October 28, 2019 REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF NEDERLAND 4:30 p.m. October 25, 2019 1. MEETING The meeting was called to order at 4=30 p.m. by Mayor Albanese at the Nederland City Office Building, 207 N. Street, Nederland, Texas. See attached for quorum. Jason Burden, First Baptist Church. 3_ CONSENT AGENDA - All consent agenda items listed are considered to be routine by the City Council and will be enacted by one motion. There will be no separate discussion of these items unless a councilmember so requests, in which event the item will be removed from the Consent Agenda and considered separately. A motion was made by Councilmember Austin and seconded by Councilmember Root to approve the Consent Agenda Items a-c as presented. MOTION CARRIED. Tax Assessor Collection Report - September 2019 4. REGULAR AGENDA a. Mayor Albanese thanked the Texas Baptist Men for coming to Nederland and assisting the citizens who are in need. He said it was an honor to have them in our city. A motion was made by Councilmember Hollier and seconded by Councilmember Root to approve a proclamation recognizing the Texas Baptist Men. MOTION CARRIED_ Ayes: Mayor Albanese, Councilmembers Austin, Neal, Hollier, and Root. Noes: None. Minutes Continued, October 28, 2019 b. A motion was made by Mayor Pro Tern Neal and seconded by Councilmember Hollier to set a public hearing, for November 11th at 4:30 p.m., for the purpose of considering and taking action including approval of an agreement with the law firm of Linebarger, Goggan, Blair &Sampson, LLP as special counsel to perform all legal services necessary to collect unpaid fines, fees, and court costs as provided in Texas Code of Criminal Procedure Article 103.0031 and authorizing the execution of such agreement. MOTION CARRIED. Ayes: Mayor Albanese, Councilmembers Austin, Neal, Hollier, and Root. Noes: None. c. A motion was made by Councilmember Austin and seconded by Mayor Pro Tern Neal to amend the Friends Helping Friends Standard Operating Procedure. MOTION CARRIED. Ayes: Mayor Albanese, Councilmembers Austin, Neal, Hollier, and Root. Noes: None. d. A motion was made by Mayor Pro Tern Neal and seconded by Councilmember Hollier to approve Resolution No. 2019-15, approving the 2019 tax roll as certified by the Jefferson County Appraisal District. MOTION CARRIED. Ayes: Mayor Albanese, Councilmembers Austin, Neal, Hollier, and Root. Noes: None. e. A motion was made by Councilmember Austin and seconded by Councilmember Root to authorize the purchase of a garbage truck via state-approved contract for the Public Works Department. MOTION CARRIED. Ayes: Mayor Albanese, Councilmembers Austin, Neal, Hollier, and Root. Noes: None. f. A motion was made by Councilmember Hollier and seconded by Mayor Pro Tern Neal to authorize the purchase of a dump truck via state-approved contract for the Public Works Department. MOTION CARRIED. Ayes: Mayor Albanese, Councilmembers Austin, Neal, Hollier, and Root. Noes: None. g. Chris Duque, City Manager, stated on July 31st the Library Director, Victoria Klehn, was notified the Houston Area Library Automated Network (HALAN) will be dissolved and will no longer support the Marion & Ed Hughes Public Library as well as other area libraries. Ms. Klehn has been working with the Port Neches Library Director for these two libraries to move forward together saving money on new contracts for services to replace those provided by HALAN. Ms. Klehn discussed briefly how the city's IT Department will be taking over most of the services previously offered by HALAN. She said only a few services will not be available to citizens but those will be services with the fewest users. At some point in the future, she expects to have those services available again. Mr. Duque thanked Ms. Klehn for all her work making this transition. No action was necessary. h. A motion was made by Councilmember Austin and seconded by Mayor Pro Tern Neal to approve the final plat of Hillcrest Landing Additional subdivision. MOTION CARRIED. Ayes: Mayor Albanese, Councilmembers Austin, Neal, Hollier, and Root. Noes: None. Minutes Continued, October 28, 2019 i. A motion was made by Mayor Pro Tem Neal and seconded by Councilmember Austin to deny a request for a Specific Use Permit for the property located at 3503 Nederland Avenue, Suite C to operate a private poker club, which has an unlisted zoning use. MOTION CARRIED. Ayes: Mayor Albanese, Councilmembers Austin, Neal, Hollier, and Root. Noes: None. 5. EXECUTIVE SESSION: Mayor Albanese announced the scheduled Executive Session was not needed. 6. COMMUNICATION City Manager's Report: • Veterans' Day Celebration will be November 11th at 3:00 p.m. • Annual Lighted Christmas Parade will be December 3rd • Christmas on the Avenue will be December 7th • Red Ribbon Parade will be October 30th at 8:00 a.m. 7. ADJOURN There being no further business a motion was made by Mayor Albanese and seconded by Councilmember Hollier to adjourn the meeting at 5:00 p.m. MOTION CARRIED.
