11-10-2025 Agenda NEDERLAND CITY COUNCIL AGENDA NOTICE is hereby given of a regular meeting of the Nederland City Council to be held Monday, November 10, 2025, 5:30 p.m., at the Nederland City Hall, 207 North 12th Street, Nederland, Texas, for the purpose of considering the following agenda items. The City Council reserves the right to retire into Executive Session concerning any of the agenda items whenever it is considered necessary and legally justified pursuant to Texas Government Code, Chapter 551. Members of the public can participate remotely via Zoom Teleconferencing. Citizens may join the Zoom Meeting by clicking on the Virtual Council Meeting https link on the City of Nederland’s website or calling the Zoom Call in Number and entering the Meeting ID# on the City of Nederland’s website. I would recommend acceptance of all the below-listed items. a. Attached are the minutes of the October 27, 2025 regular meeting and October 17, 2025 special meeting. b. Staff requests the closure of Boston Avenue from 15th Street to 17th Street on Saturday, December 6, 2025 for the 15th annual “Christmas on the Avenue” event. The streets and intersections would be closed from 7a.m. to 9p.m. to allow for event set up, program, and clearing of the street. c. Nederland First Baptist Church requests the closure of South 20th Street between Avenue A and Avenue B from Friday, November 21st through Wednesday, December 31st. The Church will provide a Christmas lights show for the public; the street closure will allow the public to safely attend. The City will provide the detour ahead and street closed signage, and the Church will provide the barricades and cones to block the street. I recommend approval of this item. d. Nederland Little Dribblers requests usage of the Nederland Recreation Center for their games on December 6, 2025 and January 17, 2026. Usage times can be flexible to meet the needs of the league and the department. Insurance will be submitted by Nederland Little Dribblers. The Parks Director recommends approval of the request. I concur with his recommendation. REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF NEDERLAND 5:30 p.m. October 27, 2025 1. MEETING The meeting was called to order at 5:30 p.m. by Mayor Darby at the Nederland City Office Building, 207 N. 12th Street, Nederland, Texas. See attached for quorum. CITIZEN COMMENTS Jacqueline Toups, 613 N. 14th St., addressed the council regarding the Zoning Board of Appeals process. She wanted to clarify that after someone has appealed an issue to the Zoning Board of Appeals, the next step is to take the matter to court, not address the city council. She stated this is a misconception and recommended that the city create a pamphlet explaining the proper appeal process and have recipients sign for it when receiving. 4. Discussion and possible action to approve a request from the Nederland Little Dribblers to utilize the Nederland Recreation Center for practices on Tuesday and Thursday evenings from November 2025 thru February 2026. 5. REGULAR AGENDA NEW BUSINESS a. Tina Martinez, Senior Vice Commander of the Veterans of Foreign Wars Post 4820 in Port Neches gave a presentation on ‘Women in Veterans Services,’ highlighting women’s military service throughout American history. b. Michael Mitchell, Water Treatment Plant Supervisor, presented detailed information about a recent water quality violation. Mitchell explained that the violation involved disinfection byproducts (TTHMs and HAA5s) that exceeded maximum contaminant levels during the second quarter of 2025. Mr. Mitchell clarified residents do not need to boil water and that the current water supply is compliant and safe for all uses including restaurants, schools, and nursing homes. He explained that the violation occurred during a routine free chlorine conversion process in June. c. A motion was made by Councilmember Sonnier and seconded by Councilmember Duplant to approve final payment to Texas Drainage for the ditch cleanout project. MOTION CARRIED. AYES: Mayor Darby, Councilmembers Duplant, Sonnier, and Ortiz. NOES: Councilmember Jones. Jolei Shipley, 8765 Holmes Rd, raised concerns about the project and stated she had not viewed the contract. She also noted ongoing issues with specific locations that remain unaddressed. d. A motion was made by Councilmember Jones and seconded by Mayor Pro Tem Ortiz to approve final payment and release of