MEETING
March 23, 2021
The meeting was held March 23, 2021, at the City of Nederland D. Bob Henson
Office Building, 1903 Atlanta Avenue, Nederland, Texas and was called to order
at 5:00 p.m. by the Chairman.
MEMBERS PRESENT: Jerry Smith, Mike Louvier, David Guillot and Paul
Hussey
MEMBERS ABSENT: Michael Whitehead
CITY STAFF PRESENT: George Wheeler, Chief Building Official and Beth
Merren, Inspections Department Secretary
OTHERS PRESENT: Tommy Page, Deborah Sanchez, and April Osburn
APPROVAL OF MINUTES
A motion was made by Paul Hussey and seconded by Mike Louvier to approve
the minutes of the September 15, 2020 meeting. All voted aye.
VARIANCES
a. Cuong V. Tran and Nga N. Pham, owners of the property located at 7816
Green Avenue, described as Lot 57, Pleasant Home Replat Addition requested
a variance to the City Zoning Ordinance, Section 12.1 "Schedule of residential
district regulations" to construct an accessory building (garage) prior to the
construction of the primary residence. After a full discussion, a motion was
made by Mike Louvier and seconded by Paul Hussey to approve the variance
contingent upon the construction of the primary residence beginning within
one year of the variance approval. All voted aye.
b. Tommy Page, owner of the property located at 215 23rd Street, described as
Lot 9, Block 5, Hilltop Addition requested a variance to the City Zoning
Ordinance, Section 12.2 "Schedule of residential height and area regulations"
which requires a five foot side yard building setback. On November 12, 2019
the Zoning Board of Appeals approved a one (F) foot variance for Mr. Page to
build an attached garage to his residence. However, in 2021, the partially
finished structure was found to be encroaching (2' 10") two foot ten inches into
the side yard. After a full discussion, a motion was made by Mike Louvier
and seconded by Paul Hussey to deny the variance extension and require Mr.
Page to obtain a survey confirming differing measurements within 30 days

and/or to within 6 months move the structure back to the encroachment
measurements of the first approve variance and complete the framing and
complete exterior of the structure or to demolish the addition and if not in
compliance at the deadline instructing Mr. Wheeler to send the addition to the
Construction Board of Appeals for a demolition hearing. All voted aye.
c. Jackie Marshall, owner of property located at 324 S. 15th Street, described as
Lot 27, J. Carabin Addition, failed to appear. After a full discussion, a motion
was made by David Guillot and seconded by Paul Hussey to deny the
variance. All voted aye.

5. ADJOURN
There being no other business a motion was made by Paul Hussey and seconded
by David Guillot to adjourn the meeting at 6:15 p.m. All voted aye.
