NOTICE is hereby given of a regular meeting of the Nederland City Council to be held May 18,
2026, 5:30 p.m., at the Nederland City Hall, 207 North 12th Street, Nederland, Texas, for the
purpose of considering the following agenda items. The City Council reserves the right to retire
into Executive Session concerning any of the agenda items whenever it is considered necessary
and legally justified pursuant to Texas Government Code, Chapter 551.
Members of the public can participate remotely via Zoom Teleconferencing. Citizens may join
the Zoom Meeting by clicking on the Virtual Council Meeting https link on the City of
Nederland’s website or calling the Zoom Call in Number and entering the Meeting ID# on the

and considered separately. I would recommend acceptance of all the below-listed items.

c. Attached are the quarterly investment reports for the quarters ending December 31, 2025
and March 31, 2026. Interest earned for the quarter ending December 31, 2025 totaled
$688,751.91 (Texpool $625,898.19 and Stellar $62,853.72). Interest earned for the
quarter ending March 31, 2026 totaled $662,458.87 (Texpool $572,052.44 and Stellar
$90,406.43). Texpool interest rates have fallen but remain strong, with an average rate of
4.1183% for the 4th quarter 2025, and an average of 3.8283% for the 1st quarter 2026,
compared to 4.2897% for the 3rd quarter 2025. The City’s depository account with
Stellar Bank pays interest on demand deposits currently at a rate of 2.7300%, compared
to 2.8900% and 3.0833% in the previous two quarters. I recommend acceptance of the
Quarterly Investment Reports ending December 31, 2025 and March 31, 2026.
d. Attached are the Financial Reports for March 2026.

announced that citizen comments would be postponed until after certain agenda items due
to executive session needing to be moved.

Gordon Friesz.

CITIZEN COMMENTS (First Session)
Dwayne Morell, 1624 Canal, thanked the council for approving health insurance changes
at no increased costs to the city employees.
Renee O'Connor, 1131 Gary Avenue, thanked the council for the past year's work and
progress, particularly noting sidewalk repairs on the 700-800 block of 12th Street.
Kenny Lofton, 3100 Eugenia Lane, Commander VFW 4820, discussed the Voice of
Democracy Scholarship program, which provides high school students an opportunity to
compete for scholarships through patriotic-themed audio essays.
Tim Windberg, 912 Circle Drive, provided a historical background on Loyalty Day.
5. REGULAR AGENDA
a. 2026 City Election:
iv. Mayor Darby noted he had inadvertently skipped agenda item 5.a.iv, the
election of Mayor Pro Tem in accordance with the city charter. He explained that
two council members had expressed interest in the position. The mayor explained
his preference for rotating the position.
Mayor Darby nominated Councilmember Sonnier to serve as Mayor Pro Tem. A
vote was conducted. MOTION CARRIED.

6. EXECUTIVE SESSION
The regular meeting was recessed at 5:55 p.m. by Mayor Darby for the purpose of
conducting an Executive Session as authorized by Texas Government Code, Consultation
with Attorney - Tex. Gov’t Code, Section 551.071, including: Pending litigation/arbitration
with former City Manager, Chris Duque; Legal issues raised in connection with awarding
health insurance contract.

The regular meeting was reconvened at 7:19 p.m. by Mayor Darby. Mayor Darby
announced that there will be no action on the first executive item regarding former City
Manager, Chris Duque.
A motion was made by Councilmember Jones and seconded by Councilmember Stratton to
clarify that the commencement of the new health insurance policy will only cover city
employees. MOTION CARRIED.

City Attorney Richard Hughes confirmed that Councilmember Ortiz, attending via
Zoom, was not able to vote on this item per state law.
3. Item 3. CITIZEN COMMENTS was moved on the agenda.
CITIZEN COMMENTS (Second Session)
Ray Short, 236 Atlanta Avenue, discussed infrastructure concerns in Ward 1, specifically
regarding street conditions on Atlanta, Boston, and Chicago streets. Mr. Short noted that
most growth in the city is occurring in older areas with vacant lots and expressed
concerns about rising property taxes forcing longtime residents out of their homes.
5. UNFINISHED BUSINESS
b. City Manager De La Rosa presented a revised proposal for furniture for administrative
staff in the annex trailer. He explained that the original furniture proposal presented to
council was for 15-year-plus furniture with a longer shelf life, but the revised proposal
featured furniture with a 3-5 year shelf life at approximately one quarter of the original
cost. The revised proposal excluded furniture for the city secretary's office and the
building permit office, which would be handled as budget line items within
departments. Council discussion included acknowledgment that the original furniture
would have been lifetime furniture that could be utilized in different locations later, but
the public did not want the city to pay for that level of quality.
A motion was made by Councilmember Sonnier and seconded by Councilmember
Jones to approve payment to Hernandez Office Supply regarding furniture for
administrative staff in annex trailer. MOTION CARRIED.