retainage for the 2024 HMAC Street Program project. MOTION CARRIED. A motion was made by Mayor Pro Tem Ortiz and seconded by Councilmember Sonnier to approve Ordinance No. 2025-21, amending the fiscal year 2025-2026 budget. MOTION CARRIED. A motion was made by Councilmember Jones and seconded by Mayor Pro Tem Ortiz to approve Ordinance No. 2025-22, Texas Municipal Retirement System adjustment including cost of living increases for retirees. Tommy McDonald with Water District #10 stated Water District #10 Board of Directors did approve to serve sanitary sewer service to 2005 Peterson Street. h. A motion was made by Councilmember Jones and seconded by Councilmember Sonnier to approve the Minutes of October 13, 2025 with the correction on Item 4.i, regarding his vote on a motion related to Johnny Powell's extension. The minutes were amended to reflect that Jones voted "no" rather than "yes" on the motion. MOTION CARRIED. AYES: Mayor Darby, Councilmembers Duplant, Jones, Sonnier, and Ortiz. NOES: None. Mayor Darby announced that Bruce Mills will begin serving as interim city manager beginning Monday, November 3, 2025. Mr. Mills has extensive background in Austin city government and police work. Mayor Darby also thanked interim City Manager Cheryl Dowden for her service over the past six months. 6. Attached is Proclamation recognizing National Nurse Practioner Week and recognizing the 12th anniversary of the Southeast Texas Nurse Practitioner Association. b. Attached is Proclamation recognizing United States Marine Corp Day and declaring November 10, 2025 as “United States Marine Corps Day.” c. Attached is Resolution 2025-17 Honoring the Bravery of Police Officers in Rescuing a Citizen from a Burning House and recognizing Sergeant Chase Romero and Officer Brant Halfin for their heroism. d. In accordance with the Texas Tax Code Section 351.101.c, it is necessary for the City to review and accept the quarterly Hotel Occupancy Tax Fund financial report from the Nederland Chamber of Commerce. Attached is the Chamber’s report for the 2025 3rd Quarter (July 1st – September 30th). Revenues exceed expenditures by $8,440.28. I recommend acceptance of the quarterly report. e. Discussion and possible approval of Recreation Center lighting upgrade via state approved contract. Attached is a quote from Spark Lighting, LLC for LED lighting and installation costs in the amount of $46,750. The purchase is reimbursable by grant awarded from the State Energy Conservation Office’s (SECO) Municipally Owned Building Energy Efficiency Retrofit Program. At the September 23, 2024 City Council meeting, an Agreement for the SECO grant between the City and the Texas Comptroller of Public Accounts was approved for $50,000. The grant request included LED lighting upgrades to the Nederland Recreation Center with no local match. Staff recommends approval of the purchase; I concur with his recommendation. f. Attached is Resolution 2025-18, casting votes for Bert Lamson as a candidate for the Board of Directors of the Jefferson County Appraisal District (JCAD). In accordance with Section 6.03 of the Property Tax Code, is it necessary for City Council to cast votes for one nominee or distribute them as you wish. Mr. Lamson is a mid-county representative nominated by the City of Groves. New legislation has implemented staggered terms, so only two of the five appointed positions on the Board of Directors are up for re-election. The City of Nederland holds 22 (1.10%) votes of JCAD. I recommend approval of this item. g. Attached is Ordinance 2025-23 amending the fiscal year 2025-2026 budget in accordance with the Ordinance 2025-23 which states “That any unencumbered funds remaining on hand at the end of the fiscal year ending September 30, 2025, shall be construed with and classified with Miscellaneous revenue anticipated during the fiscal year beginning October 1, 2025, and ending September 30, 2026. The attached ordinance provides funds for; contract services for Interim City Manager hired effective November 3, 2025, remaining obligated funds on contract for forensic audit approved in FY24-25, police department spike strips and dress class A uniforms for officers, dedicated funds for NISD mental health services through Samaritan Counseling and increased cost of the Regional Radio System cost for MCML dispatch. I recommend approval. h. Attached is proposed Resolution No. 2025-19, authorizing