04-20-2026 Agenda with attachmentsNEDERLAND CITY COUNCIL AGENDA NOTICE is hereby given of a regular meeting of the Nederland City Council to be held Monday, April 20, 2026, 5:30 p.m., at the Nederland City Hall, 207 North 12th Street, Nederland, Texas, for the purpose of considering the following agenda items. The City Council reserves the right to retire into Executive Session concerning any of the agenda items whenever it is considered necessary and legally justified pursuant to Texas Government Code, Chapter 551. The 2025-26 total adjusted tax levy is $8,593,639.58 and the amount of collections as of March 31, 2026 is $7,666,882.21 which represents 89.22% of the total tax levy. The 2025-2026 current year adjusted tax levy is $8,147,469.72 and the amount of collections as of March 31, 2026 is $7,664,647.06 which represents 94.07% of the current year tax levy. In comparison to prior year, the amount of property tax collected as of March 31, 2025 was $7,056,273.54 which represented 89.11% of the total tax levy and $6,991,830.83 of the current tax levy which represented 93.80%. I recommend acceptance of the March 2026 Tax Collection Report. MEETING The meeting was called to order at 5:30 p.m. by Mayor Darby at the Nederland City Office Building, 207 N. 12th Street, Nederland, Texas. See attached for quorum. The following statement was posted: “PURSUANT TO SECTION 30.07, PENAL CODE (TRESPASS BY LICENSE HOLDER WITH AN OPENLY CARRIED HANDGUN), A PERSON LICENSED UNDER SUBCHAPTER H, CHAPTER 411, GOVERNMENT CODE (HANDGUN LICENSING LAW), MAY NOT ENTER THIS PROPERTY WITH A HANDGUN THAT IS CARRIED OPENLY.” 2. INVOCATION AND PLEDGES OF ALLEGIANCE The invocation and Pledges of Allegiance were led by Mayor Darby. 3. PRESENTATION Police Chief Rod Carroll presented information regarding the Nederland Police Department's participation with the Southeast Texas Violent Crime Task Force under the Federal Bureau of Investigation. Chief Carroll explained that the task force addresses repetitive violent crime in the region and cited recent successes, including the rapid apprehension of suspects in a murder case on Highway 73. The chief noted that the task force includes members from communities including Jasper Police Department and Jasper County. Council members expressed no objection to the Chief joining the task force. 4. CITIZEN COMMENTS Tim Windberg, 912 Circle Dr, inquired about water quality notices that had been sent to residents. He asked whether citizens would receive notification when water quality issues were resolved and the water no longer required special precautions. Mayor Darby informed him that the city manager would provide an update on this matter later in the meeting. Laura Smith, 2108 Avenue C, commended the Public Works Department for their prompt response to a water meter safety hazard. Jolie Shipley, 8765 Holmes Road, addressed several topics regarding agenda transparency and ongoing projects. She noted a lack of regular updates on drainage projects and also raised concerns about development projects approved by previous councils, specifically Minutes continued, April 6, 2026 2 mentioning developments on South 28th Street and at the corner of 27th Street and Canal, where she alleged lot sizes and building coverage ratios did not comply with city codes. 5. CONSENT AGENDA - All consent agenda items listed are considered to be routine by the City Council and will be enacted by one motion. Minutes – March 23, 2026 regular meeting and March 12, 2026 special meeting. 6. REGULAR AGENDA UNFINISHED BUSINESS a. City Manager, Manny De La Rosa, provided updates on public works and engineering projects. He explained that the city is requiring engineering firms to provide status reports that will be made available to the public online, either on a dedicated webpage or organized by date or month. He also acknowledged that not all ongoing projects are handled by engineers and that the city is working through a list of items, some addressable now and others requiring staged approaches, including sewer-related issues in both residential and commercial areas. Councilman Sonnier expressed appreciation for making project information available online and requested a comprehensive recap of all major projects at the second meeting of each month. NEW BUSINESS b. City Manager De La Rosa presented the proposed replat of 1111 Boston Avenue, which was tabled at the previous month's meeting. Anthony Toups, 803 Hunters Ridge and President of the Economic Development Corporation, addressed the council. He explained that the replat had already received approval from Planning and Zoning and noted that the item was tabled at the prior council meeting due to concerns about zero lot lines and boundaries. He noted the adjacent land would remain a parking lot regardless of the decision. Mr. Toups clarified he was not requesting a resolution but rather seeking approval from council. Jolie Shipley noted that she discovered additional issues under Section 8 of city ordinances and expressed concern about creating a strip that cannot be built on and/or the existing building cannot be legally occupied. Minutes continued, April 6, 2026 3 A motion was made by Councilmember Jones and seconded by Mayor Pro Tem