MINUTES
5:00 p.m. March 19, 2024
1. MEETING
The meeting was held March 19, 2024, at the City of Nederland D. Bob Henson
Office Building, 1903 Atlanta Avenue, Nederland, Texas and was called to order
at 5:00 p.m. by the Chairman.

2. APPROVAL OF MINUTES
A motion was made by Kevin Smith and seconded by Michael Whitehead to
approve the minutes of the December 5, 2023 meeting. All voted aye.
3. VARIANCES
a. Julio Ceasar Cabrera, owner of 1136 Kent Avenue, described as Lot 3, Block
1 of Humphrey Heights 1 Addition, requested a variance to Section 18
"Fencing and Screen" of the City of Nederland Zoning Ordinance.
The owner of 1140 Kent Debra Frantz was represented by attorney Brandon
Monk. Mr. Monk voiced their disapproval of the variance request and added
that the applicant still has not complied with the variance issued at the
December 5, 2023 meeting. Mr. Monk claimed that the carport is still over the
side property line. The applicant denied the claim by Mr. Monk. After a full
discussion, a motion was made by Kevin Smith and seconded by Michael
Whitehead to deny the applicant's request for a variance to Section 18
"Fencing and Screening" and recommended the Building Official meet with
the property owners of 1136 and 1140 Kent to measure the current distance
from the carport to the property line for verification of whether the variance
issued on December 5, 2023, is in compliance or not in compliance. All voted
aye.

b. Glin LeBaron, representative of the property located at 1336 and 1344 Boston
Avenue, described as East 34' of the West 100' of the South 1/2 of Block 13,
Nederland Addition, requested a variance to Section 12.2 "Schedule of
residential height and area regulations" of the City of Nederland Zoning
Ordinance for one duplex to be constructed on each lot with each lot not
meeting the minimum width requirement. After a full discussion, a motion
was made by Kevin Smith and seconded by Michael Whitehead to approve
the variance. All voted aye.
4. COMMUNICATIONS
None
5. ADJOURN
There being no other business a motion was made by Kevin Smith and seconded
by Michael Whitehead to adjourn the meeting at 5:45 p.m. All voted aye.