Sonnier to approve Ordinance No. 2026-08, amending the fiscal year 2025-2026

j. City Manager De La Rosa presented two proposals from Corvus Communications for
replacement of the City Hall generator. The first proposal was for $128,951 including a
600-amp automatic transfer switch, and the second proposal was for $119,000 without
the new transfer switch. De La Rosa noted the replacement would not be a proprietary
system like Generac or Cummins, making it easier to obtain parts and service.
Fire Chief Morton explained the existing generator has experienced significant
problems during hurricanes Laura and Delta. The department has replaced belts and
pulleys multiple times trying to solve the problem. The exhaust system is deteriorating
due to rain coming through vents. Chief Morton noted the generator is 14 years old and
original to the building. The automatic transfer switch is the only difference between
the two quotes.
Councilmember Stratton questioned having only one quote and suggested obtaining
additional bids before spending such a significant amount. City Manager De La Rosa
explained the state purchasing co-op process, noting companies have already met state
procurement requirements. He stated that specifications would need to be established
and the project bid out separately if the council wanted competitive bids outside the co-
op system.
Mayor Pro Tem Sonnier made a motion to table the item until the May 18th meeting to
research additional pricing. Councilmember Jones seconded the motion.
City Attorney Hughes cautioned that the council would not be able to base their vote on
informal price shopping and would need to follow the competitive bid process if they
wanted to consider other vendors. City Manager De La Rosa explained that the
competitive bid process requires two published notices 21 days apart with 30 days to
submit, making it approximately a 60-day minimum process.
David Wedgeworth, 712 Heritage Lane, stated he had contacted two generator dealers
and found the generator quoted at $88,000 available for $57,000 in Houston and
$56,200 from another dealer. City Manager De La Rosa responded that government
entities typically do not receive the same prices as private individuals and that there is
usually a premium when working with government. He also noted the importance of
liability coverage.
Following further discussion, Mayor Pro Tem Sonnier withdrew his motion to table.
City Attorney Hughes clarified that City Manager De La Rosa had indicated if the

council wanted to pursue competitive bidding, they should deny the current proposal
and direct staff to begin the competitive bid process, which would take at least 60 days.
A motion was made by Councilmember Sonnier and seconded by Councilmember
Jones to approve payment to Corvus Communications for the city hall generator

k. City Manager De La Rosa explained there is one vacancy on the Civil Service
Commission. Civil service commissioners are nominated by the city manager with the
consent of the city council. Two candidates submitted applications: Kenny Litvik and
Jeremy Lloyd. City Manager De La Rosa initially nominated Kenny Litvik based on
the order applications were received and Chief Morton's recommendation.
Jeremy Lloyd, 1532 North 22nd Street, explained he is a police officer with the City of
Port Arthur, where he has worked for 27 years and as a supervisor for 19 years. He
stated Port Arthur is a civil service city and he has extensive experience working on the
administrative side of civil service. He also noted that he has been an executive board
member of their police association for the last 10 years and is familiar with Chapter
143.
City Manager De La Rosa withdrew his nomination of Kenny Litvik and nominated
Jeremy Lloyd, stating this was based on Lloyd’s experience.
The council voted on City Manager De La Rosa’s nomination of Jeremy Lloyd to the
Civil Service Commission.

l. City Manager De La Rosa introduced the request from Lower Neches Valley Authority
(LNVA) for abandonment of a portion of Detroit Avenue right-of-way. He explained
LNVA representatives had met with city officials previously and that LNVA was
proposing to purchase property to build a cul-de-sac as part of the abandonment. De La
Rosa noted the city cannot give up public lands without receiving something in return.
He stated benefits would be more for the surrounding community than specifically for
Nederland, and legal issues would need to be examined if the council was interested in
proceeding. De La Rosa noted concerns from public safety regarding three connection
points onto FM 366, which is a dangerous roadway with high speeds and numerous
accidents. He stated closing one connection would minimize dangerous pullouts onto
the high-speed roadway.
Victoria Dai, representing Lower Neches Valley Authority, presented the request. She
explained LNVA is requesting abandonment of a small portion of Detroit Avenue right-

