1. MEETING
The meeting was called to order at 4:30 p.m. by Mayor Nugent at the Nederland City
Office Building, 207 N. 12r" Street, Nederland, Texas. See attached for quorum.
The following statement was posted:

2_ INVOCATION AND PLEDGE OF ALLEGIANCE
The invocation and pledge of allegiance were led by Gay Ferguson, City Clerk.
3. CONSENT ^GENOA - All consent agenda items listed are considered to be routine by
the City Council and will be enacted by one motion. There will be no separate
discussion of these items unless a councilmember so requests, in which event the item
will be removed from the Consent Agenda and considered separately.
A motion was made by Councilmember Austin and seconded by Councilmember Selaire
to approve the Consent Agenda Items a-e as presented. MOTION CARRIED..
Ayes: Mayor Nugent, Councilmembers Austin, and Selaire.
Noes: Mayor Pro Tem Neal.

d_ Consider action setting a Public Hearing date to discuss amending the Zoning
Ordinance Permitted Use Tale by adding the use "tattoo parlors" in C-2
(Neighborhood Retail) zoning districts with prior approval of a Specific Use Permit.
e. Consider action setting a Joint Public Hearing for the purpose of receiving
comments regarding the request for a Specific Use Permit for the property located
at 2826 Avenue H to operate a tattoo parlor in a C-2 (Neighborhood) zoning
district.
Councilmember Austin was concerned with the hours of operation of the Tattoo
Parlor. Chris Duque, City Manager, said the owner of the proposed tattoo parlor
would be at the next meeting to discuss his plans. He also said Planning S. Zoning
has met and is going to recommend tattoo parlors be allowed but with a Specific
Use Permit so additional conditions could be set.
Mayor Pro Tem Neal said he is not in favor of any tattoo parlors in Nederland.

4. REGULAR AGENDA
a. Allen Nation, President, Adaptive Sports for Kids, thanked the City Council for their
continued support of ASK programs. He invited everyone out to Opening Day which
is scheduled for noon, March 23, 2019 at Vincent Beck Stadium. Several athletes
were in attendance to present t-shirts to councilmembers and staff.
b. Recognition of Jefferson County Master Gardeners Club for the volunteer gardening
work on Boston Avenue.
c. Recognition of Nederland Domino's for their on-going support of Nederland Parks
& Recreation Department activities.
A motion was made by Councilmember Belaire and seconded by Councilmember
Austin to postpone items "b" and "c" until March 11, 2019. MOTION CARRIED.
Ayes: Mayor Nugent, Councilmembers Austin, Neal, & Belaire.
Noes: None.
d. A motion was made by Mayor Pro Tem Neal and seconded by Councilmember
Austin to approve Resolution No. 2019-03, designating the City's Emergency
Operations Center as the R. A. Nugent Emergency Operations Center. MOTION
CARRIED.
Ayes: Mayor Nugent, Councilmembers Austin, Neal, and Belaire.
Noes: None.
e. A motion was made by Councilmember Belaire and seconded by Councilmember
Austin to approve the re-plat request of Tract 41-B-1 of Pleasant Homes Addition.
MOTION CARRIED.
Ayes: Mayor Nugent, Councilmembers Austin, Neal, and Belaire.
Noes: None.
f. Chris Duque, City Manager, reviewed the proposed changes of Ordinance 2019-07,
establishing hours of operation, procedures, facility rental fees, pool rental/passes,
and league fees for the Nederland Recreation Center and Nederland Swimming
Pool. The Parks Advisory Board reviewed these adjustments to the fees and
recommends approval. Mr. Duque said he agrees with all the changes except for
Open Swim which he would like to keep at the current fee for residents and non-
residents.
A motion was made by Councilmember Austin and seconded by Mayor Pro Tern
Neal to approve Ordinance No. 2019-07, establishing hours of operation,
procedures, facility rental fees, pool rental/passes, and league fees for the
Nederland Recreation and Nederland Swimming Pool excluding open swim fee
which will remain the same. MOTION CARRIED.
Ayes: Mayor Nugent, Councilmembers Austin, Neal, and Belaire.
Noes: None.
g. Contracts/Bids:
i. A motion was made by Councilmember Austin and seconded by Mayor Pro Tem
Neal to authorize the solicitation of bids for water inventory items. MOTION
CARRIED.
Ayes: Mayor Nugent, Councilmembers Austin, Neal, and Belaire.
Noes: None.

