07-25-22 AgendaNEDERLAND CITY COUNCIL AGENDA NOTICE is hereby given of a regular meeting of the Nederland City Council to be held on Monday, July 25, 2022, 4:30 p.m., at the Nederland City Hall, 207 North 12th Street, Nederland, Texas, for the purpose of considering the following agenda items. The City Council reserves the right to retire into Executive Session concerning any of the agenda items whenever it is considered necessary and legally justified pursuant to Texas Government Code, Chapter 551. This meeting will be OPEN to in-person attendance by the public; however due to the spacing restrictions in the City Council Chamber, masks are encouraged. The City will continue to provide citizens an alternative method to attend and participate in City Council meetings. Members of the public can participate remotely via Zoom Teleconferencing. Citizens may join the Zoom Meeting by clicking on the Virtual Council Meeting https link on the City of Nederland’s website or calling the Zoom Call in Number and entering the Meeting ID# on the City of Nederland’s website. 1. There will be no separate discussion of these items unless a councilmember so requests, in which event the item will be removed from the Consent agenda and considered separately. a. Minutes – July 11, 2022 regular meeting and July 11, 2022 Work Session meeting b. June 2022 Departmental Reports c. Tax Assessor Collection Report – June 2022 d. Consider action authorizing the closure of Boston Avenue between the “Welkom to Nederland” arch and 14th Street and all intersections on Saturday, October 15th for the NEDC’s Fall Market Day event. 4. REGULAR AGENDA a. Receive comments from Andrew Cousins regarding “the City’s compliance with Section 5.02 of the City Charter.” b. Receive comments from Andrew Cousins regarding “potential for investment into City parks and recreation in an effort to combat the mental health crisis in our communities.” c. Discussion regarding Kirk Gillespie’s request to de-annex a portion of his property located at 1815 Peterson Road. d. Conduct a Public Hearing to receive comments regarding the Lower Neches Valley Authority’s request to abandon a section of Detroit Avenue and North 1st Street near FM 366 for a LNVA canal improvement project. e. Receive the Consumer Confidence Report (Water Quality Report). f. Consider action appointing Kevin Smith to the Zoning Board of Appeals and the Board of Appeals. AGENDA July 25, 2022 Page 2 g. Discussion and possible action amending the Lease Agreement with Nederland Babe Ruth League for use of City property located at 3300 Park Street to the Mid-County Babe Ruth League. h. Consider action approving Ordinance No. 2022-18, authorizing the suspension of the effective date for an additional ninety days beyond the August 5, 2022 effective date proposed by Entergy Texas, Inc. in connection with its rate increase application. i. Consider action amending the Callout Guideline to address the Parks & Recreation Department employees during the pool season. j. City of Nederland Non-Profit Partnership Grant Program: i. Consider action approving an Agreement for Funding with the Rotary Club of Nederland. ii. Consider action approving an Agreement for Funding with the Knights of Columbus, Council 5145. iii. Consider action approving an Agreement for Funding with First United Methodist Church of Nederland. iv. Consider action approving an Agreement for Funding with Optimist International dba Mid-County Noon Optimist. v.
