October 22, 2018 REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OP NEDERLANC. 4:30 P_m_ October 22, 2018 1_ MEETING The meeting was called to order at 4:30 p.m. by Mayor Nugent at the Nederland City Office Building, 207 N. 12« Street, Nederland, Texas. See attached for quorum. Tax Assessor Collection Report September 2018 d_ Consider action setting a Joint Public Hearing on Monday, November 12, 2018 at 4:30 p.m. for the purpose of receiving comments regarding the request for a Specific Use Permit for the property located at 3205 Nederland Avenue to construct a vehicle oil and lube shop. Minutes Continued, October 22, 2018 4. REGULAR AGENDA a. Britt Roscoe, Baubles and Bliss, spoke in favor of the 2nd Annual Block Party but requested the time for street closure to be closer to closing time for businesses which are within the area. He felt closing the streets while businesses were still open would affect their sales. He also questioned the logistics of closing the streets while shopper's vehicles were still parked. A motion was made by Mayor Pro Tern Albanese and seconded by Councilmember Neal to approve request for a street closure of Boston Avenue between 13th Street and Twin City Highway on Saturday, November 10, 2018 from the hours of 5:00 p.m. to 9:00 p.m. for the Merchants of Boston Avenue 2nd Annual Block Party. MOTION CARRIED. Ayes: Mayor Nugent, Councilmember Neal, and Albanese. Noes: None. Absent: Councilmembers Austin, and Belaire. b. Chris Duque, City Manager, reported the details of Harvey expenses and the received/planned reimbursements. The three categories of projects (debris removal, emergency protective measures, and damaged equipment), the City's expenses totaled $648,223.82. For the three categories, the federal share totals $595,117.12 and the local share is $53,106.70 of which $50,861.65 is reimbursed by the state. The remaining local share was paid via the General Fund to reflect the expenses for Police, Fire, and Streets. The overwhelming majority of Harvey expenses are debris removal ($508,616.54), which includes the payments to DRC, Tetra Tech, and Republic landfill, force labor expenses, and use of city equipment. The debris removal work includes the removal of 19,52702 cubic yards of construction and demolition debris, 1.7 tons of hazardous household waste, 339 units of e-waste (televisions, computers, printers, etc.), and 115 units of white goods (refrigerators, stoves, washing machines, etc.). The federal share of this category (90%) equals $457,754.89; the City has been advised the paperwork was approved, and reimbursement is pending. The local share (10%) equals $50,861.65; previously Governor Abbott pledged state funds to cover local entities' local share of debris expenses. The City has already received half of the state funds. Emergency measures ($117,156.76) includes expenses related to sandbagging operations, emergency search and rescue operations, emergency barricading operations, and security and safety patrols. This category is reimbursed at 100% and reimbursement is pending. Damaged equipment ($22,450.52) includes cleaning gear, repairing vehicles, and replacing boots, belts, holsters, body armor, and barricades. This category is reimbursed at 90% ($20,205.47) with a 10% local match ($2,245.05). No action is necessary. c. A motion was made by Councilmember Neal and seconded by Mayor Pro Tern Albanese to authorize the purchase of a Ford F-150 via HGAC, BuyBoard, or other state-approved contract for the Inspection Department. A motion was made by Mayor Pro Tern Albanese and seconded by Councilmember Neal to approve Ordinance No. 2018-32, amending the fiscal year 2018-2019 budget. MOTION CARRIED. Ayes: Mayor Nugent, Councilmember Neal, and Albanese. Noes: None. Absent: Councilmembers Austin, and Belaire. e. A motion was made by Councilmember Neal and seconded by Mayor Pro Tern Albanese to approve Resolution No. 2018-15, approving the 2018 tax roll as certified by the Jefferson County Appraisal District. MOTION CARRIED. Ayes: Mayor Nugent, Councilmember Neal, and Albanese. Noes: None. Absent: Councilmember Austin, and Belaire. f. A motion was made by Mayor Pro Tern Albanese and seconded by Councilmember Neal to approve an engineering and consulting services agreement with Schaumburg & Polk, Inc. for the Main Sewer Line Rehabilitation project. MOTION CARRIED. Ayes: Mayor Nugent, Councilmember Neal, and Albanese. Noes: None. Absent: Councilmember Austin, and Belaire. g. Chris Duque reported, Bobby Nguyen approached the City to request water service at his property along Patillo Road. The property would be developed into a RV park with approximately 69 lots. The property is located outside the City limits, inside the City's extraterritorial jurisdiction, and is between the City of Beaumont's and the City of Nederland's CNN. The City currently provides water service to several property owners along Patillo Road, including a home and church via a 6-inch waterline. The developer's engineer performed water supply testing and confirms the existing 6-inch water is sufficient to supply Mr. Nguyen's development. Mr. Duque recommended the following conditions if the Council were inclined to approve Mr. Nguyen's request: • Permit Approval from Jefferson County for the sewer system • Approval from DD7 regarding drainage • Contract between the development and the City of Nederland for fire protection A motion was made by Councilmember Neal and seconded by Mayor Pro Tern Albanese to approve a request by Bobby Nguyen to provide water service to a RV Park development located on Patillo Road in the City of Nederland's ETJ with the conditions set forth by the City Manager. MOTION CARRIED. Ayes: Mayor Nugent, Councilmember Neal, and Albanese. Noes: None. Absent: Councilmember Austin, and Belaire. 5. COMMUNICATION City Manager's Report: a. Rob Woods and Rick Bourque gave a brief update on the Nederland Avenue project - work is continuing with repairs from 23rd to Hwy 69. Most of the asphalt work has been completed from Twin City to 23rd Street. Minutes Continued, October 22, 2018 12th Street Drainage project is beginning to cross Boston Avenue with boring under the street. b. Early Voting begins on Monday, October 26th at the Library. Election Day voting will be at the Library and City Hall on November 6th c. Trunk R Treat will be Wednesday, Oct. 31St d. Veterans' Day ceremonies will be next month on Nov. 9th and 11th e. Council meeting will be Nov. 12th and Nov. 19th next month f. Red Ribbon parade will be in the morning g. Letter from GLO was received with allocations for Harvey Disaster Recovery 6. ORDINANCE NO. 2018-32 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF NEDERLAND,TEXAS AMENDING THE FISCAL YEAR 2018- 2019 BUDGET IN ACCORDANCE WITH THE BUDGET AND THE CHARTER OF THE CITY OF NEDERLAND.
