1. MEETING
The meeting was called to order at 4:30 p.m. by Mayor Albanese at the Nederland City
Office Building, 207 N. 12th Street, Nederland, Texas. See attached for quorum.
The following statement was posted:
"PURSUANT TO SECTION 30.07, PENAL CODE (TRESPASS BY LICENSE HOLDER
WITH AN OPENLY CARRIED HANDGUN), A PERSON LICENSED UNDER
SUBCHAPTER H, CHAPTER 411, GOVERNMENT CODE (HANDGUN LICENSING
LAW), MAY NOT ENTER THIS PROPERTY WITH A HANDGUN THAT IS CARRIED

2. INVOCATION AND PLEDGE OF ALLEGIANCE
The invocation and pledge of allegiance were led by Gay Ferguson, City Clerk.
3. CONSENT AGENDA - All consent agenda items listed are considered to be routine by
the City Council and will be enacted by one motion. There will be no separate
discussion of these items unless a councilmember so requests, in which event the item
will be removed from the Consent Agenda and considered separately.
A motion was made by Councilmember Austin and seconded by Councilmember Hollier
to approve the Consent Agenda Items a-d as presented. MOTION CARRIED.

c. Consider action authorizing the Jefferson County Mosquito Control District to

• Consider action authorizing the closure of various city streets for the
Nederland Heritage Festival activities.
• Consider action authorizing the closure of various city streets for the
Spindletop Rod & Classic Car Show.
4. REGULAR AGENDA
a. Chris Duque, City Manager, recognized the Jefferson County Master Gardeners
Club (David Oates, Marianne Kirkpatrick, Brenda Beadle, Emeline Auzenne, John
Hughes, Deborah Parker, Ron Hogue, Dorothy Norris and Lisa Hill) for volunteering

to plant tulip bulbs along Boston Avenue which should bloom during Heritage
Festival. Angela Fanette, Director of Parks, presented Mr. Oates with a plaque.
b. A motion was made by Mayor Pro Tern Neal and seconded by Councilmember Root
to accept the Quarterly Investment Report from the Finance Department.
MOTION CARRIED.

c. A motion was made by Councilmember Austin and seconded by Councilmember
Hollier to renew an agreement for consulting services with HUB International
related to employee and group benefits. MOTION CARRIED.

d. A motion was made by Mayor Pro Tern Neal and seconded by Councilmember
Hollier to amend the Collective Bargaining Agreement between the City of
Nederland and the International Association of Fire Fighters, Local 3339. MOTION
CARRIED.

Noes: None.
e. A motion was made by Councilmember Austin and seconded by Councilmember
Root to amend the household income limits of the Spay and Neuter Program
guidelines. MOTION CARRIED.

f. A motion was made by Councilmember Hollier and seconded by Councilmember
Root to approve Change Order No. 2 for the 2019 Concrete Street Rehabilitation
project to reflect final quantifies (a reduction of $5,443.75) for a total project cost
of $876,897.25. MOTION CARRIED.
Ayes: Mayor Albanese, Councilmembers Austin, Neal, Hollier, and Root.

g. A motion was made by Mayor Pro Tern Neal and seconded by Councilmember
Austin to approve final payment and release of retainage for the 2019 Concrete
Street Rehabilitation project. MOTION CARRIED.

h. Chris Duque, City Manager, updated City Council on the 2020 Street Program. He
reported the pending Hodgson Road Street project was considered by the
Nederland Economic Development Corporation at their meeting held on January
15, 2020. Their decision was to deny the City's request for funding. Mr. Duque
stated it would minimize interruptions to the numerous businesses in the area and
it would save money by combining the Hodgson Road project with the Bourque
Road project. He suggested utilizing city funds to finance the project now rather
than postposing the project until 2021 or later. Mr. Duque said he and Mrs.
Dowden reviewed several accounts and found some savings to put toward the
unplanned expenditure and take the remaining funds needed from the General
Fund and Street Improvement Fund reserves. No action was necessary.

i. A motion was made by Councilmember Austin and seconded by Councilmember
Hollier to authorize the solicitation of bids for the 2020 Hot Mix Overlay project.
MOTION CARRIED.

j. A motion was made by Councilmember Root and seconded by Councilmember
Austin to authorize the solicitation of bids for the 2020 Concrete Street
Rehabilitation project. MOTION CARRIED.

k. A motion was made by Councilmember Hollier and seconded by Councilmember
Root to appoint Betty Davis-Pruitt and reappoint Brandin Shaw to the Parks
Advisory Board. MOTION CARRIED.

I. Mr. Duque, City Manager, presented an update to the city owned property located
at 3300 Park Street which has been utilized by Babe Ruth Baseball (League). He
said the agreement between the City of Nederland and Babe Ruth was executed in
1994 with an "ever-green" term (automatic renewal unless termination notice
provided), requires the League maintain its non-profit status, the grounds will be
maintained, and carry proof of liability insurance. Last summer the city began to
receive numerous complaints regarding the lack of maintenance of the property.
Efforts to contact Babe Ruth board members were unsuccessful. Staff became
aware the League lacked a board of directors. Currently staff and community
leaders are attempting to re-organize the board of directors. There are outstanding
utility bills, which include the City of Nederland, on this property. Mr. Duque said
if the League can show their non-profit status remains in effect and they can
provide insurance, the City would need to update the agreement for the lease of
the property. Adaptive Sports for Kids is interested in utilizing this field for their
spring baseball and has been in contact with Babe Ruth regarding scheduling and
work needed at the field in order to play. No action was necessary.
m. A motion was made by Councilmember Root and seconded by Councilmember
Hollier to approve Ordinance No. 2020-03, establishing hours of operation for the
Nederland Swimming Pool. MOTION CARRIED.

n. A motion was made by Councilmember Austin and seconded by Councilmember
Hollier to approve Ordinance No. 2020-04, amending the fiscal year 2019-2020
budget. MOTION CARRIED.

Noes: None.
o. Chris Duque, City Manager said an issue has arisen with a previously approved tax
abatement request for Phillips 66 and Chris G. Cisneros, Senior Advisor - Property
Tax with Phillips 66 is in attendance to speak to City Council. While preparing the
industrial tax bills, Mrs. Dowden notice a contractual issue regarding the 85%
threshold specified in the tax agreement. (Upon completion of the project, should
the actual amount of investment be less than 85% of the project amount provided

to the City, this exclusion shall not be granted as otherwise may have been
previously approved by the City Council in accordance with Section IV(B)(2)(f).
Two tax abatements failed to meet this requirement.
Mr. Cisneros requested the city amend the two projects: Crude 2 from
$100,000,000 to $80,070,774.02 and Crude 3 from $52,000,000 to
$40,388,895.65 to satisfy the 85% threshold.
p. 2020 Election:
i. A motion was made by Councilmember Austin and seconded by Councilmember
Root to approve Resolution No. 2020-01, calling for an election to be held on May
2, 2020 for the purpose of electing two (2) City Councilmembers - one from Ward
I and one from Ward III and appointing an Early Voting Clerk. MOTION CARRIED.
Ayes: Mayor Albanese, Councilmembers Austin, Neal, Hollier, and Root.
Noes: None.
ii. A motion was made by Councilmember Root and seconded by Councilmember
Hollier to approve an Interlocal Agreement between the City of Nederland and the
Nederland Independent School District in regard to the May 2020 election.
MOTION CARRIED.
Ayes: Mayor Albanese, Councilmembers Austin, Neal, Hollier, and Root.
Noes: None.
5. EXECUTIVE SESSION
The regular meeting was recessed at 5:28 p.m. by Mayor Albanese for the purpose of
conducting an Executive Session as authorized by Texas Government Code, Chapter
551.071, Consultation with City Attorney.
6. RECONVENE
The regular meeting was reconvened at 5:57 p.m. by Mayor Albanese.
o. A motion was made by Councilmember Austin and seconded by Councilmember
Hollier to approve a request by Phillips 66 to amend the Crude 2 project from
$100,000,000.00 to $80,070,774.02 and deny a request to amend the Crude 3
project from $52,000,000.00 to $40,388,895.65. MOTION CARRIED.

