09-12-22 AgendaNEDERLAND CITY COUNCIL AGENDA NOTICE is hereby given of a regular meeting of the Nederland City Council to be held on Monday, September 12, 2022, 4:30 p.m., at the Nederland City Hall, 207 North 12th Street, Nederland, Texas, for the purpose of considering the following agenda items. The City Council reserves the right to retire into Executive Session concerning any of the agenda items whenever it is considered necessary and legally justified pursuant to Texas Government Code, Chapter 551. This meeting will be OPEN to in-person attendance by the public; however due to the spacing restrictions in the City Council Chamber, masks are encouraged. The City will continue to provide citizens an alternative method to attend and participate in City Council meetings. Members of the public can participate remotely via Zoom Teleconferencing. Citizens may join the Zoom Meeting by clicking on the Virtual Council Meeting https link on the City of Nederland’s website or calling the Zoom Call in Number and entering the Meeting ID# on the City of Nederland’s website. 1. CALL THE MEETING TO ORDER 2. INVOCATION AND PLEDGE OF ALLEGIANCE 3. CONSENT AGENDA—All consent agenda items listed are considered to be routine by the City Council and will be enacted by one motion. There will be no separate discussion of these items unless a councilmember so requests, in which event the item will be removed from the Consent agenda and considered separately. a. Minutes – August 22, 2022 regular meeting b. Street Closure Requests: i. Consider action authorizing the closure of various streets for the Nederland Economic Development Corporation’s Fall Concert Series on September 15th, 29th and October 13th and 20th. ii. Consider action authorizing the closure of Boston Avenue between 14th Street and 17th Street and all intersections on Tuesday, October 4th for the National Night Out event and the Nederland Fire Department Open House. iii. Consider action authorizing the closure of Boston Avenue between 12th Street and 17th Street and all intersections on Saturday, December 3rd for the “Christmas on the Avenue” event. 4. REGULAR AGENDA a. Consider action approving a Proclamation recognizing the Girls Relay Team known as the “Dream Team.” b. Consider action approving Resolution No. 2022-09, ratifying the action of the Nederland Economic Development Corporation Board of Directors related to the incentive offered to Tran Plaza. c. Consider action approving Ordinance No. 2022-20, declining to approve the change in rates requested by Entergy Texas, Inc.’s Statement of Intent filed on July 1, 2022. AGENDA September 12, 2022 Page 2 d. City of Nederland Non-Profit Partnership Grant Program: i. Consider action approving an Agreement for Funding with the Nederland Chamber of Commerce. ii. Consider action approving an Agreement for Funding with Hillcrest Baptist Church. iii. Consider action approving an Agreement for Funding with the Community Care Prayer Outreach Center. iv. Consider action approving an Agreement for Funding with the Tender Loving Care Center for Children dba Legacy Community Development Corporation. v. Consider action approving an Agreement for Funding with the Samaritan Counseling Center of Southeast Texas. e. Consider action declaring surplus various equipment from the Fire Department and authorizing the donation of said surplus equipment to the Bridge City Volunteer Fire Department. f. Consider action declaring surplus various vehicles and equipment from the Public Works Department. g. Consider action approving an Engineering Services agreement with Pacheco-Koch regarding the Seattle Avenue and N. 27th Street Drainage Improvements project. h. Receive comments from Keith Bass regarding food truck regulations. i. Fiscal Year 2021-2022 Budget: i. Conduct a Public Hearing for the purpose of receiving comments regarding the proposed City of Nederland Fiscal Year 2022-2023 Budget. ii. Conduct a Public Hearing for the purpose of receiving comments regarding the proposed tax rate of $0.481056 per $100 assessed taxable value for the Fiscal Year 2022-2023. 5. EXECUTIVE SESSION (No Public Discussion on These Items) The City Council will announce that it will go into Executive Session, pursuant to Chapter 551 of the Texas Government Code, to discuss matters as specifically listed on the agenda, or as authorized by law. Consultation with City Attorney – Texas Government Code, Chapter 551.071 6. RECONVENE Reconvene into regular session and discuss and take action, if any, on items discussed in Executive Session. 7.
