October 23, 2023 REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF NEDERLAND 4:30 p.m. October 23, 2023 1. MEETING The meeting was called to order at 4:30 p.m. by Mayor Albanese at the Nederland City Office Building, 207 N. 12th Street, Nederland, Texas. See attached for quorum. The following statement was posted: "PURSUANT TO SECTION 30.07, PENAL CODE (TRESPASS BY LICENSE HOLDER WITH AN OPENLY CARRIED HANDGUN), A PERSON LICENSED UNDER SUBCHAPTER H, CHAPTER 411, GOVERNMENT CODE (HANDGUN LICENSING LAW), MAY NOT ENTER THIS PROPERTY WITH A HANDGUN THAT IS CARRIED OPENLY." 2. INVOCATION AND PLEDGE OF ALLEGIANCE The invocation and Pledge of Allegiance was led by Mayor Pro Tem Sonnier. 3. CONSENT AGENDA - All consent agenda items listed are considered to be routine by ✓ the City Council and will be enacted by one motion. There will be no separate discussion of these items unless a councilmember so requests, in which event the item will be removed from the Consent Agenda and considered separately. A motion was made by Councilmember Root and seconded by Councilmember Guillot to approve the Consent Agenda Item "a thru e" as presented. MOTION CARRIED. Tax Assessor Collection Report—September 2023 d. Consider action regarding a request from Nederland Little Dribblers to utilize the Nederland Recreation Center gymnasium for practices and the waiver of associated fees. e. Consider action authorizing the closure of South 20th Street between Avenue A and Avenue B from November 26th through December 31' for Nederland First Baptist Church's Christmas activities. 4. REGULAR AGENDA a. Discussion was held regarding the request for a Specific Use Permit for the property located at 1003 Nederland Avenue for a massage establishment in a property zoned C-3 (highway commercial). Seven Stones Day Spa has requested a Specific Use Permit for the property located at 1003 Nederland Avenue to operate a massage establishment in a property located in a C-3 (highway commercial) zoning district. A massage establishment may only operate in property located in a C-3 zoning with a Specific Use Permit. A Joint Public Hearing was held on October 9th with the only comments received from Minutes continued, October 23, 2023 Police Chief Porter; he addressed his concern with massage establishments re- opening in Nederland. The Planning & Zoning Commission met on October 17th, and they unanimously recommended approval of the request. P&Z and Mr. Wheeler recommend approval of the request. City Manager, Chris Duque, stated that based on Police Chief Porter's concerns, he recommends denial of the request. A motion was made by Mayor Pro Tem Sonnier and seconded by Councilmember Guillot to deny the request for a Specific use Permit for the property located at 1003 Nederland Avenue for a massage establishment in a property zoned C-3 (highway commercial). Mayor Pro Tem Sonnier asked how we could close the gap between C2 and C3 zoning, in order to eliminate confusion in the future. Chris Duque commented that the operations of massage establishments are at the discretion of the Council and a new owner of this business would need to reapply for the Specific Use Permit. George Wheeler, Chief Building Official, stated that our ordinance contains inspection language that would allow the City to shut down any massage business conducting certain criminal acts. Jeff Darby, 1515 N. 26th St., addressed the differences between a massage establishment and a massage parlour. Nathan Walters, owner of Seven Stones Day Spa, stated that he understood that a new owner would need to reapply for the permit and this would be advantageous to Council to have that leverage on whether to allow or not to allow. He also stated that the business would operate between the hours of 10:00 am and 6:00 pm and that his wife is fully licensed as well as her workers. Mayor Pro Tem Sonnier stated that he would like to rescind his motion to deny the request, based on this recent information. Councilmember Guillot rescinded his motion to deny. A motion was made by Councilmember Root and seconded by Mayor Pro Tem Sonnier to approve the request for a Specific Use Permit for the property located at 1003 Nederland Avenue for a massage establishment in a property zoned C-3 (highway commercial). MOTION CARRIED. AYES: Mayor Albanese, Councilmembers