August 28, 2017 REGULAR MEETING OF THE CITY COUNCIL OF TME CITY OF NEUDE RLANE" 4:30 p.m_ August 28, 2017 1. MEETING The meeting was called to order at 4:30 p.m. by Mayor Nugent at the Nederland City Office Building, 207 N. 12"' Street, Nederland, Texas. See attached for quorum. OPENLY_" 2. INVOCATION ANE" PLEE"GE OF ALLEGIANCE The invocation and pledge of allegiance were led by Chris Duque, City Manager. 3. CONSENT AGENE"A - All consent agenda items listed are considered to be routine by the City Council and will be enacted by one motion. There will be no separate discussion of these items unless a councilmember so requests, in which event the item will be removed from the Consent Agenda and considered separately. A motion was made by Mayor Pro Tem Albanese and seconded by Councilmember Austin to approve the Consent Agenda Items a-d as presented. MOTION CARRIED.. Tax Assessor Collection Report - July 2017 d. Consider action regarding a request from Brian English to utilize the Nederland Recreation Center gymnasium for a basketball league and tournament. 4_ REGULAR AGENE"A a_ A motion was made by Councilmember Austin and seconded by Councilmember Neal to postpone action, until September 11, 2017, regarding a proclamation recognizing the Mid-County Senior Babe Ruth team. MOTION CARRIED.. Ayes: Mayor Nugent, Councilmembers Austin, Neal, Albanese, and Belaire. Noes: None. Minutes Continued, August 28, 2017 b. A motion was made by Councilmember Neal and seconded by Mayor Pro Tern Albanese to authorize the submittal of a 2017 grant application to the Wilton and Effie Mae Hebert Foundation. MOTION CARRIED. Ayes: Mayor Nugent, Councilmembers Austin, Neal, Albanese, and Belaire. Noes: None. c. Will Larrain, Action Civil Engineers, gave an update on the Nederland Avenue Drainage project. He advised authorization from City Council will be considered at a meeting in September, award will be considered in November, and notice to proceeds will be given to the contractor around Thanksgiving with work beginning in December. Work will be minimized around Boston Avenue during the Christmas holiday and work should be completed in January or February. Mark Mann, Schaumburg & Polk, Inc., reported on the Nederland Avenue Paving project. They plan to keep 2 lanes of traffic open at all times during construction. There will be some night work at the traffic signal intersections. Authorization to bid will be on council agenda in January, construction award will be considered in February. Contractor will be ready to mobilize and begin work after Heritage Festival and be completed in June or July. No action was necessary. d. A motion was made by Councilmember Austin and seconded by Councilmember Neal to approve a work authorization with Schaumburg & Polk, Inc., in a proposed amount of $21,500.00, to prepare permits with Kansas City Southern and the Texas Department of Transportation in regards to the planned sewer main line replacement/improvements project. MOTION CARRIED. Ayes: Mayor Nugent, Councilmember Austin, Neal, Albanese, and Belaire. Noes: None. e. A motion was made by Mayor Pro Tem Albanese and seconded by Councilmember Austin to authorize the issuance of a request for proposals for the City's bank depository services. MOTION CARRIED. Ayes: Mayor Nugent, Councilmembers Austin, Neal, Albanese, and Belaire. Noes: None. f. A motion was made by Councilmember Neal and seconded by Mayor Pro Tem Albanese to approve Ordinance No. 2017-15, amending Chapter 22 - Businesses of the Nederland Code of Ordinances providing the regulation of gaming room and gaming machines, commonly known as "eight-liners." MOTION CARRIED. Ayes: Mayor Nugent, Councilmembers Austin, Neal, Albanese, and Belaire. Noes: None. g. A motion was made by Mayor Pro Tern Albanese and seconded by Councilmember Belaire to set a public hearing, on September 11, 2017, 4:30 p.m. at Nederland City Hall, to receive comments regarding amending Appendix A - Zoning of the Nederland Code of Ordinances, providing for the zoning regulations of gaming rooms. MOTION CARRIED. Ayes: Mayor Nugent, Councilmembers Austin, Neal, Albanese, and Belaire. Noes: None. Minutes Continued, August 28, 2017 h. Fiscal Year 2017-2018 Budget: i. A motion was made by Councilmember Belaire and seconded by Mayor Pro Tern Albanese to approve Resolution No. 2017-2018, utility rates and regulations. MOTION CARRIED. Ayes: Mayor Nugent, Councilmembers Neal, Albanese, and Belaire. Noes: Councilmember Austin. ii. The regular meeting was recessed and a Public Hearing was called to order at 5:16 p.m. by Mayor Nugent for the purpose of receiving comments regarding the proposed City of Nederland Fiscal Year 2017-2018 Annual Budget. Chris Duque, City Manager, said it is necessary to conduct a public hearing on the proposed Fiscal Year 2017-2018 Annual Budget. As with any public hearing, interested persons will be given the opportunity to comment on the budget. A copy of the budget is available at the City Clerk's office and on the City's website. The ordinance adopting the FY 2017-2018 Annual Budget shall be placed on the September 11. 2017 at 4:30 p.m. agenda for consideration. No action was necessary. There being no further questions and/or comments the Public Hearing was adjourned and the regular meeting was reconvened at 5:17 p.m. by Mayor Nugent. iii. The regular meeting was recessed and a Public Hearing was called to order at 5:17 p.m. by Mayor Nugent for the purpose of receiving comments regarding the proposed tax rate of $0.609578 per $100 assessed valuation for the Fiscal Year 2017-2018. Mr. Duque stated the public hearing is being held to discuss the proposed Fiscal Year 2017-2018 tax rate. All interested persons are given the opportunity to commend on the proposed tax rate. At the August 14, 2017 meeting, the Council unanimously voted to adjust the tax rate to $0.609578 per $100 assessed valuation for the fiscal year beginning October 1, 2017 and ending September 30, 2018. Due to the certificates of obligation issued for the Nederland Avenue project, it was necessary to adjust the interest and sinking fund portion of the tax rate, resulting in the tax rate increase. There being no further questions and/or comments the Public Hearing was adjourned and the regular meeting was convened at 5:18 p.m. by Mayor Nugent. 5. EXECUTIVE SESSION The regular meeting was recessed at 5:18 p.m. by Mayor Nugent for the purpose of conducting an Executive Session as authorized by Texas Government Code, Chapter 551.074, Annual Evaluation - City Manager, Christopher Duque. 6. RECONVENE The regular meeting was reconvened at 6:13 p.m. by Mayor Nugent. Minutes Continued, August 28, 2017 7. APPOINTMENT A motion was made by Mayor Pro Tern Albanese and seconded by Councilmember Neal to approve an employment agreement between the City of Nederland and Nederland City Manager, Christopher Duque. MOTION CARRIED. Ayes: Mayor Nugent, Councilmembers Austin, Neal, Albanese, and Belaire. Noes: None. 8. COMMUNICATION City Manager's Report: a. Special City Council meeting - Friday, September 1, 2017 at 9:00 a.m. b. City offices closed on September 4, 2017 in observance of Labor Day holiday c. Miscellaneous: • Chamber Coffee September 12, 2017 at 8:00 a.m. at Nederland City Hall • Chris thanked employees and inmate crews for the hard work during Hurricane Harvey 9.
