All consent agenda items listed are considered to be routine by the City Council and will be enacted
by one motion. There will be no separate discussion of the items unless a councilmember so
requests, in which event the item will be removed from the Consent agenda and considered
separately. I would recommend acceptance of all the below-listed items:

NEW BUSINESS
1. City Manager to provide progress reports on Public Works engineering projects.
2. Police Chief Rod Carroll is to acknowledge and congratulate Assistant Police Chief
Andrew Arnold on completing the Law Enforcement Command Operations Program
(LECOP) for the Texas Police Chiefs Association.
3. Attached is the City of Nederland – Public Water Supply – 2025 Consumer Confidence
Report.
4. The attached memo outlines the current board members on the Planning and Zoning
Commission. One (1) board member does not seek reappointment and two-year terms need
to be established for all board members.
5. Attached is proposed Ordinance No. 2026-12, amending Ordinance 2025-16 Fiscal Year
2025-2026 City Budget. The following expenses are being requested under this budget
amendment:
a. City Hall budget for flagpole spotlight mounting upgrade
b. Homer Nagel Building Public Safety Complex (Police and Fire budgets) for
flagpole spotlight mounting upgrade
c. Public Works Department budget for network switch upgrade
d. Senior Citizen Center budget for ceiling light upgrade
e. Streets Department budget for lighting upgrade along Boston Avenue

Manny De La Rosa, City Manager, stated that each department will present their
accomplishments, goals, and future needs to the Council relative to budgeting.
Following each presentation, Mr. De La Rosa reviewed the proposed 2026-2027
budget for that department. The schedule was as follows:

MEETING
1. The Pledge of Allegiance and invocation were led by Mayor Pro Tem Sonnier.
CITIZEN COMMENTS
Darren Johnson, 1007 Chicago, expressed concerns regarding the new home construction at
1314/1318 Helena. He stated he is worried about potential flooding and drainage issues for the
surrounding properties.
Darell Montgomery, 8375 Lake Placid, expressed concerns regarding the construction at
1314/1318 Helena. He commented that two new homes are being built on a lot that formerly held
one home and this could cause potential flooding and drainage issues.
Norma Montegomery, 1308 Helena, expressed concerns about the new construction at 1314/1318
Helena. She commented that the new construction could increase the risk of flooding to the
neighboring properties.
Ray Herrrera, 1140 Chicago, commented that the side property line off-set on this new
construction at 1314/1318 Helena could be a potential hazard for firefighters. He also expressed
concerns about the number of rental properties in the city, stating that many have overgrown grass
and poor maintenance.
Jolei Shipley, 8765 Holmes Rd., stated that the lot width on the two lots at 1314/1318 Helena does
not meet city code. She also expressed concerns about potential drainage issues for the
surrounding properties from the new construction.
Bob Klinger, 1140 Kent, commented that he is concerned about drainage issues at the new
construction at 1314/1318 Helena.
CONSENT AGENDA ITEMS
Mayor Darby removed the consent agenda item and moved it to the regular agenda. All items in
regular agenda section were renumbered accordingly.
REGULAR MEETING
1. A motion was made by Councilmember Jones and seconded by Mayor Pro Tem Sonnier to
correct Item 9.m on the June 22, 2026 minutes by deleting the words ‘City Attorney

Richard Hughes and’ and ‘both’ from verbiage and approve the minutes as corrected.
MOTION CARRIED.
AYES: Mayor Darby, Councilmembers Stratton, Jones, Sonnier, and Ortiz.

