MEETING The meeting was called to order at 4:30 p.m. by Mayor Nugent at the Nederland City Office Building, 207 N. 12." Street, Nederland, Texas. See attached for quorum. The following statement was posted: "PIJRSUANT TO SECTION 30_07, PENAL CODE (TRESPASS BY LICENSE HOLDER WITH AN OPENLY CARRIED HANDGIJN), A PERSON LICENSED UNDER SUBCHAPTER H, CHAPTER 411, GOVERNMENT CODE (HANDGUN LICENSING LAWS, MAY NOT ENTER THIS PROPERTY WITH A HANDGUN THAT IS CARRIED OPENLY." 2_ INVOCATION ANO PLEDGE OF ALLEGIANCE The invocation and pledge of allegiance were led by Gay Ferguson, City Clerk_ 3_ CONSENT AGENDA - All consent agenda items listed are considered to be routine by the City Council and will be enacted by one motion. There will be no separate discussion of these items unless a councilmember so requests, in which event the item will be removed from the Consent Agenda and considered separately. A motion was made by Councilmember Austin and seconded by Mayor Pro Tem Albanese to approve the Consent Agenda Items a-c as presented. MOTION CARRIED. REGULAR AGENDA a. A motion was made by Councilmember Neal and seconded by Mayor Pro Tern Albanese to approve an amendment to the Debris Removal Service Agreement with DRC Emergency Services, LLC to establish e-waste prices. A motion was made by Councilmember Austin and seconded by Councilmember Neal to approve Wells Fargo Bank as the City's bank depository services provider. MOTION CARRIED. A motion was made by Councilmember Neal and seconded by Mayor Pro Tern Albanese to approve a second amendment to the interlocal agreement between the City of Nederland, Nederland Economic Development Corporation, and Jefferson County regarding the funding of infrastructure improvements at the Jack Brooks Airport. MOTION CARRIED. Ayes: Mayor Nugent, Councilmembers Austin, Neal, Albanese, and Belaire. Noes: None. d. A motion was made by Councilmember Austin and seconded by Mayor Pro Tern Albanese to approve Resolution No 2017-14 authorizing the city manager, when a firefighter is on extended unpaid leave or any other necessary circumstance, to overhire entry-level civil service fire positions. MOTION CARRIED. Ayes: Mayor Nugent, Councilmembers Austin, Neal, Albanese, and Belaire. Noes: None. e. Chris Duque, City Manager, reported the 2017-2018 Streets Program is budgeted at $1.7M; $1,425,000.00 in the Street Improvement Fund, and $275,000.00 in the Street Department General Fund. The proposed Streets Program is divided into 3 main components: BOMAG/Chip Seal projects, Concrete Repairs, and Hot Mix Overlays/Resurfacing. BOMAG/CHIP Seal The Street Division developed a list of streets that would be BOMAG'ed by the Streets Department and then chip sealed with the County's assistance. The City and County staff will coordinate work to minimize inconvenience to residents along these streets. Last year, Jefferson County requested oil and rock to contribute toward road work; this year, $20,000 is allocated assuming the same request will be made by the County. Nuge t, 4(1•r G:yFerguln " i Cer/ November 13, 2017 Date RESOLUTION NO. 2017-14 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEDERLAND, TEXAS, AUTHORIZING THE CITY MANAGER, WHEN A FIREFIGHTER IS ON EXTENDED UNPAID LEAVE OR ANOTHER NECESSARY CIRCUMSTANCE, TO OVERHIRE ENTRY-LEVEL CIVIL SERVICE FIRE POSITIONS WHEREAS, the City Council of the City of Nederland has prescribed by Ordinance No. 2017-19,an appropriations ordinance adopting the fiscal year 2017-2018 budget,the number of positions in each classification in the Nederland Fire Department in accordance with Chapter 143 of the Texas Local Government Code;and WHEREAS,to promote public safety by efficiently staffing fire personnel,it is occasionally necessary to hire one or more entry-level candidates when a member of the Fire Department is serving on an extended military deployment or is otherwise on extended unpaid leave;and WHEREAS, to promote public safety, it is necessary to adequately staff the Fire Department. NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF NEDERLAND, TEXAS,THAT: Section 1. The City Manager is authorized to,when the need arises,overhire entry-level positions in the Fire Department when there is sufficient budgetary funds and a temporary absence of entry-level civil service fire personnel as a result of military leave or other unpaid leave. Section 2. The meeting at which this resolution was approved was in all things conducted in strict compliance with the Open Meetings Act,Texas Government Code,Chapter 551. Section 3. This resolution shall become effective from and after its passage.
