February 11, 2019 REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF NEDERLAND 4:30 P_rrm. February 11, 2015 1. MEETING The meeting was called to order at 4:30 p.m. by Mayor Nugent at the Nederland City Office Building, 207 N. 12« Street, Nederland, Texas. See attached for quorum. The following statement was posted: "PIJRSUANT TO SECTION 30_07, PENAL CODE (TRESPASS BY LICENSE HOLDER WITH AN OPENLY CARRIED INANDGUN), A PERSON LICENSED UNDER SUBCHAPTER H, CHAPTER 411, GOVERNMENT CODE CHANDGUN LICENSING LAWS, MAY NOT ENTER THIS PROPERTY WITH A HANDGUN THAT IS CARRIED OPENLY." 2. INVOCATION AND PLEDGE OF ALLEGIANCE The invocation and pledge of allegiance were led by Gay Ferguson, City Clerk_ 3. CONSENT AGENDA - All consent agenda items listed are considered to be routine by the City Council and will be enacted by one motion. There will be no separate discussion of these items unless a councilmember so requests, in which event the item will be removed from the Consent Agenda and considered separately. A motion was made by Councilmember Austin and seconded by Councilmember Belaire to approve the Consent Agenda Items a-d as presented. MOTION CARRIED. Ayes: Mayor Pro Tem Neal, Councilmembers Austin, and Belaire. Noes: None. Absent: Mayor Nugent. an. Minutes - January 28, 2019 regular meeting b. December 2018 Departmental Reports G. Consider action regarding a request from First Baptist Church to utilize Ooornbos Park for their annual Easter Fest. d_ Consider action authorizing the closure of various city streets for the Spindletop Rod 8, Classic Car Show. 4_ REGULAR AGENDA a. A motion was made by Councilmember Austin and seconded by Councilmember Belaire to reimburse Don Solis for overcharge on his utility bill_ MOTION CARRIED. Ayes: Mayor Pro Tem Neal, Councilmembers Austin, and Belaire_ Noes: None. Absent: Mayor Nugent. Minutes Continued, February 11, 2019 b. A motion was made by Councilmember Neal and seconded by Councilmember Belaire to accept the Hotel Occupancy Tax Fund financial report from the Nederland Historical Society. MOTION CARRIED. Ayes: Mayor Pro Tem Neal, Councilmembers Austin, and Belaire. Noes: None. Absent: Mayor Nugent. c. A motion was made by Councilmember Belaire and seconded by Councilmember Austin to authorize the acceptance of the 2019 Wilton and Effie Mae Hebert Foundation grant. MOTION CARRIED. Ayes: Mayor Pro Tern Neal, Councilmembers Austin, and Belaire. Noes: None. Absent: Mayor Nugent. d. A motion was made by Councilmember Austin and seconded by Councilmember Belaire to approve an engineering services agreement with Tolunay-Wong Engineers, Inc. for the Main Sewer Line Rehabilitation project. MOTION CARRIED. Ayes: Mayor Pro Tern Neal, Councilmembers Austin, and Belaire. Noes: None. Absent: Mayor Nugent. e. A motion was made by Councilmember Austin and seconded by Councilmember Belaire to receive the Racial Profiling Report from the Nederland Police Department in accordance with Article 2.132(b)(7) of the Texas Code of Criminal Procedures. MOTION CARRIED. Ayes: Mayor Pro Tern Neal, Councilmembers Austin, and Belaire. Noes: None. Absent: Mayor Nugent. 5. EXECUTIVE SESSION The regular meeting was recessed at 4:47 p.m. by Mayor Nugent for the purpose of conducting an Executive Session as authorized by Texas Government Code, Chapter 551.071, Consultation with City Attorney; and Chapter 551.074, Discuss Personnel - . Fire Chief. 6. RECONVENE The regular meeting was reconvened at 5:03 p.m. by Mayor Pro Tern Neal. 7. APPROVAL A motion was made by Councilmember Austin and seconded by Councilmember Belaire to approve the appointment of Terry Morton as Fire Chief. MOTION CARRIED. Ayes: Mayor Pro Tern Neal, Councilmembers Austin, and Belaire. Noes: None. Absent: Mayor Nugent. I Minutes Continued, February 11, 2019 8. COMMUNICATION City Manager's Report: a. 2019 Street Program Update: Approximately 1600 feet of 33rd Street between Helena Avenue and Nederland Avenue will be added to the list for this year's concrete street program. 31st Street from 30th Street to Seattle will be added to this year's BOMAG street project. Staff is pricing for the city to retain the millings for donation to baseball, softball, and soccer fields. b. Hooked on Fishing, Not on Drugs - February 23rd c. Miscellaneous - City staff participated in the Rotary Career Day on Feb. 6th 9. ADJOURN There being no further business a motion was made by Councilmember Belaire and seconded by Councilmember Austin to adjourn the meeting at 5:13 p.m. MOTION CARRIED.
