1_ MEETING
The meeting was called to order at 4:30 p.m. by Mayor Nugent at the Nederland City
Office Building, 207 N. 12t" Street, Nederland, Texas. See attached for quorum.
The following statement was posted:

2. INVOCATION AND PLEDGE OF ALLEGIANCE
The invocation and pledge of allegiance were led by Chris Duque, City Manager.
3. CONSENT AGENDA - All consent agenda items listed are considered to be routine by
the City Council and will be enacted by one motion. There will be no separate
discussion of these items unless a councilmember so requests, in which event the item
will be removed from the Consent Agenda and considered separately_
A motion was made by Councilmember Neal and seconded by Counci!member Belaire
to approve the Consent Agenda Items a-d as presented. MOTION CARRIED_
Ayes: Mayor Nugent, Councilmembers Neal, and Belaire_
Noes: None.
Absent: Mayor Pro Tem Albanese, and Councilmember Austin.

4. REGULAR AGENDA
a. A motion was made by Councilmember Neal and seconded by Councilmember
Belaire to appoint Mike Louviere to the Zoning Board of Appeals and Board of
Appeals to fill the unexpired term of Dr. Lanny Howell. MOTION CARRIED.
Ayes: Mayor Nugent, Councilmembers Neal, and Belaire.
Noes: None.
Absent: Mayor Pro Tern Albanese, and Councilmember Austin.
b. A motion was made by Councilmember Belaire and seconded by Councilmember
Neal to approve Resolution 2017-15, casting votes for Charles Lankford as a
candidate for the Board of Directors of the Jefferson County Appraisal District.
MOTION CARRIED.
Ayes: Mayor Nugent, Councilmembers Neal, and Belaire.
Noes: None.
Absent: Mayor Pro Tern Albanese, and Councilmember Austin.
c. A motion was made by Councilmember Neal and seconded by Councilmember
Belaire to approve an agreement with UA engineering, Inc. for engineering
services related to the Phase II MS4 Permit Implementation Services, Permit Year
5, FY 2017-2018. MOTION CARRIED.
Ayes: Mayor Nugent, Councilmembers Neal, and Belaire.
Noes: None.
Absent: Mayor Pro Tern Albanese, and Councilmember Austin.
d. Chris Duque, City Manager, reported five bids were received on the Nederland
Avenue - 12th Street Drainage project with the lowest bid being $1,192,121.87
from McInnis Construction. The project engineer's opinion of probable construction
cost was approximately $856,000.00. The Public Works Director recommends
rejecting bids since the lowest was approximately $300,000.00 over budget. After
assessing all the bids, staff recommends combining both Nederland Avenue
projects (drainage and road work) into one large project under the guidance of one
project engineer, Schaumburg & Polk, Inc. The project timeline would be slightly
amended with completion in late summer. Mr. Duque concurred with the Public
Works Director's recommendation.
A motion was made by Councilmember Belaire and seconded by Mayor Nugent to
reject all bids for the Nederland Avenue and 12th Street Drainage project. MOTION
CARRIED.

Noes: None.
Absent: Mayor Pro Tern Albanese, and Councilmember Austin.
e. A motion was made by Councilmember Belaire and seconded by Councilmember
Neal to amend the work authorization with Schaumburg & Polk, Inc. for the
Nederland Avenue project to include the 12th Street Drainage project. MOTION
CARRIED.
Ayes: Mayor Nugent, Councilmembers Neal, and Belaire.
Noes: None.

5. COMMUNICATION
City Manager's Report:
a. The 1st December City Council meeting will be Monday, December 11th
b. Christmas on the Avenue - Saturday, December 2nd
c. Annual Lighted Christmas Parade - Tuesday, December 5th
d. Miscellaneous - a sink hole was reported at the end of Jackson off of 14th Street
toward the Entergy ROW. A TV inspection was done and work will begin soon.
6. ADJOURN
There being no further business a motion was made by Mayor Nugent and
seconded by Mayor Pro Tern Albanese to adjourn the meeting at 4:54 p.m. MOTION
CARRIED.

RESOLUTION 2017-15
WHEREAS,Senate Bill No.621,Acts of the 66th Texas Legislature, Chapter 841,
1979, provides for establishing an Appraisal District which would concern the City of
Nederland;and
WHEREAS,the Act provides that the Appraisal District shall be governed by a Board of
Directors to be chosen by the taxing units within the district by a voting method set out in the
Act;and
WHEREAS,the Act provides for nomination of candidates for the Board by the taxing
units within the Appraisal District; and
WHEREAS,the City of Nederland is desirous of having representation on the Board
of Directors of the Appraisal District;and
WHEREAS,the Act entitles each taxing unit to vote and determine its votes by
resolution submitted to the Jefferson County Appraisal District before December 15,2015.
NOW,THEREFORE, BE IT RESOLVED,that the City Council of the City of
Nederland, in compliance with Senate Bill No.621, hereby casts its entire vote as follows:
