02-23-2026 Agenda with attachmentsNEDERLAND CITY COUNCIL AGENDA NOTICE is hereby given of a regular meeting of the Nederland City Council to be held Monday, February 23, 2026, 5:30 p.m., at the Nederland City Hall, 207 North 12th Street, Nederland, Texas, for the purpose of considering the following agenda items. The City Council reserves the right to retire into Executive Session concerning any of the agenda items whenever it is considered necessary and legally justified pursuant to Texas Government Code, Chapter 551. Members of the public can participate remotely via Zoom Teleconferencing. Citizens may join the Zoom Meeting by clicking on the Virtual Council Meeting https link on the City of Nederland’s website or calling the Zoom Call in Number and entering the Meeting ID# on the City of Nederland’s website. PUBLIC COMMENT ON AGENDA ITEMS. Citizens may provide comments regarding the items listed on the Consent or Regular Agenda. Citizens will address the City Council from the podium after providing their name and address. Comments shall not exceed three minutes. 1. CALL THE MEETING TO ORDER 2. The 2025-26 total adjusted tax levy is $8,633,622.83 and the amount of collections as of January 31, 2026 is $6,588,946.76 which represents 76.32% of the total tax levy. The 2025-2026 current year adjusted tax levy is $8,162,823.68 and the amount of collections as of January 31, 2026 is $6,585,212.98 which represents 80.67% of the current year tax levy. In comparison to prior year, the amount of property tax collected as of January 31, 2025 was $6,022,847.09 which represented 76.05% of the total tax levy and $5,977,662.56 of the current tax levy which represented 80.18%. I recommend acceptance of the January 2026 Tax Collection Report. MEETING The meeting was called to order at 5:30 p.m. by Mayor Darby at the Nederland City Office Building, 207 N. 12th Street, Nederland, Texas. See attached for quorum. INVOCATION AND PLEDGES OF ALLEGIANCE The invocation and Pledges of Allegiance were led by Councilmember Sonnier. 5. EXECUTIVE SESSION Mayor Darby moved the first of two executive sessions to the beginning of the meeting. The regular meeting was recessed at 5:31 p.m. by Mayor Darby for the purpose of conducting an Executive Session as authorized by Texas Government Code, Consultation with Attorney, Section 551.071 of the Texas Government Code, regarding the forensic audit. 6. RECONVENE The regular meeting was reconvened at 6:15 p.m. by Mayor Darby. He announced the Executive Session was held for informational purposes only and no action is necessary. 3. CITIZEN COMMENTS Robert Klinger of 1140 Kent Avenue addressed the council regarding building rules and ordinances. He stated the established building rules and ordinances previously approved by city council should not be up for debate or deviation. He specifically discussed concerns about multifamily housing and rental properties and requested that the council consider a moratorium on duplexes. Jackie Toups, 613 N. 14th Street, questioned the process for reviewing city manager applications, stating there was a conflict of interest with HR personnel reviewing Minutes continued, February 9, 2026 2 applications for their future boss. She expressed concern about the proposed salary range of $161,000 to $219,000 for the city manager position. She also requested the establishment of a citizen committee or advisory panel to help select the city manager. Keith Bass, 2415 Avenue E, discussed neighborhood safety concerns, particularly regarding speed limits. He stated 30mph in a residential neighborhood is too high of a speed limit. He requested another speed study and suggested reducing residential speed limits to 20-25 mph. Bass also proposed quarterly town hall meetings on Saturdays to accommodate citizens who cannot attend evening meetings. David Wedgworth, 712 Carriage Lane, inquired about the status of final reports received from Schaumburg & Polk. Jolie Shipley, 8765 Homes Road, addressed several concerns, including the lack of response to citizen comments and the failure to place recurring issues on council agendas. She mentioned specific issues including the moratorium on duplexes, Schaumburg & Polk contract approval, city manager applications, code enforcement problems, and the lack of a master plan for the city. 4. A motion was made by Mayor Pro Tem Ortiz and seconded by Councilmember Sonnier to approve the Consent Agenda Item “a” as presented. MOTION CARRIED. AYES: Mayor Darby, Councilmembers Jones, Sonnier, and Ortiz. NOES: None. ABSENT: Councilmember Duplant a. Minutes – February 2, 2026 regular meeting 8. REGULAR AGENDA NEW BUSINESS a. The Nederland Little Dribblers have made other arrangements and their usage of the Nederland Recreation Center is no longer needed. b. A motion was made by Mayor Pro Tem Ortiz and seconded by Councilmember Jones to approve the Nederland Chamber of Commerce’s Hotel Occupancy Tax Fund financial report as presented. MOTION CARRIED. AYES: Mayor Darby, Councilmembers Jones, Sonnier, and Ortiz. NOES: None. ABSENT: Councilmember Duplant Minutes continued, February 9, 2026 3 Jolei Shipley questioned