of-way to allow for an open canal crossing associated with improvements along the
Atlantic Canal. She stated LNVA's goal is to develop a solution that allows LNVA to
move forward with necessary canal improvements while also maintaining public access
and providing equal or greater value back to the city.
Ms. Dai explained LNVA is proposing a cul-de-sac that maintains turnaround
capabilities and accommodates emergency and service vehicles, with roadway and
drainage improvements constructed at LNVA's expense. The existing right-of-way
requested for abandonment is approximately 0.114717 acres, and LNVA is proposing
dedication of approximately the same amount of new right-of-way back to the city. She
stated the abandoned right-of-way was appraised at approximately $52,000, and LNVA
is proposing comparable right-of-way plus construction of a cul-de-sac estimated at
$58,000-$100,000 at no cost to the city. She noted LNVA has an agreement with the
property owner to demonstrate commitment to moving forward. Ms. Dai explained this
is part of a larger capital improvement project along the Atlantic Canal system. LNVA
has completed improvements from 2nd through 12th Street in 2018 and is working to
open canal crossings that are bottlenecking the system. She stated the reason for
requesting complete closure with an open cut is that Gage Street is immediately
upstream, and the opening and closing of culverts in close proximity creates
bottlenecking.
Councilmember Jones asked whether LNVA had considered upgrading infrastructure
under the existing street to obtain necessary flow. Ms. Dai explained the proximity to
Gage Street creates bottlenecking issues that cannot be resolved by upgrading the
existing culvert alone.
Councilmember Stratton expressed concerns about drainage issues for homeowners and
suggested LNVA should build a bridge to maintain continuous flow rather than close
the road section.
Ms. Dai responded to traffic concerns by stating traffic counts from 2022 showed
Detroit is minimally used and closing Detroit could improve safety due to the diagonal
crossing creating dangerous sight lines at FM 366.
Council Member Ortiz stated he agreed with concerns raised by Councilmembers Jones
and Stratton.
Mayor Darby stated he is open to discussion but not as currently presented because
there is no value to add for the city.
Ray Short, 236 Atlanta Avenue, stated no hydraulic information had been discussed and
raised concerns about raising water levels in canals that have existed since the 1930s-
1940s.

Mayor Darby stated if LNVA desires to return with a proposal that provides better value
for citizens of the community, he would consider it. The council took no action on this
item, effectively declining the request as presented.
m. Discussion was held regarding amending the zoning ordinance to increase the minimum
lot width standards for R-2 Duplex Residential zoning district. City Manager De La
Rosa explained this would authorize staff to begin the process of amending the zoning
ordinance to increase minimum lot width standards for the R-2 duplex residential
zoning district. He clarified this would only authorize staff to begin the administrative
process, including publication notices, legal work, drafting ordinances, and holding
public hearings. No changes would occur until the process was complete and the
council took action on an amending ordinance.
A motion was made by Councilmember Jones and seconded by Councilmember
Sonnier to authorize staff to begin the process of amending the zoning ordinance to
increase the minimum lot width standards for R-2 Duplex Residential zoning district
MOTION CARRIED.

Authority Lab for analysis. All 20 passed.
45 distribution residuals were taken with an average of 2.13 mg/L.
A total of 179 turbidity readings were taken with an average of 0.088 NTU
and a maximum of 0.195 NTU. 95% of our monthly readings must be below
0.300 NTU.
NTU: Nephelometric Turbidity Unit, a unit used to measure the turbidity of water, which is a measure of
the cloudiness or haziness of the water caused by suspended particles (turbidity)
mg/L: milligrams per liter
SWTP: Surface Water Treatment Plant
Sabine River Authority: TCEQ accredited lab used for our water samples
Distribution System Chlorine residuals:
Minimum required: Total: 0.5 mg/L Free: 0.2 mg/L

distribution system)
Total coliform (TC): A group of closely related bacteria, mostly harmless, that live in soil, water, and the
intestines of small animals. This group of bacteria includes fecal coliform bacteria and other non-fecal
bacteria that are very common in the natural world. The presence of these bacteria in drinking water
indicates that potentially harmful bacteria may be present.