Ortiz to deny the request to replat 1111 Boston Avenue described as S W 81’ Lots 13-15 Block 18 of Nederland Addition to become Tract 13-A and 13-B of Nederland Addition. A motion was made by Councilmember Jones and seconded by Councilmember Duplant to approve Ordinance 2026-04, suspending the rates proposed by CenterPoint Energy Resources Corporation dba CenterPoint Energy Entex and CenterPoint Energy Texas Gas Company’s Gas Reliability Infrastructure Program filing made on February 17, 2026. A motion was made by Councilmember Jones and seconded by Councilmember Sonnier to approve Resolution No. 2026-06, authorizing the City of Nederland Police Department to submit a grant proposal to Motor Vehicle Crime Prevention Authority for the 2026 Auto Theft Task Force Grant Program. ATTENDING VIA ZOOM: Councilmember Duplant Police Chief Rod Carroll explained the grant requires a 20% city match with 80% funded by the grant. He requested five additional Flock cameras, referencing the tour council members had taken of the Real Time Crime Center. The Chief specified the total cost as $63,000 for five cameras, with approximately $12,000 as the city's match and $51,000 from the grant. e. City Manager De La Rosa presented information regarding a proposed agreed order with the Texas Commission on Environmental Quality regarding a violation on December 15, 2025. He clarified that no action would be required on the proposed order and that the fine under consideration is $20,152. He reported that staff, plant operators, and he had participated in a conference call with TCEQ's enforcement division to discuss options and that responding timely pauses the enforcement order. He explained that the city has requested to submit a Supplemental Environmental Project (SEP) plan to satisfy the requirements instead of paying a monetary penalty. David Wedgworth, 712 Carriage Lane, addressed the council and explained that he contacted Water Treatment Plant Supervisor Michael Mitchell, who sent staff to open the fire hydrant and clear the system. He noted his neighborhood is on a dead-end system that does not loop. Mr. Wedgworth stated the situation needs to be fixed and should not rely on closed-in systems. Minutes continued, April 6, 2026 4 This item required no action and no vote was taken. f. City Manager De La Rosa presented a request to ratify payment to Baker Tilly for $3,621.50 over the approved $78,000 contract amount. Mr. De La Rosa explained that the forensic audit contract with Baker Tilly had a not-to-exceed amount of $78,000. Upon Mr. De La Rosa's arrival, he was informed the city had exceeded the contract amount. He stated this needed to be presented to council for ratification for auditing purposes. When the contract was located and sent to finance, it was discovered that $3,621.50 had been paid over the $78,000 approved amount. Mr. De La Rosa explained this issue would not necessarily appear in the current year's audit since auditors use random sampling, but staff identified and disclosed it. Mayor Darby asked about the process by which payments were authorized beyond the agreed-upon amount. He stated he would receive bills from Baker Tilly and forward them to whoever was serving as interim city manager at the time. Councilman Duplant sought to understand how the overage was authorized and paid. Mr. De La Rosa explained that a purchase order was likely issued, as that has been the standard process, but the contract signed by the Mayor was based on an hourly rate schedule without a total cap and included additional expenses. He offered that if council wished not to ratify the payment and instructed him to collect the money back, he would follow those instructions and address any potential breach of agreement issues. He also noted that Baker Tilly had received $10,000 up front as a retainer, of which they used $6,736, converting the remainder to payment toward the balance. Councilman Duplant requested information on who initialed approval for the payments, and Mr. De La Rosa agreed to provide that information. Mayor Darby clarified that he signed the contract after legal review by the previous city attorney, who raised no objections. Councilman Jones asked if the scope of work changed during the process, such as adding additional years for review. Mr. De La Rosa stated he found no written agreements or amendments to the contract for scope changes or extensions. Several citizens commented on better practices addressing contracts. A motion was made by Mayor Pro Tem Ortiz and seconded by Councilmember Sonnier to deny ratifying the payment of $3,621.50 to Baker Tilly which is over the approved $78,000 regarding the forensic audit report. City Manager De La Rosa presented information regarding furniture purchase from Hernandez Office Supply for administrative staff and the annex trailer. He explained the annex will contain four offices and a conference area, requiring five furniture sets total. He stated the quote came through a purchasing cooperative which provides government rates that are typically the best available without competitive bidding, as the cooperative already negotiates volume pricing. A motion was made by Councilmember Duplant and seconded by Councilmember Jones to postpone Item 6.h until the April 20, 2026 meeting to obtain further information. MOTION CARRIED. An average of 2,679,000 gallons per day and a maximum of 2,980,000 gallons. A total of 20 bacteriological samples were taken to Sabine River Authority lab for analysis. All 20 passed. 