whether all hotels and short-term rentals were properly reporting and paying the required taxes. She noted concerns about the Mid Jeff Hospital property and requested an audit of hotel/motel tax compliance. c. Charlie Hallmark, 614 N. 26th St., presented their ongoing drainage concerns. Charlie Hallmark explained that after the city performed sewer line work in 2015, a new drainage problem was created in the easement behind their property. He stated the water now pools and does not drain properly. The Hallmarks presented photographs showing standing water in the easement and expressed frustration with years of unfulfilled promises from city staff. Charlie Hallmark stated they were promised and assured that the issue would be resolved but as of now, has not. Craig Devillier, 606 N. 26th Street, the Hallmarks' neighbor, corroborated their account, confirming that flooding began in 2015 after the city's sewer work and that his property is also affected. Interim City Manager Bruce Mills provided background on the issue, noting that the subdivision was originally platted for front drainage, not rear drainage, and recommended that water should be directed to the front of properties as designed. Council members discussed potential solutions, including connecting to the DD7 drainage ditch. The Mayor indicated this would be followed up on promptly. d. Interim City Manager, Bruce Mills, stated the city’s current sidewalk ordinance needs to be revised and will continue research work on this. This item will be brought back to council at a later date with more information and recommendations. e. Item 8.e, Request for Proposals for Windstorm Insurance, was postponed until the February 23rd meeting so that proposals can be reviewed and recommendations made. f. A motion was made by Councilmember Sonnier and seconded by Mayor Pro Tem Ortiz to approve Change Order No. 1, final payment of $78,532.00 and release of retainage for the 2024 Waterline Project. A motion was made by Councilmember Sonnier and seconded by Mayor Pro Tem Ortiz to approve the Order of General Election for the City of Nederland’s May 2026 general election. MOTION CARRIED. plant treated 85,659,000 gallons. An average of 2,764,000 gallons per day and a maximum of 3,665,000 gallons. A total of 20 bacteriological samples were taken to Sabine River Authority lab for analysis. All 20 passed. 43 distribution residuals were taken with an average of 3.24 mg/L. A total of 184 turbidity readings were taken with an average of 0.105 NTU and a maximum of 0.167 NTU. 95% of our monthly readings must be below 0.300 NTU. The Interim City Manager previously informed the Council that the City issued a Request for Proposals (RFP) for windstorm insurance coverage for City facilities. The RWL Group, the City’s insurance consultant, has assisted staff throughout this process. Attached is their recommendation, along with supporting documentation, for Council’s consideration and action. Additionally, Carolyn Miller, consultant with the RWL Group, will be available via Zoom to answer any Council questions regarding the recommended coverage options. Langham Elementary third grade classes have requested the usage of the Recreation Center on March 4, 2026 for a field trip. This would require the facility to be closed to the public during normal business hours from 11:30-2:30 that day. I recommend approval of this item. Buckstin Brewery Company has submitted a request to operate a temporary beer garden on the vacant lot between 1208 and 1220 Boston Avenue. The Brewery has received permission from the lot owner for this use. The Texas Alcohol Beverage Commission prescribes the requirements for this use including “approval from local officials.” The request has been reviewed by Mr. Wheeler, the Nederland Police Department and Nederland Fire Department. The beer garden would operate on the vacant lot that is enclosed with temporary fencing. Occupancy would be limited to 99 persons; no smoking would be allowed in the tent area; and no combustible materials such as hay, saw dust, etc. would be used. Due to the proximity of the Brewery storefront and the proposed beer garden, this use is considered an “accessory use.” Per TABC guidelines, a patron cannot enter or exit the beer garden with alcohol. The requested use is during the week of the Nederland Heritage Festival (Wednesday, March 11th – Saturday, March 14th), but the beer garden is not affiliated with the Festival. The Inspections Department, Police Department, and Fire Department do not have objections to the request, and none reported any issues in past years. I concur with their recommendation. In accordance with Articles 2.131 – 2.138 of the Texas Code of Criminal Procedures, the Nederland Police Department shall present its annual “Racial Profiling Report”. The report fulfills the statutory requirements to report contacts and the racial/ethnic breakdowns. Police Chief Carroll recommends approval of this item; I concur with his recommendation. f. Attached is the quarterly investment report for the quarter ending September 30, 2025. Interest earned for the quarter ending September 30, 