1. MEETING
The meeting was called to order at 4:30 p.m- by Mayor Albanese at the Nederland City
Office Building, 207 N. 12"" Street, Nederland, Texas. See attached for quorum.
This meeting was OPEN to in-person attendance by the public; however due to the
- spacing restrictions in the City Council Chamber, all attendees WORE A MASK- The
City continued to provide citizens an alternative method to attend and participate in
City Council meetings. Members of the public were able to participate remotely via
Zoom Teleconferencing.

the City Council and will be enacted by one motion- There will be no separate
discussion of these items unless a councilmember so requests, in which event the item
will be removed from the Consent Agenda and considered separately-
A motion was made by Councilmember Austin and seconded by Councilmember Root
to approve the Consent Agenda Items a-b as presented- MOTION CARRIED,.

a. Minutes - April 26, 2021 regular meeting
b. Consider action regarding a request from Hillcrest Baptist Church to utilize the Babe
Ruth ballpark for a softball game.

a. A motion was made by Mayor Pro Tem Hollier and seconded by Councilmember
Neal to approve a proclamation in regard to Motorcycle Safety Awareness Month.

b. A motion was made by Councilmember Austin and seconded by Mayor Pro Tern
Hollier to amend Ordinance 164, setting the calendar for regular City Council
meetings for January 2022. MOTION CARRIED.

Noes: None.
c. A motion was made by Councilmember Neal and seconded by Councilmember Root
to approve an Interlocal Agreement between the City of Nederland and the South
East Texas Regional Planning Commission for Planning, Development, Operation
and Provision of 9-1-1 Service and the Use of 9-1-1 funds. MOTION CARIED.
Ayes: Mayor Albanese, Councilmembers Austin, Neal, Hollier, and Root.

d. A motion was made by Councilmember Root and seconded by Mayor Pro Tem
Hollier to approve Resolution No. 2021-21, ratifying a Declaration of Disaster of
Local State of Disaster in response to concerns related to the Coronavirus Disease
2019 (COVID-19) and consenting to continuation of the disaster declaration for a
period of more than thirty days. MOTION CARRIED.

e. A motion was made by Mayor Pro Tern Hollier and seconded by Councilmember
Austin to approve Resolution 2021-22, ratifying the action of the Nederland
Economic Development Corporation Board of Directors related to the incentive
offered to Imprint Studios. MOTION CARRIED.
Ayes: Mayor Albanese, Councilmembers Austin, Neal, Hollier, and Root.

f. A motion was made by Councilmember Austin and seconded by Mayor Pro Tern
Hollier to approve Resolution No. 2021-23, ratifying the action of the Nederland
Economic Development Corporation Board of Directors related to the purchase of
the former Bank of America parking lot/drive-thru (legal description: N 1/2 BIk 16
and All of 1 & 6 20" alley). MOTION CARRIED.

Noes: None.
g. A motion was made by Mayor Pro Tem Hollier and seconded by Councilmember
Neal to approve Ordinance No. 2021-07, authorizing the acquisition of an easement
for waterlines to facilitate economic Development at the Jack Brooks Airport.
MOTION CARRIED.

Noes: None.
h. A motion was made by Mayor Pro Tern Hollier and seconded by Councilmember
Austin to approve Ordinance No. 2021-08, authorizing the acquisition of an
easement for utility lines to facilitate economic development at the Jack Brooks
Airport. MOTION CARRIED.
Ayes: Mayor Albanese, Councilmembers Austin, Hollier, and Root.
Noes: None.
i. A motion was made by Councilmember Root and seconded by Councilmember
Austin to approve the final plat of Heritage Estates Private Subdivision and
Minutes Continued, May 10, 2021
accepting the water main, which includes fire hydrants, valves, and meters.
MOTION CARRIED.
Ayes: Mayor Albanese, Councilmembers Austin, Neal, Hollier, and Root.
Noes: None.
j. A motion was made by Councilmember Root and seconded by Mayor Pro Tem
Hollier to authorize the solicitation of bids for the 2021 Concrete Pavement
Rehabilitation project. MOTION CARRIED.