account representatives for the City’s Texpool Investment Account. The City has had an account with Texpool since 1997, and it is necessary to update the authorized signatories to include both of the City’s investment offices (interim city manager and finance director) since Texpool requires a minimum of two signatures to transact business on behalf of the City. The finance director recommends approval of this item; I concur with her recommendation. i. Attached is invoice number 1088 from GovWell Technologies, Inc. in the amount of $35,000 for annual subscription fees for building permits & inspections, planning & zoning, public works permits, contractor registration and resident requests and work orders modules. The subscription term is October 1, 2025 through September 30, 2026. Purchase of this software was approved in the fiscal year FY25-26 budget and purchasing policy requirements require approval from City Council for purchases exceeding $25,000. I recommend approval of this item. j. Attached is invoice 1418 from Samaritan Counseling Center of Southeast Texas for a mental health wellness program for NISD. At the December 9, 2024 City Council meeting, council approved the dedication of funds in the amount of $50,000 for mental health services of NISD for the 2025-2026 school year allocated to the Coronavirus Local Fiscal Recovery Funds (CLFRF). The CLFRF funding needed to be obligated by December 31, 2024 and those funds are no longer available for this program. Included in Ordinance 2025-23 is a budget amendment to approve funding for the mental health wellness program for NISD as the previous city council authorized this expenditure. I recommend approval. k. Discuss and possible action approving reclassification of Cheryl Dowden from Interim City Manager to Assistant to the City Manager at grade 127, step 7 effective November 3rd through November 30th. With the hiring of Bruce Mills as Interim City Manager effective November 3rd, it is necessary to reclassify Ms. Dowden as Assistant to the City Manager for the remainder of the month as she will retire from the City effective November 30, 2025. I recommend approval. CITY OF NEDERLAND “PROGRAMMED FOR PROGRESS” Nederland, Texas Proclamation WHEREAS, this November, we celebrate National Nurse Practitioner Week and recognize the 12th anniversary of the Southeast Texas Nurse Practitioner Association. SETXNP is a non-profit organization dedicated to serving the Southeast Texas community through education, advocacy and outreach. Their members volunteer countless hours at health fairs, lead initiatives such as the clinic drive to support local school nurses, and partner with schools and law enforcement to educate the public on important health issues; and WHEREAS, SETXNP has donated to local women’s and children’s organizations and supported Kerrville victims. They have contributed significantly to the annual Alzheimer’s Walk at the Beaumont Event Center, raising more than $15,000 over the past three years. They have been recognized as one of the top donating teams, with several champion walkers – including a grand champion walker – and a member honored to participate in the opening ceremony. WHEREAS, SETXNP exists to serve the Southeast Texas community with love, compassion, and dedication. NOW, THEREFORE, I, Jeffrey P. Darby, Mayor Attest: Joni Underwood, City Clerk CITY OF NEDERLAND “PROGRAMMED FOR PROGRESS” Nederland, Texas Proclamation WHEREAS, on November 10, 1775, the Continental Congress resolved to recruit and equip “two battalions of Marines” to provide shipboard security and boarding parties for the Continental Navy (where they got their nickname “Leathernecks” due to the high leather collars they wore to protect against swords), and WHEREAS, Captain Samuel Nicholas was commissioned the first officer of Marines, and WHEREAS, the first recruiting station was set up in Tun Tavern, and WHEREAS, United States Marines distinguished themselves throughout the American Revolution in naval battles against the Royal Navy, and WHEREAS, Marines served throughout the 19th and early 20th centuries, including during the Barbary Wars (“the shores of Tripoli”), the Battle of Chapultepec in the war against Mexico (“the halls of Montezuma”), and in expeditionary duties in Panama, China, Cuba, Veracruz, Nicaragua, Haiti, Santo Domingo, and others, and WHEREAS, , the Corps served in France during World War One