2025 totaled $765,383.48 (Texpool $678,425.63 and Stellar $86,957.85). Texpool interest percentages have fallen slightly but remain strong, with an average interest rate of 4.2897% for the 3rd quarter 2025, compared to 4.3259% for the 2nd quarter 2025. The City’s depository account with Stellar Bank pays interest on demand deposits currently at a rate of 3.0833%, compared to 3.09% in the previous quarter. I recommend acceptance of the Quarterly Investment Report ending September 30, 2025. g. Attached is proposed ordinance 2026-02 , budget amendment for staffing needs in three departments. The City Manager’s department is requesting reinstatement of Executive Secretary position, which was eliminated in 2022. Many of the duties of the former City Clerk were combined with the Executive Secretary role, and additional responsibilities absorbed throughout City Hall staff. This staffing change will provide improved support to the City Council and the City Manager’s office. Total expense increase for this portion of the budget amendment is $61,500. The Finance department is requesting reinstatement of the Accounting Supervisor position, which was eliminated in 2023 when the supervisor retired after 25 years of service. With this reinstatement, the current Accountant will move to the Supervisor role. The department also requests to reclassify the Accountant position to be filled as an Accounts Payable Specialist position. These staffing changes will improve workload distribution, reduce overtime, and provide the Finance department with the necessary staffing to effectively deliver full-service finance, accounting, and billing functions. The total expense increase for this portion of the budget amendment is $52,000. The Meter/Billing & Collections Department is requesting reinstatement of the part-time Department Clerk position and the addition of a third Meter Reader position. The need to replace meters throughout the city is increasing, and current workload does not allow adequate focus on meter replacement. These additions will reduce overtime, improve coverage, and allow greater focus on meter replacement and maintenance. The total expense increase for this portion of the budget amendment is $49,300. Additionally, to support the new position, the Meter department is requesting $25,000 for an additional Meter truck. Staff recommends approval of the budget amendment. h. Interim Public Works Director, Taylor Shelton, will present council with an update on ongoing infrastructure projects and studies. i. City Council will discuss and receive clarification on directing staff and legal counsel to evaluate and draft an ordinance establishing a moratorium on new multi-family and duplex residential construction within the city limits, including scope and legal considerations. j. City Council will discuss and possibly take action on current code enforcement priorities, staffing, enforcement focus, and alignment with adopted building codes, including enforcement related to multi-family and residential construction standards. k. Two responses was received timely, one from the incumbent agent, Victor Insurance Managers, LLC (Victor), and one from USI Insurance Services, LLC (USI). Separate interviews were conducted with USI and Victor on February 17, 2026 and both agents were given the opportunity to clarifications for certain issues that were unclear as presented. Both agents were given the opportunity to go back to their markets to negotiate a best and final offer. The following is a review of the best and final offers. Victor has offered a program is a split between commercial markets and the Texas Windstorm Insurance Association (TWIA). The number of policies will depend on which option is chosen. Each part of the program offers coverage on a portion of the schedule of values through the commerical market and another portion of the schedule of values through TWIA. With this program, there are a few locations which were on the scheduel of values that are not included for coverage due to the actual lack of exposure to wind damage, such as parking lots, and jogging trails. In addition, Victor has offered an option based solely on coverage provided by the commercial markets with no coverage to be provided by TWIA. The first option is based on the full schedule of values, a total insured value of $74,140,021. The commercial market portion of the program provides a $50,000,000 loss limit for the locations on its part of the schedule ($50,570,486); the TWIA portion of the program offers $23,569,535 based on the statement of values provided by the City for the TWIA locations. Together, the full program offers a total coverage limit of $73,569,535. The deductible options vary and are outlined in the tables below. The second option is based on an the same statement of values but with a $50,000,000 loss limit, and all coverage provided through the commercial market. The total insured value of $74,140,021. USI has offered a program through the commercial market based on a $75,000,000 loss limit, subject to the underlying schedule of values of $74,140,021. Their offer is also outlined below.
