MEETING The meeting was called to order at 4:30 p.m. by Mayor Albanese at the Nederland City Office Building, 207 N. 12.. Street, Nederland, Texas. See attached for quorum. A motion was made by Mayor Pro Tern Austin and seconded by Councilmember Neal to appoint Dylan Fairly to the Planning Sa Zoning Commission for a term ending June 30, 2022. A motion was made by Mayor Pro Tern Austin and seconded by Councilmember Root to accept the Quarterly Investment Report from the Finance Department. MOTION CARRIED. Ayes: Mayor Albanese, Councilmembers Austin, Neal, Sonnier, and Root. Noes: None. c. A motion was made by Councilmember Root and seconded by Councilmember Sonnier to approve final payment and release of retaining for the South 6th Street Water Main Improvements project. MOTION CARRIED. Ayes: Mayor Albanese, Councilmembers Austin, Neal, Sonnier, and Root. Noes: None. d. A motion was made by Councilmember Sonnier and seconded by Councilmember Neal to approve Change Order #1, a cost reduction of $46,236.07, for the 2020- 2021 Concrete Pavement Rehabilitation project. MOTION CARRIED. Ayes: Mayor Albanese, Councilmembers Austin, Neal, Sonnier, and Root. Noes: None. e. A motion was made by Mayor Pro Tern Austin and seconded by Councilmember Neal to approve final payment and release of retainage for the 2020-2021 Concrete Pavement Rehabilitation project. MOTION CARRIED. Ayes: Mayor Albanese, Councilmembers Austin, Neal, Sonnier, and Root. Noes: None. f. A motion was made by Councilmember Sonnier and seconded by Councilmember Root to authorize the solicitation of bids for the Storm Sewer Improvements (17th Street and Avenue N) Allen Meadows Subdivision project. MOTION CARRIED. Ayes: Mayor Albanese, Councilmembers Austin, Neal, Sonnier, and Root. Noes: None. g. A motion was made by Councilmember Neal and seconded by Councilmember Sonnier to approve Ordinance 2021-20, abandoning two alleyways (0.1168 acre of land adjacent to Lots 19 & 20, BIk 23, Town of Nederland) and retaining certain easements. MOTION CARRIED. Ayes: Mayor Albanese, Councilmembers Austin, Neal, Sonnier, and Root. Noes: None. h. A motion was made by Mayor Pro Tern Austin and seconded by Councilmember Neal to approve a Purchase and Sale Agreement between the City of Nederland and the Economic Development Corporation in regard to the sale of two alleyways (0.1168 acre of land adjacent to Lots 19 & 20, BIk 23, Town of Nederland, for future economic development subject to final legal review and approval. MOTION CARRIED. Ayes: Mayor Albanese, Councilmembers Austin, Neal, Sonnier, and Root. Noes: None. i. A motion was made by Councilmember Sonnier and seconded by Councilmember Root to approve Resolution No. 2021-32, authorizing the City Manager to execute closing and title documents for the sale of two alleyways (0.1168 acre of land adjacent to Lots 19 & 20, BIk 23, Town of Nederland) to the Nederland Economic Development Corporation. A motion was made by Councilmember Neal and seconded by Councilmember Root to approve the Intergovernmental Contract between the City of Nederland and Jefferson County for jail fees. MOTION CARRIED. Ayes: Mayor Albanese, Councilmembers Austin, Neal, Sonnier, and Root. Noes: None. 5. COMMUNICATION City Manager's Report: a. Miscellaneous: Robert Woods gave a brief construction update: • Bourque and Hodgson Road project should be completed by December 3rd with close-out being presented at December 13th City Council meeting. • Hodgson Road Lift Station still has a few issues outstanding to be resolved before closing out. • 2022 Concrete Street Improvements will begin soon with the parking lot at the Babe Ruth Baseball field being priority for an estimated completion date of February 15th. b. City Offices will be closed this Thursday and Friday in observance of Thanksgiving. c. Christmas on the Avenue will be December 4th d. Annual Lighted Christmas Parade will be December 7th e. EDC Tour of Lights will be December 14tn f. Next City Council meeting will be December 6th 6. (J:044 4, WO ji-ackJ2-0e_fi o* 'z , h0 Don Albanese,Mayor kbrer 0101( 61y(}01)( Gay FerguYon,City Clerk APPROVED AS TO FORM: Jesse Bra ick,C ttorney ORDINANCE NO. 2021-20 AN ORDINANCE ABANDONING OF ALLEYWAYS IN THE CITY OF NEDERLAND, JEFFERSON COUNTY, TEXAS, AND RETAINING CERTAIN EASEMENTS THEREOF AND PROVIDING AN EFFECTIVE DATE WHEREAS, the Checkerboard Restaurants shall own separate portions of the property adjacent to the alleyway hereinafter described as 0.1168 acre of land adjacent to 1132 Nederland Avenue Lot 19 &20, Block 23 of Town of Nederland Addition, and WHEREAS, the Nederland Economic Development Corporation (NEDC) has petitioned the City Council of the City of Nederland to abandon said portion of the alleyways and convey and exchange said alleyways to the abutting property owner for economic development, and WHEREAS, the City of Nederland agrees to abandon, and convey and exchange said alleyways to the NEDC as shown in Exhibit"A"as attached hereto, and WHEREAS, the City of Nederland shall retain a twenty foot (20') utility easement as shown in Exhibit"B"as attached hereto, and NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF NEDERLAND, TEXAS THAT: Section 1. That the following described portion of said alleyways in the City of Nederland, Jefferson County, Texas, be and it is hereby abandoned as a twenty (20)ft. alleyway and retained as a twenty (20)ft. utility easement in which shall become part of said adjacent property described herein in Exhibit "B" from the purchase thereof as shown in Exhibit"B" Section 2. The City of Nederland shall convey and exchange said alleyways to the NEDC, and Section 3. That the City of Nederland shall retain a twenty foot(20') utility easement as shown in Exhibit"B". Section 4.This ordinance shall be effective from and after its passage.
