1. MEETING.
The meeting was called to order at 4:30 p_m. by Mayor Nugent at the Nederland City
Office Building, 207 N. 12- Street, Nederland, Texas. See attached for quorum.
The following statement was posted:

the City Council and will be enacted by one motion. There will be no separate
discussion of these items unless a councilmember so requests, in which event the item
will be removed from the Consent Agenda and considered separately.
A motion was made by Councilmember Neal and seconded by Cou ncilmember Austin

s. Recognition of Retiree: Darrell ]. Marchand, Jr. The meeting was recessed 4:35 -
4:47 to allow for cake and congratulations to Mr. Marchand.
b. No action was taken regarding the proclamation honoring Dollye Roberts.
c. A motion was made by CouncUnnernbmrAustin and seconded by Counc|rnernber
Neal to authorize the submittal of a 2016 grant application to the Wilton and Effie
Mae Hebert Foundation. MOTION CARRIED.

d. A motion was made by Mayor Pro Tern Albanese and seconded by Counci|member
Austin to approve Change Order #1 in the amount of $4,081.35 to add an
additional underground junction box, including conduits/ that will tie the new
service center with the old service center and also the sewer plant at the Nederland
Service Center. MOTION CARRIED.

Albanese to approve final payment and release of retainage to Gulf States
Protective Coatings, Inc. for the South 5m Street water tower rehabilitation project.

g. A motion was made by Mayor Pro Tern Albanese and seconded bvDound|member
Neal to award a bid to Delta Specialty Contractors in the amount of $59,000.00 for
the Nederland swimming pool fence project. MOTION CARRIED.

i. Fiscal Year 2016-2017 Budget:
i. The regular meeting was recessed and a Public Hearing was called to order at
4:59 p.m. by Mayor Nugent for the purpose of receiving comments regarding the
proposed City ofNederland Fiscal Year 2O16-2O17Annual Budget.
Chris Duque, City Manager, indicated this public hearing was necessary in
accordance with City Charter. Citizens will be given the opportunity to comment
on the proposed budget. He advised a copy of the proposed budget is available in
the City Clerk's office and onthe City ofNeder|and'swebsite. Headded the ZO1G-
2O17Annual Budget will be on the City Council agenda on September 13, 2016 at
4:30 p.m. for their consideration.

There being no further questions and/or comments the Public Hearing was
adjourned and the regular meeting was reconvened at 5:00 p.m. by Mayor Nugent.
ii. The regular meeting was recessed and a Public Hearing was called toorder at
S:OO p.m. by Mayor Nugent for the purpose of receiving comments regarding the
proposed tax rate of$O.S94Oper $1OOassessed valuation for the fiscal year 3O16 -
2O17'
Mr. Duque stated this public hearing is being held h»discuss the proposed FY3O16-
2O17tax rate. Atthe August 8mmeeting, the council unanimously voted toadjust
the tax rate to $0.5940 per $100 assessed valuation for the fiscal year beginning
October 1,2D16 and ending September 3D,2O17. Herecommended adjusting the
tax rate due tonominal appraised value growth, the drop inoil prices that continue
toaffect sales tax and industrial tax revenue, the costs associated with the police
CBA and fire CBA, and the request from Police Chief Bush for an additional police
officer position. The second public hearing shall be held on Monday, August 29,
2O1Gat4:3Dp.nn.atthe Nederland City Hall Council Chamber.
Therm being no further questions and/or comments the Public Hearing was
adjourned and the regular meeting was convened at 5:01 p.m. by Mayor Nugent.
5. EXECUTIVE SESSION
The regular meeting was recessed at 5:02 p.m. by Mayor Nugent for the purpose of
conducting an Executive Session as authorized by Texas Government Code, Chapter
551.071, Consultation with City Attorney; and Chapter 551.074, Personnel, Annual
Evaluation - City Manager, Christopher Duque.
6, RECONVENE
The regular meeting was reconvened atG:46by Mayor Nugent.
h. A motion was made by Mayor Pro Tern Albanese and seconded bvCound|rnennber
Austin to terminate the agreement with Severn Trent Environmental Services and
resume city operations of the wastewater treatment plant beginning October 1,
2016. MOTION CARRIED.

7. APPOINTMENT
Amotion was made by Mayor Pro Tern Albanese and seconded byCound|member
Austin to approve an employment agreement between the City of Nederland and

City Manager's Report:
a. On Friday (8/19) a work directive for additional work was given to LD
Construction for work on Atlanta between 14m Street and the Dead-end. The
cost of $23,900 is below the 25% cost threshold for changes to the contract.
b' ASpec|a| City Council Meeting will be held on August 29�om.
c. Back the Blue Day is Wednesday, August 24th

seconded by Mayor Pro Tern Albanese to adjourn the meeting at 6:52 p.m. MOTION
