MINUTES
5:00 p.m. October 24, 2023
1. MEETING
The meeting was held October 24, 2023, at the City of Nederland D. Bob Henson
Office Building, 1903 Atlanta Avenue, Nederland, Texas and was called to order
at 5:00 p.m. by the Chairman.
MEMBERS PRESENT: Emmett Hollier, Kevin Smith, and Paul Hussey
MEMBERS ABSENT: Michael Whitehead and Mike Louvier
CITY STAFF PRESENT: George Wheeler, Chief Building Official and Beth
Merren, Inspections Department Secretary
OTHERS PRESENT: Fez Hussain, Mike Pena, and Waleed Khan
2. APPROVAL OF MINUTES
A motion was made by Paul Hussey and seconded by Kevin Smith to approve the
minutes of the August 15, 2023 meeting. All voted aye.
3. VARIANCES
a. Jingo Cajun Eatery, prospective tenant at 930 Nederland Avenue, described as
Part of Tract A, Nederland Plaza requested a variance to the City of Nederland
Zoning Ordinance, Section 12.2, "Schedule of area regulations" for the
encroachment of ten (10) ft. into the thirty (30) ft. minimum front yard
setback for the construction of an outside patio. After a full discussion, a
motion was made by Paul Hussey and seconded by Kevin Smith to grant the
variance. All voted aye.
b. Waleed Khan, owner of the property located at 145-147 Atlanta Avenue,
described as Lots 1 and 2, Block 11, Staffen Addition, requested a variance to
the City of Nederland Zoning Ordinance, Section 8, "Non -conforming uses #3
a, b, and c" to renovate the existing nonconforming duplex that was
abandoned for over 15 years. After a full discussion, a motion was made by
Emmett Hollier and seconded by Kevin Smith to deny the variance. All voted
aye.

5. ADJOURN
There being no other business a motion was made by Paul Hussey and seconded
by Kevin Smith to adjourn the meeting at 5:28 p.m. All voted aye.