Noes: None.
k. A motion was made by Councilmember Austin and seconded by Councilmember
Root to authorize the solicitation of bids for the 2021 Flexible Pavement
Rehabilitation project. MOTION CARRIED.

Noes: None.
I. A motion was made by Councilmember Neal and seconded by Councilmember Root
to authorize the expenditure of funds for the Port Arthur Health Department in
recognition of COVID-19 vaccination efforts. MOTION CARRIED.
Ayes: Mayor Albanese, Councilmembers Austin, Neal, Hollier, and Root.

m. A motion was made by Councilmember Austin and seconded by Mayor Pro Tem
Hollier to postpone Ordinance No. 2021-09, authorizing the issuance of City of
Nederland, Texas, Combination Tax and Revenue Certificates of Obligation, Series
2021. MOTION CARRIED.
Ayes: Mayor Albanese, Councilmembers Austin, Neal, Hollier, and Root.

5. COMMUNICATION
City Manager's Report:
a. Miscellaneous:
• Robert Woods gave a brief construction update:
1. Bourque Road and Hodgson Road rehabilitation is approximately
65% complete.
2. Hodgson Road Lift Station is near completion. Pumps are in and
Entergy is due to provide power.
3. 14th Street wastewater main is completed and cleaning up is
underway.
4. Wastewater Treatment plant is continuing with phase one and phase
two.
5. Elevated water tower on Canal is nearing completion. Contractor
will move to Avenue G on May 17th to begin work.
• NISD will host a senior parade and senior pictures will go on the City's
marque.
• 2nd Townhall meeting will be held May 24th at 6:00 p.m. in person and
by Facebook Live.
• Chamber of Commerce monthly coffee will be tomorrow at 8:00 a.m.
at the Golden Cup on Boston Avenue.

RESOLUTION NO. 2021-21
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEDERLAND, TEXAS EXTENDING THE DISASTER
DECLARATION ISSUED BY MAYOR ALBANESE ON
MARCH 16, 2020 IN RESPONSE TO THE CORONAVIRUS
DISEASE 2019 (COVID-19)
WHEREAS, the City of Nederland, Texas has been impacted by the Coronavirus Disease 19
(COVID-19)that was declared a pandemic by the World Health Organization;and
WHEREAS,on March 16, 2020, Don Albanese, Mayor of the City of Nederland,Texas issued a
Declaration of Disaster declaring a state of disaster for the City of Nederland;and
WHEREAS,the Nederland City Council via Resolution No.2020-03, No.2020-04, No. 2020-06,
No. 2020-09, No. 2020-12, No. 2020-14, No. 2020-19, No. 2020-29, No. 2020-30, No. 2021-03, No.
2021-05, No. 2021-08, and No. 20201-14 authorized the extension of the Declaration of Disaster in
accordance with Section 418.018 of the Texas Government Code;and
WHEREAS,the conditions necessitating such disaster declaration continue to exist;and
WHEREAS, pursuant to Section 418.108(b), Texas Government Code, a local state of disaster
may not be continued for a period in excess of seven(7)days without the consent of the governmental
body of the political subdivision;and
WHEREAS,the continued presence and effects of Coronavirus Disease 19(COVID-19)pose an
imminent threat to public health and safety and immediate action of the City Council is required.
NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF NEDERLAND,TEXAS,
THAT:
Section 1. The declaration of disaster, which was signed and executed by the Mayor on
March 16, 2020, shall be extended by the City Council of the City of Nederland
effective May 17,2021 through June 16,2021 in accordance with Section 418.018
of the Texas Government Code.
Section 2. The meeting at which this resolution was approved was in all things conducted in
strict compliance with the Open Meetings Act,Texas Government Code,Chapter
551.
Section 3. This resolution shall.become effective from and after its passage.

