pz_20140211 Nederland Zoning Board of Appeals Agenda NOTICE is hereby given of a meeting of the Zoning Board of Appeals to be held on Tuesday, February 11, 2014, at 5:00 p.m. at the City of Nederland D. Bob Henson Office Building, 1903 Atlanta Avenue, Nederland, Texas for the purpose of considering the following agenda items. 1. CALL THE MEETING TO ORDER 2. APPROVE THE MINUTES OF PREVIOUS MEETING 3. VARIANCES Review and consider action approving a variance for Cormier Homes, owner of the property located at 158 Sterling Ridge Drive, described as Lot 21, Block 1, Sterling Ridge Phase II, Section II Subdivision. Applicant is requesting a variance to Section 12.2 "Schedule of residential height and area regulations" of the City of Nederland Zoning Ordinance for a front yard setback encroachment consisting of a maximum of seven feet (7′) located at a point starting at the right corner of the garage then decreasing for a distance of twenty-three feet (23′) to a point intersecting with the twenty foot (20′) front yard building setback line required by Section 12.2. Review and consider action approving a variance for Al Celaya, tenant of the property located at 2208 Helena Avenue, described as Lot 1, Tract 1, Block 1, Cottage Groves Addition. Mr. Celaya is requesting a variance to Section 15.1(6) "Temporary Use Permits" of the City of Nederland Zoning Ordinance that allows a maximum time limit of sixty (60) days to sell seasonal products from temporary structures. The applicant is requesting to sell snow cones (Temporary Product) year round from a detached 7 ′ by 15′ accessory building located on the same lot as the main building being a convenience store. Review and consider a variance for Clint Boyd, owner of the property located at 3113 Highway 69 N, described as 1.859 acres being part of Lot 5 and 6, Block 19I, Port Arthur Land Company. Mr. Boyd is requesting a variance to Section B “Specific Standards” note (2) "Non-residential Construction” of Chapter 50 – Floods from the City of Nederland Code of Ordinances. Section B requires that all non-residential construction located in a flood hazard area to elevate the top of the lowest floor eighteen (18”) inches above the base flood elevation establish by FEMA. The variance request is to allow the top ZONING BOARD OF APPEALS AGENDA February 11, 2014 Page 2 of the lowest floor or top of the concrete foundation to be elevated six (6") inches above base flood elevation of fourteen (14′) feet. Review and consider action approving a variance for Kent and Bobbie Lee, owners of the property located at 8010 Viterbo Road, described as Lot 3A, of Replat of Lots 2 and 3, of Pleasant Home Addition. Applicants are requesting a variance to Section 11.4 R-1 (1) "Single-family district" (General Purpose and Description) which requires every lot located in a single family zoning district to have constructed first a detached 1200 square foot dwelling before any accessory buildings are constructed on the lot. 4.
