CONSTRUCTION BOARD OF APPEALS MINUTES
MEETING
October 26, 202t
The meeting was held October 26, 2021, at the City of Nederland D. Bob Henson
Office Building, 1903 Atlanta Avenue, Nederland, Texas and was called to order
at 5:00 p.m. by Boyd Meier, Chairman.
MEMBERS PRESENT: Boyd Meier, Ron Minaldi, Ricky Root, Mike Spell
and David Knight
MEMBERS ABSENT: Steve Gentile and Mitch Macon
CITY STAFF PRESENT: George Wheeler, Chief Building Official and Beth
Merren, Inspections Department Secretary
OTHERS PRESENT: Tommy Page, Mrs. Page, Deborah Sanchez and
April Osburn
APPROVAL OF MINUTES
A .motion was made by David Knight and seconded by Ricky Root to approve the
minutes of the August 24, 2021 meeting. All voted aye.
3. PROPERTIES
A. Dilapidated and Unsafe Structures: Located at 215 23Cd Street, described as
Lot 9, Block 5, Hilltop Addition. Property owner, Tommy Page appeared to
make an extension request. Board chairman, Boyd Meier, asked Mr. Page how
much time he would need to finish the project. Mr. Page stated he would need
at least a one (1) year extension to complete the unfinished garage structure.
The Building Official noted that by code the Construction Board of Appeals
cannot grant a time period for compliance that is greater than ninety (90) days.
Ricky Root brought up the yard condition which was discussed. The Building
Official stated that by ordinance, there is a different penalty process for
noncompliance of yard violations thru the court system by way of fines and
that the Code Enforcement Officer has started the process for the yard
violations. The Construction Board of Appeals would only act on the yard
condition when the structure was to be heard as a complete demolition and
clearing of the lot. At such time, the yard violations can be made part of the
board's motion and be part of the clearing of the lot. After a full discussion a

motion was made by Ron Minald stating Mr. Page be allowed ninety (90)
days to have the encroaching wall moved from the five (5) ft. side yard
building setback, the framing finished, submit an engineer's letter approving
the framing, and complete the exterior of the structure. At the expiration of
ninety (90) days if not complete, the Building Official shall order Mr. Page to
appear before the City Council to continue the demolition process for the
abandoned construction. The motion was seconded by Ricky Root. All voted
aye.

5. ADJOURN
There being no other business a motion was made by David Knight and seconded
by Ricky Root to adjourn the meeting at 6:25 p.m. All voted aye.