ii. A motion was made by Councilmember Austin and seconded by Mayor Pro Tern
Neal to authorize the solicitation of bids for the 2019-2020 Concrete Sewer
Rehabilitation project. MOTION CARRIED.
Ayes: Mayor Nugent, Councilmembers Austin, Neal, and Belaire.
Noes: None.
iii. A motion was made by Councilmember Austin and seconded by Councilmember
Belaire to approve an agreement for consulting services with HUB International
related to employee group benefits. MOTION CARRIED.
Ayes: Mayor Nugent, Councilmembers Austin, Neal, and Belaire.
Noes: None.
iv. A motion was made by Mayor Pro Tern Neal and seconded by Councilmember
Belaire to authorize a request for proposals for employee group benefits (health
insurance, dental insurance, life insurance, and vision insurance). MOTION
CARRIED.
Ayes: Mayor Nugent, Councilmembers Austin, Neal, and Belaire.
Noes: None.
v. A motion was made by Councilmember Austin and seconded by Mayor Pro Tern
Neal to authorize the solicitation of bids for the Marion & Ed Hughes Public Library
Roof project. MOTION CARRIED.
Ayes: Mayor Nugent, Councilmembers Austin, Neal, and Belaire.
Noes: None.
5. EXECUTIVE SESSION
The regular meeting was recessed at 5:09 p.m. by Mayor Nugent for the purpose of
conducting an Executive Session as authorized by Texas Government Code, Chapter
551.071, Consultation with City Attorney; and Chapter 551.074, Discuss Personnel -
City Manager.
6. RECONVENE
The regular meeting was reconvened at 5:32 p.m. by Mayor Nugent. He announced
the Executive Session was held for informational purposes only and no action was
necessary.
7. COMMUNICATION
City Manager's Report:
a. Trash Bash - March 9th
b. Miscellaneous - Hooked on Fishing Not on Drugs was held this past Saturday,
Little League is having Opening Day this Saturday, March 2nd.

8. ADJOURN
There being no further business a motion was made by Councilmember Belaire and
seconded by Councilmember Austin to adjourn the meeting at 5:33 p.m. MOTION
CARRIED.

A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF NEDERLAND, TEXAS,
DESIGNATING THE CITY'S EMERGENCY
OPERATIONS CENTER LOCATED AT 1400
BOSTON AVENUE AS THE "R.A. NUGENT
EMERGENCY OPERATIONS CENTER"
WHEREAS, R.A."Dick"Nugent's life is one of dedicated and self-less service to his
community and area. For over 43 years, he has served on the Nederland City Council,
including 15 years as Mayor;and
WHEREAS, R.A. "Dick"Nugent's professional and political career have focused on
emergency management. His professional career has included work as Nederland's Civil
Defense Coordinator and Jefferson County's Emergency Management Coordinator. As
Mayor, he has served as the City's Emergency Management Director overseeing the
City's efforts with various natural disasters;and
WHEREAS, in 2014 during his tenure as Mayor, the police and fire station and the
former city hall were renovated and named the"Homer E. Nagel Public Safety Complex,"
which included the emergency operations center.
NOW,THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF NEDERLAND,TEXAS:
Section I. R.A. "Dick" Nugent is an exemplary public servant with the highest
level of integrity, who worked tirelessly to serve the citizens of
Nederland and is dedicated to the men and women of the City.
Section II. In 2019, Mayor Nugent reached his 47th year of service to the City of
Nederland.
Section III. The emergency operations center located at the Homer E. Nagel
Public Safety Complex shall forever be known as the "R.A. Nugent
Emergency Operations Center".

ORDINANCE NO. 2019-07
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF NEDERLAND, TEXAS ESTABLISHING HOURS OF
OPERATION, PROCEDURES, FACILITY RENTAL
FEES, POOL RENTAL/PASSES, AND LEAGUE FEES
FOR THE NEDERLAND RECREATION CENTER AND
THE NEDERLAND SWIMMING POOL AS SHOWN IN
EXHIBIT "A"; REPEALING ORDINANCE NO. 2018-01;
AND ESTABLISHING AN EFFECTIVE DATE.
WHEREAS,the Nederland Parks&Recreation Board has reviewed the presented revisions
to the parks schedule of fees ordinance and recommends its adoption to the Nederland City
Council;and
WHEREAS,the City Council of the City of Nederland has been presented with hours of
operation, procedures, and a schedule of fees for the Nederland Recreation Center and the
swimming pool for its acceptance and adoption;and
WHEREAS,the City Council of the City of Nederland deems it advisable and to be in the
best interest of the citizens of Nederland to adopt the hours of operation, procedures, and fee
schedule for the Nederland Recreation Center and the swimming pool as shown in Exhibit "A"
attached;and
NOW,THEREFORE,BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF NEDERLAND,
TEXAS THAT:
Section 1. The hours of operation, procedures, and fee schedules as shown in Exhibit
"A"attached,which is incorporated herein by reference,is hereby approved
and adopted;and
Section 2. Ordinance No. 2018-01 shall be repealed when this Ordinance becomes
effective;and
Section 3. This ordinance shall take effect and be in force from and after its passage.

Notes:
Open Swim:
o During the daily Open Swim,the fee for admission for residents and non-residents is half the
normal price for the final hour of open swim (3:30-4:30pm Tuesday-Saturday,4:00-5:OOpm
on Sunday.
Single pass:
o Only valid for swimmers over the age of 10.
o Parent consent and emergency contact information required at application.
o No admission/attendance requirements.
Family passes:
o All children under age of 10 require parent/guardian/adult supervision at all times, no
exceptions.
o Non-relative adults (baby-sitters, neighbors, etc) may be listed on application.
o Additional members may be added up to seven (7)family members. Changes cannot be
made to the pass during the pool season.