April 2026 Departmental Report – Parks and Recreation
The Nederland Recreation Center is operating with regular hours:
Monday – Thursday 8:30 am – 8:00pm, Friday 8:30am – 5:00pm, & Saturday 10:00am – 5:00pm.
Pickleball schedule is Tuesday, Thursday & Saturday from 10am-1pm. Wednesday evenings from 5pm-6pm for family/beginner play
and 6pm-8pm for competition play.
The City of Nederland held staff meetings with 5 hours usage at the Recreation Center.
The Parks Advisory Board meeting was held on April 15TH
The Parks & Rec was open April 3rd on Good Friday but closed on April 4th in observance of Easter.
The Parks & Rec dept. held Easter Crafts and Easter Bunny Photos at the Rec center on April 2nd with 20 kids attending 10 adults
The Parks & Rec dept. gave out hot dogs at Doornbos Park for “National Picnic Day” on April 7th with numerous patrons.
The Parks & Rec dept partnered with FFA and held “National Farm Day” at the Nederland Rec Center on April 10th with 120
attendees.
The Parks & Rec held Pickleball 101 on April 14th with 7 attendees.
The Parks & Rec dept. partnered with the Library for “MMATP” for Dino Dig on April 21st at Doornbos Park with 35 kids and 30
adults.
The Parks & Rec dept hosted Popcorn Pickleball tournament on April 17th with 20 attendees and April 24th with 19 attendees.

TESTING & INTERVIEWS
▪ On April 2, 2026 tested fifteen (15) applicants for Administrative Assistant for Public Works, tested six (6) Library
Page applicants, and one employee for Bilingual testing. A total of four (4) library page applicants were interviewed
and four (4) Laborers for Streets and Drainage were interviewed.

WORK INJURIES / SAFETY INSURANCE

INSRUANCE BIDS
▪ All proposals were received April 9, 2026. Presented options to council April 20th and the renewal of city’s current
medical and dental plans were approved.
POLICE / FIRE / CIVIL SERVICE CONTRACTS
▪ Negotiations with the Police and Fire associations commenced in April, with two meetings held with both
associations.
INCIDENTS
▪ On March 9, 2026 a public works employee was driving the pressure truck when he backed into a parked vehicle. This
caused damage to the parked vehicle. Citizen has filed a claim with TML for damages to their vehicle. TML paid
$1,500 in damages.
▪ On March 12, 2026 a police officer was driving through the covered awing behind the police and fire building.
Employee turned too sharply causing the right quarter panel and right rear tire to strike the support column of the
awning. This caused damage to the patrol unit and the column of the awning. A claim for the damages to both the

vehicle and column have been submitted to TML. TML paid $6,377.93 for damages to the vehicle and $2,013.13 for
the awning.
▪ On March 17, 2026 a citizen states there was a water/sewer back up at his home. A contractor was performing sewer
maintenance at that time. Citizen filed a claim with TML. On April 21, 2026 TML denied the claim.
▪ On March 25, 2026 public works employees had to remove a section of privacy fence to work on a water line. A
strong gust of wind blew over the section of fence removed onto a storage building which punctured a hole in it.
Citizen filed a claim with TML.

Advisory Board. James Vandevender was appointed on 06-23-2025 by Ward 1,

31-2026.
d. Discussion and possible action on the city’s retirement plan. Pertaining to the city’s
retirement plan, City of Nederland Personnel Policy Section 7.03 as revised 08-25-2025
is shown below.
7.03 RETIREMENT PLAN. Regular Full-Time employees are eligible for
participation in the Texas Municipal Retirement System (TMRS) at the time of
hire. Participation in the retirement plan is a condition of Regular Full-Time
employment. Employees are eligible for benefits in accordance with the
provisions of the plan adopted by the CITY. Employees receive credit for every
month in which they are employed by the CITY and makes the required member
deposit for that month to the system. Specific information relative to the
retirement program is available through the Personnel Office.
e. Attached is a proposal from Westwood for professional services consisting of preparing
plans and bid documents for replacement of equipment for the five filters, including air
piping, valves, media replacement, underdrain, and backwash modification at the city’s
water plant. The grand total for all services is $452,222.50.
f. Attached is a proposal from Westwood for professional services consisting of preparing
plans and bid documents for rehabilitation of the existing clarifier #2, including access
walkway additions and modification at the city’s water plant. The total basic services fee
is $176,440.00.
g. Attached is a proposal from Westwood for professional services consisting of preparing
plans and bid documents for improvements to the chemical pump and feed system at the
city’s water plant. The total design fee is $139,262.50.