43 distribution residuals were taken with an average of 2.98 mg/L. A total of 186 turbidity readings were taken with an average of 0.102 NTU and a maximum of 0.195 NTU. 95% of our monthly readings must be below 0.300 NTU. WORK INJURIES / SAFETY INSURANCE ▪ Nothing to report on March 2026. 4 INSRUANCE BIDS ▪ The RFP for medical, dental, and vision was sent out on March 25, 2026. All proposals are due April 9, 2026. POLICE / FIRE / CIVIL SERVICE CONTRACTS ▪ Nothing to report for March 2026. INCIDENTS ▪ On March 5, 2026 a public works employee was driving down Nederland Avenue when another vehicle swerved into the other lane and into the side of employee’s city vehicle. Citizen was at fault for the incident. No damage to city garbage truck. Therefore, this was not filed with insurance. ▪ On March 9, 2026 a public works employee was driving the pressure truck when he backed into a parked vehicle. This caused damage to the parked vehicle. Citizen has filed a claim with TML for damages to their vehicle. ▪ On March 12, 2026 a police officer was driving through the covered awing behind the police and fire building. Employee turned too sharply causing the right quarter panel and right rear tire to strike the support column of the awning. This caused damage to the patrol unit and the column of the awning. A claim for the damages to both the vehicle and column have been submitted to TML. ▪ On March 17, 2026 a police officer was driving in a parking lot when a low hanging AT&T fiber line struck the front bumper of the vehicle. Employee was not aware of this and continued to drive until he heard a “pop” sound. The fiber line had snapped. Attached is Ordinance 2026-06, suspending the rates proposed by Texas Gas Service Company’s Gas Reliability Infrastructure Program filing. On March 10, 2026, Texas Gas Service Company filed an Annual Gas Reliability Infrastructure Program adjustment with the City of Nederland to increase gas rates in its incorporated and environs service areas. TGS proposed an effective date of May 9, 2026, for the requested increase unless the City suspends the date for a period no longer than forty-five days. The City finds the need to suspend the effective date of TGS’s requested rate increase for 45 days beyond the Company’s proposed effective date until June 23, 2026 in order to review the company’s filing for compliance with Gas Utility Regulatory Act Section 104.301. I recommend approval of Ordinance 2026-06. d. The upstream end north of Helena is in a backlot easement, downstream of Helena is located in the ROW. Observations 1. The diameter of the line from north of Helena to Hardy is 22" and 24" with two short segments of 18". The segment nearest Hardy is 20". The material of the pipe is predominantly plastic; HOPE with some PVC and is in good condition. Undersized Segments: • • JKL: 24"-18"-15"-22". JK 65LF is in ROW, KL 181LF in backlot. DC: 22"-18"-24". In ROW . Potential upsizing of lines. SPI says their hydraulic model is running and they may have results in next few weeks. 2. Concrete spalling to expose rebar on the 15" Seg NM in backlot easement. 3. Instead, all amounts collected under a GRIP filing are considered interim rates subject to review and refund in the Company’s next base rate proceeding. In addition, the Texas Legislature recently passed a bill that broadens the scope of GRIP filings. House Bill 4384 (89th Legislative Session), codified as Gas Utility Regulatory Act, TEX. UTIL. CODE § 104.302, authorizes a gas utility to classify certain capital investment and tax expenditures as “regulatory assets” that are then recoverable through the GRIP mechanism. Eligible expenses include post in-service carrying costs, depreciation, and ad valorem taxes. Historically, gas utilities have not been allowed to recover these costs until they are approved by a regulatory authority, whether under the GRIP Statute or through a base rate case. The new law essentially erases this regulatory lag by allowing gas utilities to track costs from the date new plant goes into service and then to recover those costs retroactively. As with the GRIP Statute, amounts included in these regulatory assets are not subject to reasonableness review until the next base rate case and are subject to refund with interest. TGS has determined that its capital investment increased by $ 278,096,965 in calendar year 2025. The review process of a GRIP filing is generally a ministerial review limited to ensuring that the GRIP filing complies with the GRIP Statute. See Atmos Energy Corp. v. Cities of Allen, 353 S.W. 3d 156 (Tex. 2011). During the suspension period, any issues related to whether the GRIP filing comports with the GRIP Statute can be reviewed so that the Cities may make a final decision on this GRIP proposal. Note that under the new statute, recovery relates back to when plant went into service, so delaying the effective date will not reduce the total amount customers 3 will pay. Bell Willis, Texas 77378 