MEETING
February 15, 2022
The meeting was held February 15, at the City of Nederland D. Bob Henson
Office Building, 1903 Atlanta Avenue, Nederland, Texas and was called to order
at 5:00 p.m. by the Chairman.
MEMBERS PRESENT: Jerry Smith, Paul Hussey, Michael Whitehead and
David Guillot
MEMBERS ABSENT: Mike Louvier
CITY STAFF PRESENT: George Wheeler, Chief Building Official and Beth
Merren, Inspections Department Secretary
OTHERS PRESENT: Diana Dennis, JamieDue Reese, Mandy Clayton,
and Edward Fontenot
APPROVAL OF MINUTES
A motion was made by Paul Hussey and seconded by Jerry Smith to approve the
minutes of the August 3, 2021 meeting. All voted aye.
3. VARIANCES
a. Property owner and prospective tenant of 1515 Nederland Avenue, described
as Lots 1 and 2, J. Carabin 1 Addition, requested a variance to Section 12.3
"Schedule of nonresidential height and area regulations of the City Zoning
Ordinance to move an existing commercial building from 911 N. Twin City
Highway to 1515 Nederland Avenue. After a full discussion a motion to
approve the variance was made by Jerry Smith and seconded by Paul Hussey.
David Guillot, Jerry Smith, and Paul Hussey voted to grant variance. Michael
Whitehead voted to deny variance. Motion carried.
b. Jamie Due Reese, owner of the property located at 1320 Kent Avenue,
described as Lot 2, Block 17G, Tract 3, Port Arthur Land Company, requested
a medical hardship variance to Section 11.4 (1)"Single-family zoning district"
to occupy a detached building as living quarters to care for a family member.
After a full discussion, the chairman called for a motion and second to grant a
one (1) year medical hardship variance with the stipulation that the applicant
is required to annually renew the hardship variance or should the hardship
change, the building shall be vacated. All voted aye.

c. J.E. Clayton, owner of the property located at 1229 N. 22"d Street, described
as Lot 12, Block 1, Cottage Groves Addition, requested a medical hardship
variance to Section 11.4 (1)"Single-family zoning district" to occupy a
detached building as living quarters to care for a family member. After a full
discussion, a motion was made by Michael Whitehead and seconded by Paul
Hussey to grant a one (1) year medical hardship variance with the stipulation
that the applicant is required to annually renew the hardship variance or
should the hardship change, the detached building shall be vacated. All voted
aye.
d. Edward Fontenot, owner of the property located at 115 S. 151h Street,
described as Lots 3 and 4, J. Carabin 1 Addition, requested a medical hardship
variance to Section 11.4 (1)"Single-family zoning district" to occupy a travel
trailer as living quarters to care for a family member. After a full discussion,
a motion was made by Jerry Smith and seconded by Paul Hussey to grant a
one (1) year medical hardship variance with the stipulation that the applicant
is required to annually renew the hardship variance or should the hardship
change, the travel trailer shall be vacated. All voted aye.
