EPA) has established the MCL for haloacetic acids (group of five) to be 0.060 milligrams per liter (mg/L) based on locational running annual average (LRAA) and has determined that it is a health concern at levels above the MCL. Analysis of drinking water in your community for haloacetic acids (group of five) indicates a compliance value in quarter two (April–June) 2025 of 0.070 mg/L for DBP2-03, 0.095 mg/L for DBP2-02 and, 0.066 mg/L for DBP2-04. In quarter three (July-September) 2025 a compliance value of 0.071 mg/L for DBP2-03, 0.091 mg/L for DBP2-02 and, 0.066 mg/L for DBP2-04. Haloacetic acids are a group of volatile organic compounds that are formed when chlorine, added to the water during the treatment process for disinfection, reacts with naturally-occurring organic matter in the water. Some people who drink water containing HAA5 in excess of the MCL over many years may have an increased risk of getting cancer. You do not need to use an alternative water supply. However, if you have health concerns, you may want to talk to your doctor to get more information about how this may affect you. We are taking the following actions to address this issue: The City has converted back to Chloramines (Total Chlorine) from Free Chlorine and flushed the distribution system. This will greatly reduce the HAA5 levels, bringing the locational running average down each quarter. Increase 24-00-00-4410 Rescue Team Donations $ 3,000.00 Increase 24-22-06-6265 Supplies/Minor Tools & Equipment $ 3,000.00 Motiva First Responder Grant was awarded to the Fire Department for the purchase of one escape air pack used in conjunction with supplied breathing air system. 1 ORDINANCE NO. 2025-22 AN ORDINANCE REGARDING THE CITY OF NEDERLAND’S TEXAS MUNICIPAL RETIREMENT SYSTEM BENEFITS AUTHORIZING: (1) NON- RETROACTIVE REPEATING COLAS, FOR RETIREES AND THEIR BENEFICIARIES UNDER TMRS ACT §853.404(f) and (f-1), AND (2) ANNUALLY ACCRUING UPDATED SERVICE CREDITS. WHEREAS, the City of Nederland, Texas (the “City”), elected to participate in the Texas Municipal Retirement System (the “System” or "TMRS") pursuant to Subtitle G of Title 8, Texas Government Code, as amended (which subtitle is referred to as the "TMRS Act”); and WHEREAS, each person who is or becomes an employee of the City on or after the effective date of the City’s participation in the System in a position that normally requires services of 1,000 hours or more per year (“Employee”) shall be a member of the System (“Member”) as a condition of their employment; and WHEREAS, House Bill 2464, 88th Texas Legislature, R.S., 2023 (“HB 2464”), added Subsections 853.404(f) and (f-1) to the TMRS Act and authorized cities participating in the System to provide certain retirees and their beneficiaries with an annually accruing (“repeating”) annuity increase (also known as a cost of living adjustment, or “COLA”) based on the change in the Consumer Price Index for All Urban Consumers for the one-year period that ends 12 months before the January 1 effective date of the applicable COLA (a “non-retroactive repeating COLA”); and WHEREAS, new TMRS Act §853.404(f) and (f-1) allow participating cities to elect to provide non-retroactive repeating COLAs under certain circumstances, as further described by this Ordinance, by adopting an ordinance to be effective January 1 of 2024, 2025 or 2026, in accordance with TMRS Act §854.203 and §853.404; and WHEREAS, TMRS Act §853.404(f-1) provides the non-retroactive repeating COLA option applies only to a participating city that, as of January 1, 2023, either (1) has not passed an annually repeating COLA ordinance under TMRS Act §853.404(c) or had previously passed a repeating COLA ordinance and then, before January 1, 2023, passed an ordinance rescinding such repeating COLA, or (2) does provide an annually repeating COLA under §853.404(c) and elects to provide a non-retroactive repeating COLA under §853.404(f) for purposes of maintaining or increasing the percentage amount of the COLA; and WHEREAS, the City Council acknowledges that the City meets the above-described criteria under §853.404(f-1) and is eligible to elect a non-retroactive repeating COLA under §853.404(f) and that such election must occur before January 1, 2026, and after that date future benefit changes approved by the City may require reversion to a retroactive repeating COLA; and WHEREAS, the City Council finds that it is in the public interest to: (1) adopt annually accruing non-retroactive COLAs for retirees and their beneficiaries under TMRS Act §853.404(f) and (f-1); and (2) in accordance with TMRS Act §853.404 and §854.203(h), reauthorize annually accruing Updated Service Credits; now: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF NEDERLAND, TEXAS: 2 Section 1. Adoption of Non-Retroactive Repeating