where their determination and perseverance against battle-hardened German forces caused the Germans to give them their nickname Teufelhunden, or “Devil Dogs”, and WHEREAS, , the United States Marine Corps was a key to the “island hopping” campaign of World War Two in the Pacific Theater, most famously in the raising of the United States flag over Mount Suribachi in the Battle of Iwo Jima, and WHEREAS, Marines continued their service in Korea, particularly in the Pusan Perimeter and the Chosin Reservoir (the Chosin Few), and WHEREAS, the Marine Corps was a key element of United States forces in the I Corps region of South Vietnam during the Vietnam War, fighting both the Viet Cong and North Vietnamese regulars, and WHEREAS, the Marines continued their expeditionary duties in Lebanon from 1982 to 1984, including the tragic loss of 220 Marines (along with 18 sailors and three soldiers) in the Bombing of the Beirut Barracks on 23 October 1983, the bloodiest day in Marine Corps history outside of declared wars, and WHEREAS, Marines liberated Grenada from communism from October 25 to November 1, 1983, and WHEREAS, the Corps played a role in the invasion of Panama in December 1989, and WHEREAS, the United States Marine Corps fought in the Gulf War of 1991 where they were key to the Liberation of Kuwait, in Somalia in 1993, in Afghanistan from 2001 to 2021, and in Iraq from 2003 to 2011 (particularly during the March and April 2003 invasion and Al Anbar Province from 2004 to 2007), and WHEREAS, in these 250 years of history the Marines have lived up to their motto, Semper Fidelis (“Always Faithful”), to our Constitution, our country, and its people, and “are proud to claim the title of United States Marines”. Killarney, which is located just outside the city limits of the City of Nederland; and WHEREAS, upon arrival at the scene, the officers were informed that an individual was trapped inside the burning home, with the residence fully engulfed in flames and fire venting out the windows of the structure; and WHEREAS, without hesitation or regard for their own safety, the officers entered the burning building through the garage, navigating hazardous conditions in an attempt to locate and extract the individual. After several moments inside the residence, the officers were not able to progress to the rear of the residence due to the heat and smoke. The hallway was engulfed in flames. The officers exited the residence and went to the rear of the residence, where the fire was now venting out the rear bedroom. Upon removal of the window A/C unit, officers were able to see the resident deceased just inside the window. WHEREAS, their actions exemplify the highest standards of bravery, quick thinking, and commitment to public service, reflecting great credit upon themselves, their department, and the entire law enforcement community; and WHEREAS, the courage demonstrated in this life-threatening situation serves as a powerful reminder of the risks our law enforcement officers face daily in the line of duty; NOW, THEREFORE, BE IT RESOLVED, that we, the City of Nederland, on behalf of a grateful community, formally commend and honor the heroism of Sergeant Chase Romero and Officer Brant Halfin, and all members of the Nederland Police Department, who took part in this rescue; and BE IT FURTHER RESOLVED, that this resolution be entered into the official records as a lasting tribute to their bravery, service, and unwavering dedication to the protection of human life. RESOLUTION NO. 2025-19 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEDERLAND, TEXAS, AMENDING AUTHORIZED REPRESENTATIVES OF TEXPOOL WHEREAS, the City of Nederland is a local government of the State of Texas and is empowered to delegate to a public funds investment pool the authority to invest funds and to act as custodian of investments purchased with local investment funds; and WHEREAS, it is in the best interest of the Participant to invest local funds in investments that provide for the preservation and safety of principal, liquidity, and yield consistent with the Public Funds Investment Act; and WHEREAS, the Texas Local Government Investment Pool (“TexPool / Texpool Prime”), a public funds investment pool, was created on behalf of entities whose investment objective in order of priority are preservation and safety of principal, liquidity, and yield consistent with the Public Funds Investment Act.