UNFINISHED BUSINESS
2. A motion was made by Councilmember Ortiz and seconded by Mayor Pro Tem Sonnier to
approve Ordinance No. 2026-09, amending City of Nederland Personnel Policy, Personal
Conduct, Section 2.04, Timeliness and Attendance, by deleting the existing language in
Section 2.04.06 Emergency Closings in its entirety and by adding in its place new
language providing attendance requirements, pay or benefits for designated full-time
employees during an emergency closure; and providing for repeal and an effective date,
with the requested amendments. Mayor Darby requested amendments to letter D in the
ordinance, specifically to capitalize the “F” in ‘Fair,’ add an “s” to “Standards,” and
capitalize “A” in ‘Act’ when referencing the Fair Labor Standards Act. MOTION
CARRIED. AYES: Mayor Darby, Councilmembers Stratton, Jones, Sonnier, and Ortiz.
NOES: None.
3. A motion was made by Councilmember Jones and seconded by Mayor Pro Tem Sonnier to
approve amendment Ordinance No. 2026-10, carrying into effect provisions of local
government code Section 211.003, “Zoning Regulations Generally”, by amending the
‘City of Nederland Code of Ordinances, Table 12.2 Schedule of Residential Height and
Area Regulations, by increasing the minimum lot width and lot area requirements for R-2
duplex zoning, and by amending Section 30, “Definitions” to add and define
“cargo/storage/shipping containers”, and by amending Section 11.2, Regulations
Applicable to all Zoning Districts, to add and regulate cargo/storage/shipping containers;
and providing for severability, repeal, and effective date. MOTION CARRIED.
AYES: Mayor Darby, Councilmembers Stratton, Jones, Sonnier, and Ortiz.
NOES: None.
Jolei Shipley stated she was in support of the proposed changes to Table 12.2 but
amendments also need to be made for the R-3, R-4, C-1, C-2 and C-3 zones.
NEW BUSINESS
4. A motion was made by Mayor Pro Tem Sonnier and seconded by Councilmember Ortiz to
approve a collective bargaining agreement with the Nederland Fire Department
Association for October 1, 2026 to September 30, 2028. MOTION CARRIED.
AYES: Mayor Darby, Councilmembers Stratton, Jones, Sonnier, and Ortiz.
NOES: None.
5. A motion was made by Mayor Pro Tem Sonnier and seconded by Councilmember Jones to
approve amendment Ordinance No. 2026-11, amending the fiscal year 2025-2026 Fire
Department budget special fund for the purchase of equipment. MOTION CARRIED. AYES: Mayor Darby, Councilmembers Stratton, Jones, Sonnier, and Ortiz.

6. Jacob Pitts, Chief Building Official, provided an update on three properties on Hilldale
Street.
126 Hilldale: This dilapidated home has a large hole in the roof and needs to be
demolished. The homeowner passed away in 2011, and the property inheritor has also
since passed away. A new title search process must be initiated. Mr. Pitts stated there are
currently no funds for demolition and planned to put it on hold until the next budget cycle.
The estimated demolition cost is $3,000 to $5,000, not including legal search costs.
154 Hilldale: This house has structural issues and two occupants. There is no water
service to the property. Once occupants are out, structural needs can be addressed.
162 Hilldale: This property has structural problems and Mr. Pitts stated he has spoken
with the children, who plan to eventually demolish the house and sell the lot. He
suggested that protective measures could be taken, such as securing the structure with
plywood over doors and windows to prevent entry.
7. A motion was made by Councilmember Jones and seconded by Councilmember Ortiz to
approve Resolution 2026-11 amending the city’s purchasing policy to ensure compliance
with Texas Water Development Board (TWDB) procurement requirements for grant-
funded projects and providing for related matters. MOTION CARRIED.
AYES: Mayor Darby, Councilmembers Stratton, Jones, Sonnier, and Ortiz.
NOES: None.
8. A motion was made by Councilmember Jones and seconded by Councilmember Ortiz to
approve Resolution 2026–12 authorizing the submission of an application to the Texas
Water Development Board (TWDB) for water supply and infrastructure funding,
authorizing the City Manager or designee to execute all necessary documents, and
providing for related matters. MOTION CARRIED.
AYES: Mayor Darby, Councilmembers Stratton, Jones, Sonnier, and Ortiz.
NOES: None.

The Nederland Recreation Center is operating with regular hours:
Monday – Thursday 8:30 am – 8:00pm, Friday 8:30am – 5:00pm, & Saturday 10:00am – 5:00pm.