7. COMMUNICATION
a. Miscellaneous: Robert Woods reported on the progress of the wastewater sewer
project. He said the contractor has begun work rebuilding manholes in the priority 2
area. They have cleaned and televised approximately 2400 linear feet of 30" sewer
line. They will begin lining later this week. The Hodgson Lift Station is operating with
a by-pass pump. The shaft on the first pump sheared and the second pump has a
fracture in the pump cradle.

seconded by Councilmember Austin to adjourn the meeting at 6:05 p.m. MOTION

RESOLUTION 2020-01
A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF
NEDERLAND,TEXAS CALLING A GENERAL ELECTION ON
SATURDAY, MAY 2, 2020; DESIGNATING THE POLLING
PLACE; PROVIDING FOR OTHER MATTERS RELATING TO
THE GENERAL ELECTION; AND FINDING AND
DETERMINING THAT THE MEETING AT WHICH THIS
RESOLUTION IS PASSED IS OPEN TO THE PUBLIC AS
REQUIRED BY LAW.
WHEREAS, the laws of the State of Texas and the Charter of the City of Nederland
provide that on May 2,2020 there shall be elected the following officials for this City:
One(1)Council member,Ward I
One(1)Council member,Ward Ill
WHEREAS, the laws of the State of Texas and the Charter of the City of Nederland
further provide that the Election Code of the State of Texas is applicable to said election, and in
order to comply with said Code, a resolution should be passed establishing the procedure to be
followed in said election,and designating the voting place for said election.

NOW,THEREFORE,BE IT RESOLVED AND ORDERED BY THE CITY COUNCIL OF
THE CITY OF NEDERLAND,TEXAS:
•
That all independent candidates at the electiora,to be held on the first Saturday in May,
2020,for the above-mentioned offices file their application to have their name placed on the ballot
with the City Clerk at City Hall, 207 N. 12th Street, Nederland, Texas, not later than the sixty-
second (62nd)days before the election or earlier than the 30th day before the date of the filing
deadline in accordance with Election Code Sec. 143.006 and 143.007. The earliest date for a
candidate to file same will be January 15, 2020, with the last day for filing to be February 14,
2020 at 5:00 p.m. All of said applications shall be on a form as prescribed by Section 141.031 of
the Election Code.
The order in which names of the candidates are to be printed on the ballot shall be
determined by a drawing by the City Clerk as provided by Section 52.094 of the Election Code.
The City of Nederland has one polling place located in the City Office Building, 207 N.
12th Street, Nederland,Texas. The City Clerk is hereby authorized and instructed to provide and
furnish all necessary election supplies to conduct said election.
Linda Sherman will serve as Presiding Judge and Ron Sherman will serve as Alternate
Presiding Judge, and the clerks of the election will be appointed by the Presiding Judge in a
number not to exceed seven(7).
The polls at the above designated polling place shall on said Election Day be open from
7:00 a.m.to 7:00 p.m.
Gay Ferguson is hereby appointed Clerk for Early Voting. The Early Voting for the above
designated election shall be at the Nederland City Office Building,207 N. 12th Street, Nederland,
• Texas,and said place of Early Voting shall remain open for at least eight(8)hours on each day
for Early Voting which is not a Saturday, Sunday, or an official State holiday, beginning on the
twelfth(12th)day and continuing through the fourth (4th)day preceding the date of said election.
Said place of voting shall remain open between the hours of 8:00 a.m.and 5:00 p.m.on each day
for said Early Voting. As required under Section 85.005(d), Election Code, early voting by
personal appearance at the main early voting polling place shall be conducted for at least 12
hours on two weekdays, if the early voting period consists of six or more weekdays, therefore,
early voting by personal appearance shall be conducted for 12 hours from 7:00 a.m.to 7:00 p.m.
on Tuesday, April 21, 2020 and Tuesday, April 28, 2020. The above described place for Early
Voting is also the Early Voting Clerk's address to which ballot applications and ballots voted by
mail may be sent.
The Early Voting Ballot Board shall be created as provided by Election Code Sec.
87.001. Linda Sherman is hereby appointed as the Presiding Judge for the Early Voting Ballot
Board and is authorized to appoint two(2)clerks to serve on the Board. Gay Ferguson is hereby
appointed to serve as the Presiding Judge of the Central Counting Station as provided in Section
127.005 of the Election Code.
Said election shall be held in accordance with the Election Code of the State, and only
resident qualified voters of said City shall be eligible to vote at said election.
All ballots shall be prepared in accordance with Texas Election Code. Paper ballots shall
be used for early voting by mail and for provisional ballots. The ExpressVote BMD with DS200
Scanner shall be used for early voting by personal appearance and voting on Election Day. The
City Council hereby adopts for use in early voting and Election Day voting the ExpressVote BMD
with DS200 Scanner as approved by the Secretary of State. All expenditures necessary for the
conduct of the election, the purchase of materials therefore, and the employment of all election
officials is hereby authorized.
The Mayor shall give notice of this election in accordance with the terms and provisions
of Sections 4.004,83.010, 85.004,and 85.007 of the Election Code,and all necessary orders and
writs for said election shall be issued by the proper authority. Returns of said election shall be
made to the City Council immediately after the closing of the polls.
It is further found and determined that in accordance with the order of this governing
body, the City Clerk posted written notice of the date, place and subject of this meeting on the
bulletin board located in the City Hall, a place convenient and readily accessible to the general
public, and said notice having been posted and remaining posted continuously for at least 72
hours preceding the scheduled time of said meeting.

