December 17, 2018 REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF NIEDERLAND 4:30 P.m. December 17, 2018 1_ MEETING The meeting was called to order at 4:30 p_m_ by Mayor Nugent at the Nederland City Office Building, 207 N. 12th Street, Nederland, Texas. See attached for quorum. The following statement was posted: "PURSUANT TO SECTION 30_07, PENAL CODE (TRESPASS BY LICENSE HOLDER WITH AN OPENLY CARRIED HANDGUN), A PERSON LICENSED UNDER SUBCHAPTER H, CHAPTER 411, GOVERNMENT CODE (HANUGUN LICENSING LAW), MAY NOT ENTER THIS PROPERTY WITH A HANDGUN THAT IS CARRIED OPENLY." 2. INVOCATION AND PLEDGE OF ALLEGIANCE The invocation and pledge of allegiance were led by Chris Ouque, City Manager. 3_ CONSENT AGENDA - All consent agenda items listed are considered to be routine by the City Council and will be enacted by one motion. There will be no separate discussion of these items unless a councilmember so requests, in which event the item will be removed from the Consent Agenda and considered separately. A motion was made by Councilmember Neal and seconded by Mayor Pro Tem Albanese to approve the Consent Agenda Items a-e as presented. November 2018 C>epartmental Reports c. Tax Assessor Collection Report - November 2018 d. Consider action approving a request from the Nederland Rotary Club to utilize C000rnbos Park for the annual Hooked on Fishing, Not on C>rugs (HOFNOID) event. e_ Consider action setting a Joint Public Hearing on Monday, January 14, 2019 at 4:30 p.m. for the purpose of receiving comments regarding the request to re-zone property located at 1420 Avenue L, described as Lots 7 8� 8, Block 25 of Wagner Addition from 12-2 (duplex residential) zoning to C-1 (office commercial) zoning. A motion was made by Mayor Pro Tern Albanese and seconded by Councilmember Austin to approve a proclamation regarding the Nederland Bulldogs for the 2018 season. MOTION CARRIED. Ayes: Mayor Nugent, Councilmembers Austin, Neal, Albanese, and Belaire. Noes: None. Couch Barrow thanked the council for their support and introduced 4 of the senior leaders of the team: #7 Armani Douglas, #9 Hunter Sonnier, #11 Blaysin Fernandez, and #15 Landon Hiltz. b. A motion was made by Councilmember Austin and seconded by Mayor Pro Tern Albanese to accept the Quarterly Investment Report from the Finance Department. MOTION CARRIED. Ayes: Mayor Nugent, Councilmembers Austin Neal, and Albanese. Noes: None. Note: Councilmember Belaire stepped out for a phone call before the vote was taken. c. A motion was made by Councilmember Austin and seconded by Councilmember Neal to approve an amendment to Schaumburg & Polk, Inc.'s consulting services agreement for the Nederland Avenue Paving, Drainage, and Utilities project. MOTION CARRIED. Ayes: Mayor Nugent, Councilmember Neal, Albanese, and Belaire. Noes: None. d. A motion was made by Mayor Pro Tern Albanese and seconded by Councilmember Neal to authorize the purchase of a tandem-axle dump truck for the Wastewater Treatment division of the Public Works Department. MOTION CARRIED. Ayes: Mayor Nugent, Councilmember Austin, Neal, Albanese, and Belaire. Noes: None. e. Rob Woods, Director of Public Works and Rick Bourque, Schaumburg & Polk, Inc. reported the paving on Nederland Avenue has been completed and temporary markings have been put down. Driveway tie-ins are underway and permanent markings need to be done. Work has been completed along 12th Street with the exception of the fog-seal which has been delayed due to weather. Mr. Duque recommended taking the fog-seal out of the contract and including it in the 2019 Street program so the Nederland Avenue project can be closed out. f. A motion was made by Councilmember Neal and seconded by Mayor Pro Tern Albanese to approve a Neighborhood Empowerment Zone application for Hargrove Engineers and Constructors. MOTION CARRIED. Ayes: Mayor Nugent, Councilmember Austin, Neal, Albanese, and Belaire. Noes: None. 5. COMMUNICATION City Manager's Report: a. Christmas holiday closure: Monday, December 24th and Tuesday December 25th Minutes Continued, December 17, 2018 b. New Year's Day holiday closure: Tuesday, January 1st c. Miscellaneous - • The HMGP Library grant did not meet the cost benefit analysis in order to proceed. • The Langham Singers will be at the Homer Nagel Public Safety Facility next Wednesday at 10:30 a.m. and story-time with Santa will be at the Library at 10:30 a.m. 6. ADJOURN There being no further business a motion was made by Mayor Nugent and seconded by Councilmember Neal to adjourn the meeting at 4:57 p.m. MOTION CARRIED.