Re: Annual Ordinance Authorizing Municipal Participation in Regulatory Proceedings of Entergy Texas, Inc. in 2026 Dear Steering Committee of Cities located in Entergy Texas, Inc.’s Service Territory: It is once again time to authorize municipal participation in regulatory rate proceedings involving Entergy Texas, Inc. (“ETI” or “Company”) before the Public Utility Commission of Texas (“PUCT” or “Commission”). Attached for your consideration is a proposed Ordinance to authorize participation in rate proceedings in 2026. In 2025, we participated in several different types of proceedings that ETI initiated with the Commission, summarized below: • Application of Entergy Texas, Inc. to Amend Its Certificate of Convenience and Necessity to Construct a Portfolio of Dispatchable Generation Resources. ETI’s application for approval to construct the Legend Power Station and the Lone Star Power Station was approved on December 9, 2025. Together, these plants will add 1207 MW of capacity to serve ETI’s customers by mid-2028. In its order, the Commission found that ETI did not adequately evaluate lower-cost alternatives in its planning process. To protect customers from the risk of the projects going over budget, the Commission imposed a cost cap of $1.6024 billion for the Legend Power Station and $771.5 billion for the Lone Star Power Station. • Application of Entergy Texas, Inc. to Amend Its Certificate of Convenience and Necessity to Construct a Portfolio of Renewable Generation Resources. ETI withdrew its application for approval to construct two solar facilities and will not go forward with these projects. Attorney-Client Privileged Communication 5 • Application of Entergy Texas, Inc. for Approval of a Resiliency Plan. In January 2025, the Commission approved Phase I of ETI’s “Texas Future Ready Resiliency Plan,” a comprehensive set of resiliency measures that are intended to improve service reliability for customers and to mitigate system restoration costs after extreme weather events.1 The projects approved for Phase I are expected to cost approximately $137 million, but ETI is deferring recovery of these costs until a future proceeding. ETI must file a resiliency plan report annually starting May 1, 2026. • Application of Entergy Texas, Inc. for Authority to Reconcile Fuel and Purchased Power Costs. ETI requested to reconcile the fuel and purchased power expenses it incurred between April 1, 2022 and March 31, 2024. No objections were raised and the application was approved as filed. Pursuant to the Commission’s final order, the Company’s under-recovery balance of approximately $30 million will be carried forward to the next fuel reconciliation proceeding. As such, rates were not impacted. • Application of Entergy Texas, Inc. to Adjust its Energy Efficiency Cost Recovery Factor. The Energy Efficiency Cost Recovery Rider (“EECRF”) recovers costs related to ETI’s energy efficiency programs. This rider is adjusted annually with the updated rate going into effect on January 1 of each year. The parties reached a settlement agreement that made small adjustments to the Company’s request with a negligible impact on the proposed rates. The Commission approved the settlement agreement on December 12, 2025. • ETI filed applications to recover costs related to its distribution system (Distribution Cost Recovery Factor or “DCRF”) and its transmission system (Transmission Cost Recovery Factor or “TCRF”). The DCRF applications were uncontested by the Commission Staff and intervening parties and were approved by the Commission. The TCRF application is still pending, but as we do not anticipate any major issues, we expect a final order to be issued in early 2026. The DCRF and TCRF are subject to true-up to prevent the Company from over- recovering its expenses. Looking forward to 2026, we will continue to participate in the currently pending TCRF proceedings. In addition, several other rate proceedings may be initiated this year: • ETI’s Orange County Advanced Power Station (“OCAPS”) is on track to start serving customers in summer of 2026. When the Commission approved the OCAPS project in 2023, the cost was projected to be at least $1.58 billion and possibly as much as $2.5 billion. We anticipate that the Company will file an application for a Generation Cost Recovery Rider (“GCRR”), which will allow for recovery of plant investment costs as soon as OCAPS goes into service. Like the TCRF and DCRF, 1 ETI filed its system resiliency plan pursuant to Public Utility Regulatory Act § 38.078 (Transmission and Distribution System Resiliency Planning by and Cost Recovery for Electric Utilities), which was signed into law in 2023. Attorney-Client Privileged Communication 6 the GCRR is an interim cost recovery mechanism that is subject to true-up in the next base rate case. • By statute, electric utilities must reconcile fuel and purchased power costs at least once every two years.2 ETI’s last fuel reconciliation case was filed in 2024, so ETI is expected to file its next fuel reconciliation case this year. • The Company is likely to file an additional TCRF and up to two DCRF applications for interim cost recovery of investments made to its transmission and distribution systems. • The Company is also