FINDING THAT THE MEETING COMPLIES
WITH THE OPEN MEETINGS ACT; MAKING
OTHER FINDINGS
WHEREAS,the City of Nederland,Texas, a home rule municipal corporation (the
"CITY"),that provides water and wastewater services to the City and the area within the
extraterritorial jurisdiction of the City;and
WHEREAS, the City Council finds it is reasonable and necessary to acquire an
easement,the acquisition of the easement is a public purpose and is necessary and useful
for the public health,safety and welfare and to serve economic development at the Jack
Brooks Airport;and
WHEREAS, the metes and bounds included as "Exhibit A" represents the
easement;and
WHEREAS,the City Council of the City of Nederland deems it in the public interest
to acquire this easement from Jefferson County,Texas, subject to the conditions listed
below.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
NEDERLAND,TEXAS,THAT:
Section 1. That the statement and findings set out in the preamble to this
Ordinance are hereby in all things approved and adopted.
Section 2. The City of Nederland hereby acquires from Jefferson County,
Texas an easement(the metes and bounds description is included
as Exhibit"A").
Section 3. Jefferson County, Texas shall accept the provisions of this
Ordinance by signing as indicated below within sixty(60)days after
this Ordinance is adopted by the Nederland City Council. In the
event said acceptance is not signed as provided for, this
abandonment shall be of no further effect and shall be considered
as having been entirely cancelled.
Section 4. The City Manager is authorized to execute any necessary
documents related to this abandonment.
Section 5. It is declared to be the intention of the Nederland City Council that
the sections, paragraphs, sentences, clauses, and phrases of this
Ordinance are severable. If any phrase, clause, sentence,
paragraph,or section of this Ordinance should be declared invalid
by a final judgement or decree of any court of competent
jurisdiction, such invalidity shall not affect any of the remaining
phrases, clauses, sentences, paragraphs, and sections of this
Ordinance.
Section 6. All Ordinances or parts thereof in conflict herewith are repealed to
the extent of such conflict only.
Section 7. The meeting at which this ordinance was approved was in all things
conducted in strict compliance with the Texas Open Meetings Act,
Texas Government Code,Chapter 551.
Section 8. This ordinance shall become effective from and after its passage.

Being a 0.665 acre acre tract of land for a 20-foot wide utility easement lying in the Wm.Carroll
Survey,Abstract No. 13,Jefferson County,Texas,and being out of and a portion of that certain called
185.12 acre tract of land designated as"Second Tract"in an instrument to the County Of Jefferson of
record in Volume 499,Page 136,Deed Records of Jefferson County,Texas, said 0.665 acre being more
particularly described by metes and bounds as follows:
Note:All bearings, distances, areas, and coordinates are grid, based on the Texas Coordinate System of
1983 (NAD83), South Central Zone.
COMMENCING at a capped iron rod stamped"A&G"found marking the intersection of the
Southwesterly line of U.S.Highway No. 69,96,and 287(right of way varies)with the Northwesterly line
of a 100-foot unnamed right of way, said iron rod having a Texas State Plane Coordinate Value of N:
13,930,229.96, E:3,547,053.86, from which a capped iron rod stamped"A&G"found marking an angle
point on the Southwesterly right of way line of said U.S.Highway No. 69, 96,and 287 bears N 45°48'03"
W a distance of 85.41 feet;
THENCE S 44°03;09"W with the Northwesterly line of said 100-foot unnamed right of way a distance
of 286.07 feet to a point lying in the Northwesterly line of said 100-foot unnamed right of way and being
the POINT OF BEGINNING and East corner of the herein described tract;
THENCE S 44°03'09" W continuing with the Northwesterly line of said 100-foot unnamed right of way
and the Southeasterly line of the herein described tract a distance of 20.01 feet to a point lying in the
Northwesterly line of said 100-foot unnamed right of way and being the South corner of the herein
