January 22, 2024 REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF NEDERLAND 4:30 p.m. January 22, 2024 1. MEETING The meeting was called to order at 4:30 p.m. by Mayor Albanese at the Nederland City Office Building, 207 N. 12th Street, Nederland, Texas. See attached for quorum. Councilmember Duplant was able to attend the meeting via Zoom. However, due to technical difficulties, he was unable to vote in accordance with state law. The following statement was posted: "PURSUANT TO SECTION 30.07, PENAL CODE (TRESPASS BY LICENSE HOLDER WITH AN OPENLY CARRIED HANDGUN), A PERSON LICENSED UNDER SUBCHAPTER H, CHAPTER 411, GOVERNMENT CODE (HANDGUN LICENSING LAW), MAY NOT ENTER THIS PROPERTY WITH A HANDGUN THAT IS CARRIED OPENLY." 2. INVOCATION AND PLEDGE OF ALLEGIANCE The invocation and Pledge of Allegiance was led by Mayor Pro Tern Sonnier. 3. CONSENT AGENDA - All consent agenda items listed are considered to be routine by the City Council and will be enacted by one motion. There will be no separate discussion of these items unless a councilmember so requests, in which event the item will be removed from the Consent Agenda and considered separately. A motion was made by Councilmember Guillot and seconded by Councilmember Root to approve the Consent Agenda Item "a thru d" as presented. MOTION CARRIED. A motion was made by Councilmember Root and seconded by Councilmember Guillot to re-appoint Alex Rupp, Jason Butler, and Paul Hussey to the Parks Advisory Board. MOTION CARRIED. A motion was made by Councilmember Root and seconded by Councilmember Guillot to approve a work authorization with Westwood Professional Services, Inc. for an updated "traffic study" of the Helena Avenue and 27th Street intersection. A motion was made by Mayor Pro Tern Sonnier and seconded by Councilmember Guillot to approve Change Order No. 1 - City of Nederland 2023 HMAC Street Program, in the amount of$222,529.30. A motion was made by Mayor Pro Tern Sonnier and seconded by Councilmember Root to approve final payment and release of retainage for the City of Nederland 2023 HMAC Street Program, in the combined amount of $386,189.20. A motion was made by Councilmember Root and seconded by Councilmember Guillot to approve Ordinance No. 2024-02, amending the fiscal year 2023-2024 budget. MOTION CARRIED. A motion was made by Mayor Pro Tern Sonnier and seconded by Councilmember Guillot to award bid for the "Tex Ritter Park Lighting" project to Gulf Coast Electric Company, in the amount of $57,900 with 120 calendar days for completion. COMMUNICATION City Manager's Report: • Nederland Municipal Government Academy update - Chris Duque stated that this Municipal Government Academy was created in an attempt to engage the community. Town Hall meetings were held in the past years with low turnout. This academy was scheduled to start next week but only two eligible applications were received. This program has been postponed until possibly in the summer. • Nederland Heritage Festival's Mixer will be held tomorrow night. • Cheryl Dowden's retirement reception will be Thursday, Jan. 25th at 4:00 at City Hall. • Chris Duque thanked the Water Plant and the Public Works crews for their hard work during last week's weather event. 6.
