April 10, 2023 REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF NEDERLAND 4:30 p.m. April 10, 2023 1. MEETING The meeting was called to order at 4:30 p.m. by Mayor Albanese at the Nederland City Office Building, 207 N. 12th Street, Nederland, Texas. See attached for quorum. The following statement was posted: "PURSUANT TO SECTION 30.07, PENAL CODE (TRESPASS BY LICENSE HOLDER WITH AN OPENLY CARRIED HANDGUN), A PERSON LICENSED UNDER SUBCHAPTER H, CHAPTER 411, GOVERNMENT CODE (HANDGUN LICENSING LAW), MAY NOT ENTER THIS PROPERTY WITH A HANDGUN THAT IS CARRIED OPENLY." 2. INVOCATION AND PLEDGE OF ALLEGIANCE The invocation and Pledge of Allegiance was led by Randy Sonnier, Councilmember Ward III. 3. CONSENT AGENDA - All consent agenda items listed are considered to be routine by the City Council and will be enacted by one motion. There will be no separate discussion of these items unless a councilmember so requests, in which event the item will be removed from the Consent Agenda and considered separately. A motion was made by Councilmember Sonnier and seconded by Mayor Pro Tem Root to approve the Consent Agenda Item "a"as presented. MOTION CARRIED. AYES: Mayor Albanese, Councilmembers Root, Sonnier, and Guillot. NOES: None. ABSENT: Councilmember Austin. a. Minutes - March 27, 2023 regular meeting 4. REGULAR AGENDA a. A motion was made by Councilmember Guillot and seconded by Mayor Pro Tem Root to approve a proclamation in regard to National Fair Housing Month. MOTION CARRIED. AYES: Mayor Albanese, Councilmembers Root, Sonnier, and Guillot. NOES: None. ABSENT: Councilmember Austin. b. A motion was made by Mayor Pro Tem Root and seconded by Councilmember Guillot to amend the City of Nederland COVID-10 Testing and Leave Policy. MOTION CARRIED. AYES: Mayor Albanese, Councilmembers Root, Sonnier, and Guillot. NOES: None. ABSENT: Councilmember Austin. c. A motion was made by Councilmember Sonnier and seconded by Mayor Pro Tem Root to approve an Agreement with Nederland Independent School District regarding financial assistance of the summer recreation program. A motion was made by Councilmember Guillot and seconded by Mayor Pro Tern Root to approve an Amendment to Ordinance 107, converting the Yield sign at Gage Avenue/Nederland Avenue intersection to a Stop sign. MOTION CARRIED. AYES: Mayor Albanese, Councilmembers Root, Sonnier, and Guillot. NOES: None. ABSENT: Councilmember Austin. e. Rob Woods, Director of Public Works, gave an update on Hill Terrace/Hilldale & Nederland Avenue Drainage Improvements project. Last week the consultant submitted plans for the material and redesign for Nederland Avenue and 1st Street to the contractor. On Nederland Avenue, the majority of the boxes have been placed and work is now being done on the tie-ins. We are seeing progress from the project engineer to the contractor, but at this time we don't have a return to work date. A meeting is scheduled for tomorrow and we should be receiving a timeline from them. On Hill Terrace, they are still waiting on Texas Gas and AT&T. 5. COMMUNICATION City Manager's Report: a. Miscellaneous: • This week the Parks Department began receiving reservations for pool parties. • This week is National Public Safety Telecommunications Week. The City Manager thanked the dispatchers that do a great job for us everyday. • On Saturday, April 15th, from 8:00AM to 1:00PM, SETRPC will host their annual Household Hazardous Waste Collection Event at Ford Park. The listed agenda items at this point of the meeting had all been addressed. However, prior to Mayor Albanese having the opportunity to declare the meeting adjourned, Jeff Darby, 1515 N. 26th St., went to the podium and started speaking without being on the agenda and without being properly recognized by the Mayor to speak. Jeff Darby stated this is the third time he has requested to be on the agenda. He wants to discuss the contract of the City Manager (for a third time) so that the general public can hear his concerns again. Chris Duque, City Manager, clarified that Mr. Darby's request had not been approved to be on the agenda due to the Mayor or two Council members had not requested that Mr. Darby be placed on the agenda. Further, they could discuss this after the meeting since he was not on the agenda. Jesse Branick, City Attorney, stated Mr. Darby's questioning was not part of the agenda. 6. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF NEDERLAND, TEXAS THAT, Ordinance No. 107 is hereby amended by adding the following language: ARTICLE VII. SECTION 54—STOP SIGNS The intersection at Gage Avenue and Nederland Avenue shall be controlled with a stop sign on Gage Avenue. A Stop sign shall be erected and maintained on Gage Avenuein accordance with local and state law. All vehicles traveling along Gage Avenue must come to a complete stop before entering the Nederland Avenue intersection. ARTICLE XVI. SECTION 122—PENALTY Any person who intentionally, knowingly, or recklessly violates any provision of this ordinance shall be deemed guilty of a misdemeanor,and shall on conviction thereof be fined as provided in Sec.102-323,Nederland Code of Ordinances. ARTICLE XVII. SECTION 133—EFFECTIVE DATE This amendment to the ordinance shall be in full force and effect after publication as provided by law.
