January 11, 2021 REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF NEDERLAND 4:30 P.m_ 3armuary 11, 2021 1. MEETING The meeting was called to order at 4:30 p.m. by Mayor Albanese at the Nederland City Office Building, 207 N. Street, Nederland, Texas. See attached for quorum. This meeting was closed to in-person attendance by the public. A temporary suspension of the Open Meetings Act to allow telephone or videoconference public meetings has been granted by Governor Abbott. Telephonic and videoconferencing capabilities were utilized to allow individuals to address the City Council. The following statement was posted: "PIIIRSUANT TO SECTION 30.07, PENAL CODE (TRESPASS BY LICENSE HOLDER WITH AN OPENLY CARRIED HANDGUN), A PERSON LICENSED UNDER SUBCHAPTER H, CHAPTER 411, GOVERNMENT CODE (HANDGUN LICENSING LAW), MAY NOT ENTER THIS PROPERTY WITH A HANDGUN THAT IS CARRIED OPENLY." 2. INVOCATION AND PLEDGE OF ALLEGIANCE The invocation and pledge of allegiance were led by Gay Ferguson, City Clerk_ 3_ CONSENT AGENDA - All consent agenda items listed are considered to be routine by the City Council and will be enacted by one motion. There will be no separate discussion of these items unless a councilmember so requests, in which event the item will be removed from the Consent Agenda and considered separately_ A motion was made by Councilmember Neal and seconded by Mayor Pro Tem Hollier to approve the Consent Agenda Items a-b as presented. MOTION CARRIED_ Ayes: Mayor Albanese, Councilmembers Austin, Neal, Hollier, and Root. Noes: None. a. Minutes - December 14, 2020 regular meeting b. Tax Assessor Collection Report - November 2020 4. REGULAR AGENDA a. A motion was made by Councilmember Austin and seconded by Councilmember Neal to authorize the acceptance of the 2021 Wilton and Effie Mae Hebert Foundation grant. MOTION CARRIED. Ayes: Mayor Albanese, Councilmembers Austin, Neal, Hollier, and Root. Noes: None. Minutes Continued, January 11, 2021 b. A motion was made by Councilmember Root and seconded by Mayor Pro Tern Hollier to approve Resolution No. 2021-01, ratifying a Declaration of Disaster of Local State of Disaster in response to Hurricane Laura and consenting to continuation of the disaster for a period of more than seven days. MOTION CARRIED. Ayes: Mayor Albanese, Councilmembers Austin, Neal, Hollier, and Root. Noes: None. c. A motion was made by Mayor Pro Tern Hollier and seconded by Councilmember Austin to approve Resolution No. 2021-02, ratifying a Declaration of Disaster of Local State of Disaster in response to Hurricane Delta and consenting to continuation of the disaster declaration for a period of more than seven days. MOTION CARRIED. Ayes: Mayor Albanese, Councilmembers Austin, Neal, Hollier, and Root. Noes: None. d. A motion was made by Councilmember Neal and seconded by Councilmember Root to approve Resolution No. 2021-03, ratifying a Declaration of Disaster of Local State of Disaster in response to concerns related to the Coronavirus Disease 2019 (COVID-19) and consenting to continuation of the disaster declaration for a period of more than seven days. MOTION CARRIED. Ayes: Mayor Albanese, Councilmembers Austin, Neal, Hollier, and Root. Noes: None. e. Chris Duque, City Manager, said there was no staff recommendation to revise current levels of operation. f. A motion was made by Mayor Pro Tern Hollier and seconded by Councilmember Austin to extend the City of Nederland Emergency Pandemic Leave Policy until February 28, 2021. MOTION CARRIED. Ayes: Mayor Albanese, Councilmembers Austin, Neal, Hollier, and Root. Noes: None. 5. COMMUNICATION City Manager's Report: • City Offices closed on Monday, Jan. 18th, for M. L. King Day and garbage service will run one day behind. • State of Texas will be providing COVID testing at the Recreation Center this Wednesday and Thursday free of charge. • There has been no decision made regarding the Nederland Heritage Festival. • The City has received a grant from the Texas General Land Office in the amount of $4.2M for drainage repairs. 6. ADJOURN There being no further business a motion was made by Mayor Albanese and seconded by Councilmember Austin to adjourn the meeting at 4:54 p.m. MOTION CARRIED.