1) Project Summary
The project aims to improve drainage conditions within the cul-de-sac at Avenue N and 17th Street
to reduce water level during high intensity storm events and prevent further flooding in adjacent
residential homes. AWC is currently in the design and utility/stakeholder coordination phase.
2) Work Completed This Period (4/1/26 -4/30/26)
a) Topographic survey completed.
b) Utility coordination and permit documentation started with Entergy, TxDOT and DD7 for access
permits and/or easements.
c) Design/analysis of existing conditions and proposed conditions for 100-year storm event completed.
Proposed improvements are on plans and going through internal QC/QA currently. Need final
documents from pipeline company before we can complete.
d) Coordination with pipeline companies for exact depths of all lines in the corridor, obtain
requirements for cover on Flint Hills pipeline located in our proposed alignment.

Jefferson County Stormwater Quality Coalition
Work Summary
For services rendered through 3/27/2026
Stormwater Management Program (SWMP) Implementation consisted of:
Data Entry: LJA Engineering entered data into www.MS4web.com for construction site
inspections conducted on 3/4/2026. Data includes photographs from each inspection, copies of
inspection notices, and inspection results.
Stormwater Website Updates: LJA Engineering conducted updates to the Jefferson County
Stormwater Quality Website to maintain compliance with the requirements of TPDES General
Permit No. TXR040000. Updates included: uploading permit documentation, general site
maintenance, and site security (installing new SSL certificate).
Annual Report Development: LJA Engineering completed the development of the Year 1 MS4
annual report for the City of Nederland under the new Phase II MS4 permit. The report was
developed in compliance with TPDES General Permit No. TXR040000 and was submitted to the
TCEQ for review on March 19, 2026.
Additional major scope items completed in FY 2026:
Year 7 Annual Report Development/Submittal: LJA Engineering completed the development

will revise easement as necessary to match agreement between landowner & City. Once
easement location is agreed to, it is anticipated Soutex will produce 95% preliminary plan set
in 1 week for DD7 & City review.

Good Morning Mr. De La Rosa,
The following is our progress report for the City-wide sanitary sewer system study.
Smoke Testing/Manhole Inspections -Completed. Tables and exhibits of the private service
leaks and municipal leaks have been sent to the City.
Flow Monitoring -Flow monitors were installed and operational as of March 24. Completion
of the flow monitoring is scheduled for May 23. We have access to the data real-time and we
review the data as it becomes available. Thus far, there have been several small rain event and
one slightly larger event last week. We are using data from last week to begin looking at the
wet weather flows. Rain event data will be included in the model to calibrate the system
reaction.
Hydraulic Analysis -A model of the City's collection system has been built. We have
coordinated with Staff on lift station on/off levels as well as collected flow data from the
treatment plant. Dry weather model is calibrated and we are running higher flows based on
the rain event from last week.
Final Report -The final report will include results of both smoke testing and hydraulic
analysis, along with recommendations and associated estimated costs.

-Preliminary plan pages were started using as-builts and survey information.
-Coordination with electrical and structural subconsultants is in progress.
-Coordination with El2 and Alfa Laval to confirm centrifuge sizing, polymer equipment, and diverter gate
recommendation.
Work to be completed by next Progress Report:
-Confirm structural and electrical layouts in dewatering room.
-Confirm location of polymer skids and piping to dewatering room.
-Possibly schedule a sludge sample as desired by Client.
Updates to the Schedule:
-No major updates. Meeting scheduled to review preliminary recommendations with City in mid to late
May and move forward with Centrifuge procurement in June/July.

-Substantial completion inspection and punch list generation

EXHIBIT B
For all professional services included in EXHIBIT 'A', Scope of Services, Westwood shall be compensated a lump sum and hourly fee of as summarized below. The total lump sum and hourly fee shall be considered full compensation for the services described in EXHIBIT 'A', including all labor materials, supplies, and equipment necessary to deliver the services.

Westwood shall be paid monthly payments as described in Article 3 of the AGREEMENT. The cumulative sum of such monthly partial fee payments shall not exceed the total current project budget including all approved Amendments. Each invoice shall be verified as to its accuracy and compliance with the terms of this Agreement by an officer of Westwood.
Direct expenses for services such as printing, express mail, mileage and other direct expenses incurred during the progress of the project are included in the Direct Expenses line and will not be invoiced separately.