COLAs. (a) On the terms and conditions set out in TMRS Act §854.203 and §853.404, the City authorizes and provides for payment of the increases described by this Section to the annuities paid to retired City Employees and beneficiaries of deceased City retirees (such increases also called COLAs). An annuity increased under this Section replaces any annuity or increased annuity previously granted to the same person. (b) The amount of the annuity increase under this Section is computed in accordance with TMRS Act §853.404(f) as the sum of the prior service and current service annuities, as increased in subsequent years under TMRS Act §854.203 or TMRS Act §853.404(c), of the person on whose service the annuities are based on the effective date of the annuity increase, multiplied by 30% of the percentage change in the Consumer Price Index for All Urban Consumers during the 12-month period ending in December of the year that is 13 months before the effective date of the increase under this Section. (c) An increase in an annuity that was reduced because of an option selection is reducible in the same proportion and in the same manner that the original annuity was reduced. (d) If a computation under this Section does not result in an increase in the amount of an annuity, the amount of the annuity will not be changed under this Section. (e) In accordance with TMRS Act §853.404(f-1)(2), an increase under this Section only applies with respect to an annuity payable to a TMRS Member, or their beneficiary(ies), which annuity is based on the service of a TMRS Member who retired, or who is deemed to have retired under TMRS Act §854.003, not later than the last day of December of the year that is 13 months before the effective date of the increase under this Section. (f) The amount of an increase under this Section is an obligation of this City and of its account in the benefit accumulation fund of the System. (g) The initial increase in annuities authorized by this Section shall be effective on January 1 immediately following the year in which this Ordinance is approved, subject to receipt by the System prior to such January 1 and approval by the Board of Trustees of the System (“Board”). Pursuant to TMRS Act §853.404, an increase in retirement annuities shall be made on January 1 of each subsequent year, provided that, as to such subsequent year, the actuary for the System has made the determination set forth in TMRS Act §853.404(d), until this Ordinance ceases to be in effect as provided in TMRS Act §853.404(e). Section 2. Authorization of Annually Accruing Updated Service Credits. (a) As authorized by TMRS Act §854.203(h) and §853.404, and on the terms and conditions set out in TMRS Act §§853.401 through 853.404, the City authorizes each Member who on the first day of January of the calendar year immediately preceding the January 1 on which the Updated Service Credits will take effect (i) has current service credit or prior service credit in the System by reason of service to the City, (ii) has at least 36 months of credited service with the System, and (iii) is a TMRS- contributing Employee of the City, to receive “Updated Service Credit,” as that term is defined and calculated in accordance with TMRS Act §853.402. (b) The Updated Service Credit authorized and provided under this Ordinance shall be 100% of the "base Updated Service Credit" of the TMRS Member calculated as 3 provided in TMRS Act §853.402. (c) If the City previously adopted an ordinance authorizing Updated Service Credit for unforfeited prior service credit and/or current service credit with another System participating municipality (also known as “Transfer USC”), the calculations and adjustments set forth in TMRS Act §853.601 apply to any such prior Transfer USC. (d) Each Updated Service Credit authorized and provided by this Ordinance shall replace any Updated Service Credit, prior service credit, special prior service credit, or antecedent service credit previously authorized for part of the same service. (e) The initial Updated Service Credit authorized by this Section shall be effective on January 1 immediately following the year in which this Ordinance is approved, subject to receipt by the System prior to such January 1 and approval by the System’s Board. Pursuant to TMRS Act §853.404, the authorization and grant of Updated Service Credits in this Section shall be effective on January 1 of each subsequent year, using the same percentage of the “base Updated Service Credit” stated in Subsection (b) in computing Updated Service Credits for each future year, provided that, as to such subsequent year, the actuary for the System has made the determination set forth in TMRS Act §853.404(d), until this Ordinance ceases to be in effect as provided in TMRS Act §853.404(e).