Duplant, Root, Sonnier, and Guillot. NOES: None. b. A motion was made by Councilmember Duplant and seconded by Mayor Pro Tern Sonnier to approve the Re-Plat request of 220 6th Street described as Lot 1, Block 9, Johnson Addition and 519 Boston Avenue described as Lot 2, Block 9, Johnson Addition. MOTION CARRIED. AYES: Mayor Albanese, Councilmembers Duplant, Root, Sonnier, and Guillot. NOES: None. c. A motion was made by Councilmember Guillot and seconded by Councilmember Root to amend Ordinance No. 2023-11, cancelling the November 20, 2023 City Council meeting. MOTION CARRIED. AYES: Mayor Albanese, Councilmembers Duplant, Root, Sonnier, and Guillot. NOES: None. d. A motion was made by Councilmember Root and seconded by Councilmember Duplant to approve the Resolution No. 2023-20, ratifying the action of the Nederland Economic Development Corporation Board of Directors related to N&T Construction for the Off-Boston Development construction. MOTION CARRIED. AYES: Mayor Albanese, Councilmembers Duplant, Root, Sonnier, and Guillot. NOES: None. Minutes continued, October 23, 2023 e. A motion was made by Mayor Pro Tern Sonnier and seconded by Councilmember Root to approve the Resolution No. 2023-21, approving the 2023 tax roll as certified by the Jefferson County Appraisal District. MOTION CARRIED. AYES: Mayor Albanese, Councilmembers Duplant, Root, Sonnier, and Guillot. NOES: None. f. A motion was made by Councilmember Guillot and seconded by Councilmember Duplant to receive the Quarterly Investment Report from the Finance Department. MOTION CARRIED. A motion was made by Councilmember Root and seconded by Councilmember Duplant to amend the 2023-2024 Wage &Classification Plan. MOTION CARRIED. Discussion was held regarding the City of Nederland's Coronavirus Local Fiscal Recovery Fund allocation -job training program. Chirs Duque, City Manager, stated that thus far, the City has allocated funds for the Non-Profit Partnership Grant Program; allocated funds to reimburse Adaptive Sports for Kids for the installation of artificial turf at the Babe Ruth Park baseball field; allocated funds for the purchase of an inclusive playground at Doornbos Park; and allocated funds to assist NISD with mental health services for their students. In addition, the City has noted its intent to allocate $2.5M to water and sewer infrastructure projects (replacement of old waterlines and sewerlines and a new clarifier at the WTP). Approximately $1.04M has not been earmarked. Chris Duque recommended authorizing the dedication of funds ($25,000) for a job training program with Lamar Institute of Technology for residents of Nederland to complete the CDL certification program. Following this allocation, a second round of non-profit partnership grant program funding (estimated $200,000) would be worked on with an emphasis on mental health services; a grants administrator would be necessary to complete this work. A motion was made by Councilmember Guillot and seconded by Mayor Pro Tern Sonnier to approve the dedication of funds ($25,000) for a job training program with Lamar Institute of Technology for residents of Nederland to complete the CDL certification program. EXECUTIVE SESSION The regular meeting was recessed at 5:03 p.m. by Mayor Albanese for the purpose of conducting an Executive Session as authorized by Texas Government Code, Consultation with City Attorney - Texas Government Code, Chapter 551.071. 6. RECONVENE The regular meeting was reconvened at 5:13 p.m. by Mayor Albanese. A motion was made by Mayor Pro Tern Sonnier and seconded by Councilmember Root to authorize the City Attorney to proceed with legal action against Candlewood Suites regarding remittance of Hotel Occupancy Tax Funds. MOTION CARRIED. AYES: Mayor Albanese, Councilmembers Duplant, Root, Sonnier, and Guillot. NOES: None. 7. COMMUNICATION City Manager's Report: a. Miscellaneous: • We are still accepting candy for the Trunk-R-Treat event. • The opening for the inclusive playground at Doornbos Park will be Thursday at 5:30 pm. • The incoming Finance Director, Heather Stucker, will begin on November 13th • The bonfire and pots & pans parade will be held tomorrow night. • The Red Ribbon Parade will be held tomorrow morning at 8:00 am. • Mid-County Madness game is this Friday night and Chris Duque wished the Bulldogs the best of luck. 8.
