June 28, 2021 REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF NE15ERLANU 4:30 P.m. June 28, 2021. 1. MEETING The meeting was called to order at 4:30 p.m. by Mayor Albanese at the Nederland City Office Building, 207 N. Y2t" Street, Nederland, Texas. See attached for quorum. INVOCATION ANO PLEDGE OF ALLEGIANCE The invocation and pledge of allegiance were led by Emmett Hollier, Mayor Pro Tem. 3. CONSENT AGENDA - All consent agenda items listed are considered to be routine by the City Council and will be enacted by one motion. There will be no separate discussion of these items unless a councilmember so requests, in which event the item will be removed from the Consent Agenda and considered separately. A motion was made by Councilmember Neal and seconded by Councilmember Austin to approve the Consent Agenda Items a-c as presented. MOTION CARRIED. Tax Assessor Collection Report - May 2021 5_ EXECUTIVE SESSION The regular meeting was recessed at 4:33 p.m. by Mayor Albanese for the purpose of conducting an Executive Session as authorized by Texas Government Code, Chapter 551.0437 - Deliberation Regarding Economic Development Negotiations. G. RECONVENE The regular meeting was reconvened at E.:32 p.m. by Mayor Albanese. He announced the Executive Session was held for informational purposes only and no action is necessary. Minutes Continued, dune 28, 2021 4. REGULAR AGENDA a. Appointments: i. A motion was made by Councilmember Root and seconded by Mayor Pro Tern Hollier to reappoint Paul Hussey to the Zoning Board of Appeals and Board of Appeals. MOTION CARRIED. Ayes: Mayor Albanese, Councilmembers Austin, Neal, Hollier, and Root. Noes: None. ii. A motion was made by Councilmember Austin and seconded by Councilmember Root to reappoint Jerry McNeill to the Civil Service Commission. MOTION CARRIED. Ayes: Mayor Albanese, Councilmembers Austin, Neal, Hollier, and Root. Noes: None. iii. A motion was made by Mayor Pro Tem Hollier and seconded by Councilmember Neal to reappoint Steve Gentile, Ron Minaldi, and Boyd Meier to the Construction Appeals Board. MOTION CARRIED. Ayes: Mayor Albanese, Councilmembers Neal, Hollier, and Root. Noes: None. b. A motion was made by Councilmember Neal and seconded by Councilmember Austin to approve a work authorization with Schaumburg & Polk, Inc. for the 2021 Flexible Pavement Rehabilitation (hot mix overlay) project. MOTION CARRIED. Ayes: Mayor Albanese, Councilmembers Austin, Neal, Hollier, and Root. Noes: None. c. A motion was made by Councilmember Austin and seconded by Mayor Pro Tern Hollier to approve Change Order No. 1 - Wastewater Treatment Plant Improvements Phase 1 project in the amount of $35,592.00. MOTION CARIED. Ayes: Mayor Albanese, Councilmembers Austin, Neal, Hollier, and Root. Noes: None. d. Chris Duque, City Manager, said the City will hold its 10th Annual Fireworks Extravaganza on Sunday, July 4th at Doornbos Park. Angela Fanette, Director of Parks & Recreation, stated the pool will be open from 5:00 p.m. - 10:00 p.m., there will be 5 vendors, and fireworks will begin at 9:15 p.m. 5. EXECUTIVE SESSION The regular meeting was recessed at 6:42 p.m. by Mayor Albanese for the purpose of conducting an Executive Session as authorized by Texas Government Code, Chapter 551.074 - Discuss Personnel Appointments: City Clerk, Director of Finance, Police Chief, City Attorney, and City Judge; and Annual Evaluation for City Manager, Christopher Duque. Minutes Continued, June 28, 2021 6. RECONVENE The regular meeting was reconvened at 7:15 p.m. by Mayor Albanese. He announced the Executive Session for consultation with City Attorney was not needed. 7. APPOINTMENTS a. A motion was made by Mayor Pro Tem Hollier and seconded by Councilmember Austin to authorize the following appointments: Gay Ferguson, City Clerk; Cheryl Dowden, Director of Finance; Gary Porter, Police Chief; Jesse Branick, City Attorney, and Larry Dowden, City Judge. MOTION CARRIED. Ayes: Mayor Albanese, Councilmembers Austin, Neal, Hollier, and Root. Noes: None. b. A motion was made by Councilmember Neal and seconded by Councilmember Austin to increase compensation for Mr. Branick and Judge Dowden by 2% for a cost of living adjustment beginning July 1, 2021. MOTION CARRIED. Ayes: Mayor Albanese, Councilmembers Austin, Neal, Hollier, and Root. Noes: None. c. A motion was made by Councilmember Root and seconded by Mayor Pro Tem Hollier to approve an employment agreement between the City of Nederland and City Manager, Christopher Duque. MOTION CARRIED. Ayes: Mayor Albanese, Councilmembers Austin, Neal, Hollier, and Root. Noes: None. 8. COMMUNICATION City Manager's Report: a. Miscellaneous: • City Offices will be closed Monday in observance of 4th of July. Garbage will run one day behind schedule. • Next Regular Council meeting will be July 26th due to Election. • Special Work Session will be July 7th at 4:30 p.m. at City Hall. • Early Voting will begin July 7th at 8:00 a.m. at City Hall. 9. ADJOURN There being no further business a motion was made by Mayor Albanese and seconded by Councilmember Neal to adjourn the meeting at 7:19 p.m. MOTION CARRIED.
