April 17, 2023 REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF NEDERLAND 4:30 p.m. April 17, 2023 1. MEETING The meeting was called to order at 4:30 p.m. by Mayor Albanese at the Nederland City Office Building, 207 N. 12th Street, Nederland, Texas. See attached for quorum. The following statement was posted: "PURSUANT TO SECTION 30.07, PENAL CODE (TRESPASS BY LICENSE HOLDER WITH AN OPENLY CARRIED HANDGUN), A PERSON LICENSED UNDER SUBCHAPTER H, CHAPTER 411, GOVERNMENT CODE (HANDGUN LICENSING LAW), MAY NOT ENTER THIS PROPERTY WITH A HANDGUN THAT IS CARRIED OPENLY." 2. INVOCATION AND PLEDGE OF ALLEGIANCE The invocation and the Pledge of Allegiance was led by Marvin Cash, Sr. Vice Commander of the Veteran of Foreign Wars. 3. CONSENT AGENDA - All consent agenda items listed are considered to be routine by the City Council and will be enacted by one motion. There will be no separate discussion of these items unless a councilmember so requests, in which event the item will be removed from the Consent Agenda and considered separately. A motion was made by Councilmember Sonnier and seconded by Mayor Pro Tem Root to approve the Consent Agenda Item "a thru b"as presented. MOTION CARRIED. Tax Assessor Collection Report — March 2023 4. REGULAR AGENDA a. A motion was made by Councilmember Guillot and seconded by Councilmember Sonnier to approve a proclamation in regard to Southeast Texas Circle of Hope. MOTION CARRIED. A motion was made by Councilmember Sonnier and seconded by Mayor Pro Tem Root to authorize the closure of Boston Avenue between 12th Street and 14th Street and all intersections on Saturday, June 10th for the NEDC's Summer Market event. Discussion was held regarding the request to re-zone property located at 2120 Helena Avenue (the corner of Helena Avenue and 22"a Street) described as the SW Minutes continued, April 17, 2023 1/4 Lot 1, Block 2 of Cottage Groves from property zones (C-2) neighborhood retail to R-3 (multi-family medium density) for the construction of apartments. Chris Duque, City Manager, reported that in 2009, the Marion & Ed Hughes Public Library's hours open to the public were revised after the Library staff noted the demand for additional hours (resuming the Saturday hours that had been eliminated in 2003). The Library Director assessed the library use and noted the minimal use on Monday nights (in past year only 649 patrons on Mondays between 6 and 9PM). Following her recommendation, I have authorized the following revisions effective May 1St: On Mondays, the Library would be open to the public nine hours instead of the current eight, opening at 10AM instead of 1PM and closing at 7PM instead of 9PM. Tuesday, Wednesday, Friday and Saturday hours would remain the same. On Thursdays, the Library would be open to the public nine hours instead of the current eight, opening at 10AM and closing at 7PM instead of 6PM. The total number of hours open to the public would increase by two hours a week. The Library Director will assess these changes at the end of the calendar year; any necessary revisions would be implemented effective January 1, 2024. No action was necessary. e. A motion was made by Councilmember Sonnier and seconded by Councilmember Guillot to approve a request from Tri-Con, Inc. to waive utility charges associated with a water leak. MOTION CARRIED. A motion was made by Councilmember Guillot and seconded by Mayor Pro Tern Root to approve an Interlocal Agreement between the City of Nederland and Jefferson County for road improvements. A motion was made by Mayor Pro Tem Root and seconded by Councilmember Sonnier to amend the City of Nederland Personnel Policy Manual - vacation leave. MOTION CARRIED. A motion was made by Councilmember Guillot and seconded by Councilmember Sonnier to approve Ordinance No. 2023-11, setting the calendar for regular City Council meetings - May 2023 to April 2024. Chris Duque, City Manager, discussed the possibility of engaging GE), the grant administrator utilized for the GLO project, to pursue any grants available for the Doornbos Park Pond project. He stated that he would place this grant administrator contract on the May 8th agenda for approval. A motion was made by Councilmember Sonnier and seconded by Mayor Pro Tern Root to authorize the solicitation of bids for the Doornbos Park Pond project. MOTION CARRIED. Rob Woods, Director of Public Works, stated that the larger item on the Change Order is the utility adjustment for the water line and the rest is the reduction of the inlets. We are still waiting to hear when they will resume work. This is a working day calendar and they did have some lead time on some things. A meeting was held last week with GLO to make them aware of this situation. The grant will be covering the Change Order. A motion was made by Councilmember Guillot and seconded by Councilmember Sonnier to approve Change Order #1 - Hilldale/Hill Terrace and Nederland Avenue Drainage project. MOTION CARRIED. Miscellaneous: • Chris Duque wanted to recognize our Animal Control Officer and Public Works team for National Animal Control Officer week. He thanked them for their continued work with the animals. • The National Day of Prayer event will be held on May 4th here at City Hall, 7:30AM. • Early voting begins Monday, April 24th, here at City Hall. 6.