expected to file its annual application to amend its Energy Efficiency Cost Recovery Factor in May 2026. • ETI is not required to file its next base rate case until August 2027, but it could opt to file in 2026 instead.3 The continued support of each of the Cities in the Steering Committee has been instrumental in the successful regulation of ETI and in maintaining reasonable rates for customers within the Cities. HEALTH INSURANCE Chris Duque, City Manager, stated the City’s health insurance provider is United Health Care (UHC); the contract expires on June 30th. The current plan year loss ratio (total paid medical and prescription claims over paid premiums) is 127%. Bids were opened on Thursday, April 17th. Utilizing UHC as the City’s health insurance provider, the City provides a three-option plan design (Standard PPO Plan, High Deductible Health Plan or HSA, and a Health Maintenance Organization Plan or HMO) with varying levels of dependent coverage (employee-only, employee+spouse, employee+children, and family) and differing monthly premiums. The City utilizes two defined contributions: one for the Standard Plan and the HSA Plan and another for the HMO Plan. The City provides a Standard Plan that includes a $1,500 deductible and a $6,500 maximum out of pocket, which includes the deductible amount. Due to the recent history of high loss ratios, the submitted bids were high. The City’s insurance consultant (HUB International) reviewed the received bids and assessed the bids of the two finalists – United Healthcare (UHC) and Blue Cross/Blue Shield of Texas (BCBS). HUB negotiated a best and final offer from both vendors. UHC presented two options; one with a 15.5% rate increase; and the other with a 12.3% rate increase. BCBSTX presented a 14.6% (before a 2% bundling discount) rate increase; unfortunately, the proposed plan design drastically increased the employees’ possible out of pocket expenses (higher maximum out of pocket, higher co-pays, and greater prescription costs). The first five UHC options follow the quote for the plan design matching the current benefits, not the quote for “UHC (Opt 1)”. Thus, the majority of the UHC options continue to focus on three plans (a “standard” plan, a high-deductible plan/HSA, and health maintenance organization plan/HMO), four levels of coverage (employee-only, employee+spouse, employee+children, and family), and two defined contributions (one for the standard and HSA plans and another for the HMO plan). Under Option 1 (City costs do not increase), the Standard Plan/HSA Plan and HMO Plan Defined Contributions are not adjusted. The City’s cost increase is $0 while the employees would cover the rate increase (over $262,000). Under Option 2 (employee costs do not increase), the Standard Plan/HSA Plan and HMO Plan Defined Contributions are adjusted. The City’s cost increase is over $263,000 while the employees cost increase is $0. Under Option 3 (50/50), the Standard Plan/HSA Plan and HMO Plan Defined Contributions are adjusted. The City’s cost increase is over $132,000 (approx. 50.4%) while the employees cost increase is over $130,000 (approx. 49.6%). Under Option 4 (Employee-only increase), the Standard Plan/HSA Plan and HMO Plan Defined Contributions are adjusted. The City’s cost increase is over $156,000 (approx. 59.5%) while the employees cost increase is over $106,000 (approx. 40.5%). Under Option 5 (HMO-focused plan), the Standard Plan/HSA Plan and HMO Plan Defined Contributions are adjusted with greater financial support of the HMO Plan. Jeff Darby, 1515 N. 26th St., asked what the deadline was for notifying HUB of the city’s provider selection. Chris Duque, City Manager, explained the item was placed on this agenda in order to give the HR department time to schedule open enrollment timely. A motion was made by Trustee Sonnier and seconded by Trustee Duplant to award a bid for employee health insurance to United Healthcare, Option 2, with no increase to employees. MOTION CARRIED. Ayes: Chairperson Albanese, Trustees Duplant, Root, Sonnier, and Guillot. Noes: None. 4. DENTAL INSURANCE Mr. Duque stated the City currently utilizes Blue Cross/Blue Shield of Texas as its dental insurance provider. Under the dental insurance plan design, the City pays 100% of the employee premiums and 0% of dependent premiums, regardless of whether the employee chooses the HIGH or LOW plan. The majority of City employees and retirees utilize the HIGH plan (108 out of 125 active employees OR 87%). The City annually spends over $36,300 on dental insurance premiums. The BCBS of Texas renewal offer is a rate pass. However, the UHC health proposal includes a bundling discount if their dental insurance bid is accepted. The UHC proposal is a 4.4% rate increase with a $5,000 credit, which will offset the City’s greater costs. Staff’s recommendation is to award the dental insurance bid to United Health Care maintaining the same plan design and contribution model. The additional annual cost to the City will be offset by the $5,000 credit. The additional annual cost to the employees is approximately $1,800. A motion was made by Trustee Sonnier and seconded by Trustee Root to award a bid for employee dental insurance to United Healthcare. MOTION CARRIED.