NEDERLAND SWIMMING POOL AS SHOWN IN EXHIBIT"A";
REPEALING ORDINANCE NO. 2019-07; AND
ESTABLISHING AN EFFECTIVE DATE.
WHEREAS,the Nederland Parks&Recreation Board has reviewed the presented revisions
to the parks schedule of fees ordinance and recommends its adoption to the Nederland City
Council;and
WHEREAS,the City Council of the City of Nederland has been presented with hours of
operation, procedures, and a schedule of fees for the Nederland Recreation Center and the
swimming pool for its acceptance and adoption;and
WHEREAS,the City Council of the City of Nederland deems it advisable and to be in the
best interest of the citizens of Nederland to adopt the hours of operation, procedures, and fee
schedule for the Nederland Recreation Center and the swimming pool as shown in Exhibit "A"
attached;and
NOW,THEREFORE,BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF NEDERLAND,
TEXAS THAT:
Section 1. The hours of operation, procedures, and fee schedules as shown in Exhibit
"A"attached,which is incorporated herein by reference,is hereby approved
and adopted;and
Section 2. Ordinance No. 2019-07 shall be repealed when this Ordinance becomes
effective;and
Section 3. This ordinance shall take effect and be in force from and after its passage.

Notes:
Open Swim:
o During the daily Open Swim,the fee for admission for residents and non-residents is half the normal
price for the final hour of open swim.
Single pass:
o Only valid for swimmers over the age of 10.
o Parent consent and emergency contact information required at application.
o No admission/attendance requirements.
Family passes:
o All children under age of 10 require parent/guardian/adult supervision at all times, no exceptions.
o Non-relative adults (baby sitters, neighbors, etc) may be listed on application.
o Additional members may be added up to seven (7)family members. Changes cannot be made to
the pass during the pool season.

ORDINANCE NO.2020-04
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
NEDERLAND,TEXAS AMENDING THE FISCAL YEAR 2019-
2020 BUDGET IN ACCORDANCE WITH THE BUDGET AND
THE CHARTER OF THE CITY OF NEDERLAND.
WHEREAS,the City Council previously approved Ordinance No. 2019-26,which adopted
the Fiscal Year 2019-2020 City Budget;and,
WHEREAS, the City Council deems it necessary to amend the current budget to adjust
revenues and expenditures as set out in Attachment"A"attached hereto;and,
WHEREAS,the 2019-2020 City budget states "That any unencumbered funds remaining
on hand at the end of the fiscal year ending September 30, 2020 shall be construed with and
classified with Miscellaneous revenue anticipated during the fiscal year beginning October 1,
2019 and ending September 30,2020,and such funds are hereby appropriated as a City Council
Contingency Account for purposes approved by the City Council;and,
NOW,THEREFORE,BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF NEDERLAND,
TEXAS:
THAT the budget for the fiscal year 2019-2020 is amended to allow for adjustments in
revenues and expenditures as set out in Attachment"A."
THAT all ordinances and parts of ordinances in conflict herewith are expressly repealed.
THAT the City Clerk shall file a true copy of this ordinance and said budget amendment
with the Office of County Clerk of Jefferson County,Texas as provided by Section 102.011 of the
Local Government Code.
THAT,this being an ordinance not requiring publication,it shall take effect and be in force
from and after its passage.

JUSTIFICATION
In the General Fund, the NFD Salaries&Wages line-item is increased to reflect the accrued leave payout for a
retiree and to reflect the Admin Asst. stipend; this is off-set with the Retiree Accrued Compensation line-item.
In the Parks Special Fund,funds are allocated for the Water Slide project(construction and engineering costs).
