January 22, 2018 REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF NEOERLAND 4:30 p_m_ January 22, 2018 1_ MEETING The meeting was called to order at 4:30 p.m. by Mayor Nugent at the Nederland City Office Building, 207 N. 12« Street, Nederland, Texas. See attached for quorum. The following statement was posted: ""PURSUANT TO SECTION 30_07, PENAL CODE (TRESPASS BY LICENSE HOLDER WITH AN OPENLY CARRIED HANUGUN), A PERSON LICENSED UNDER SUBCHAPTER H, CHAPTER 411, GOVERNMENT CODE (HANDGUN LICENSING LAW), MAY NOT ENTER THIS PROPERTY WITH A HANDGUN THAT IS CARRIED OPENLY_" 2. INVOCATION AND PLEDGE OF ALLEGIANCE The invocation and pledge of allegiance were led by Gay Ferguson, City Clerk. 3. CONSENT ^GENOA - All consent agenda items listed are considered to be routine by the City Council and will be enacted by one motion. There will be no separate discussion of these items unless a councilmember so requests, in which event the item will be removed from the Consent Agenda and considered separately. A motion was made by Councilmember Neal and seconded by Mayor Pro Tem Albanese to approve the Consent Agenda Items a-d as presented. Requests: • Consider action authorizing the Jefferson County Mosquito Control District to fly at low altitudes as required for the application of pesticides for the control of mosquitoes within the city limits of Nederland. • Consider action approving a request from the Nederland Rotary Club to utilize Doornbos Park for the annual Hooked on Fishing, Not on Drugs (HOFNOD) event. • Consider action authorizing the closure of various City streets for the Nederland Heritage Festival activities. A motion was made by Councilmember Austin and seconded by Councilmember Neal to accept a donation, in the amount of $20,869.61, from the Nederland Heritage Festival to the Nederland Police, Fire, Parks & Recreation, and Animal Control departments. MOTION CARRIED. Ayes: Mayor Nugent, Councilmembers Austin, Neal, Albanese, and Belaire. Noes: None. b. A motion was made by Mayor Pro Tern Albanese and seconded by Councilmember Austin to authorize the purchase of 1000 tons of PB Gr 4 modified rock for the 2018 Street Program. MOTION CARRIED. Ayes: Mayor Nugent, Councilmembers Austin, Neal, Albanese, and Belaire. Noes: None. c. A motion was made by Councilmember Austin and seconded by Councilmember Neal to set a date of February 26, 2018 for a Joint Public Hearing for the purpose of receiving comments regarding the request for a Specific Use Permit for property located at 3503 Nederland Avenue described as Lot 25 1/2 & Lot 26, Block 9 of Airport #1 Addition to open a liquor store in a C-2 (neighborhood retail) Zoning District. MOTION CARRIED. Ayes: Mayor Nugent, Councilmembers Austin, Neal, Albanese, and Belaire. Noes: None. d. A motion was made by Councilmember Austin and seconded by Mayor Pro Tem Albanese to set a date of February 26, 2018 for a Joint Public Hearing for the purpose of receiving comments regarding the request to re-zone property located at 111 South 15th Street, described as Lot 3 of J Carabin Addition from property zoned R-1 (single-family residential) to R-2 (duplex residential) for the construction of a duplex. MOTION CARRIED. Ayes: Mayor Nugent, Councilmember Austin, Neal, Albanese, and Belaire. Noes: None. e. A motion was made by Mayor Pro Tern Albanese and seconded by Councilmember Austin to re-appoint Alex Rupp and Sylvia Root and appoint Jason Butler to the Parks Advisory Board. MOTION CARRIED. Ayes: Mayor Nugent, Councilmember Austin, Neal, Albanese, and Belaire. Noes: None. f. Chris Duque, City Manager, reported funds were included in this year's budget to complete repairs to the electrical loop at Doornbos Park. The City engaged Neches Engineers to assess the existing electrical loop and lighting. They have submitted various options to complete the repairs. After conferring with the engineer and the Parks Directors, Mr. Duque recommended an option which would require a multi- phase approach due to the budgetary constraints. The first phase would be done in this year's budget and the second phase would be done in the FY 2019-2020 budget. No action was necessary. g. A motion was made by Councilmember Austin and seconded by Councilmember Neal to authorize the solicitation of bids for the Nederland Avenue Paving, Drainage, and Utility Improvements project. EXECUTIVE SESSION The regular meeting was recessed at 5:06 p.m. by Mayor Nugent for the purpose of conducting an Executive Session as authorized by Texas Government Code, Chapter 551.071, Consultation with City Attorney; and Chapter 551.074, Personnel - City Manager. 6. RECONVENE The regular meeting was reconvened at 5:39 by Mayor Nugent. He announced the Executive Session was held for informational purposes only and no action is necessary. 7. COMMUNICATION City Manager's Report: a. Miscellaneous: • Spay and Neuter Program has been updated and will kick off next month • Heritage Festival Mix will be tomorrow at 5:00 at the Heritage Festival Pavilion • Chamber Coffee will be Feb. 13th at the Heritage Festival Pavilion 6. ADJOURN There being no further business a motion was made by Mayor Nugent and seconded by Councilmember Neal to adjourn the meeting at 5:42 p.m. MOTION CARRIED.
