10-10-22 AgendaNEDERLAND CITY COUNCIL AGENDA NOTICE is hereby given of a regular meeting of the Nederland City Council to be held on Monday, October 10, 2022, 4:30 p.m., at the Nederland City Hall, 207 North 12th Street, Nederland, Texas, for the purpose of considering the following agenda items. The City Council reserves the right to retire into Executive Session concerning any of the agenda items whenever it is considered necessary and legally justified pursuant to Texas Government Code, Chapter 551. This meeting will be OPEN to in-person attendance by the public; however due to the spacing restrictions in the City Council Chamber, masks are encouraged. The City will continue to provide citizens an alternative method to attend and participate in City Council meetings. Members of the public can participate remotely via Zoom Teleconferencing. Citizens may join the Zoom Meeting by clicking on the Virtual Council Meeting https link on the City of Nederland’s website or calling the Zoom Call in Number and entering the Meeting ID# on the City of Nederland’s website. 1. CALL THE MEETING TO ORDER 2. INVOCATION AND PLEDGE OF ALLEGIANCE 3. CONSENT AGENDA—All consent agenda items listed are considered to be routine by the City Council and will be enacted by one motion. There will be no separate discussion of these items unless a councilmember so requests, in which event the item will be removed from the Consent agenda and considered separately. a. Minutes – September 26, 2022 regular meeting and September 19, 2022 special meeting b. Consider action approving a request from the Nederland Rotary Club to utilize Doornbos Park for their annual Hooked on Fishing, Not on Drugs (HOFNOD) event. c. Consider action approving a request from Nederland Little Dribblers to utilize the Nederland Recreation Center gymnasium for practices and the waiver of associated fees. d. Consider action authorizing the closure of Boston Avenue between 15th Street and 17th Street and all intersections on Monday, October 31st for the Nederland Chamber of Commerce’s “Trunk-R-Treat” event. 4. REGULAR AGENDA a. Consider action accepting a donation from the Nederland Heritage Festival Foundation for the Nederland Police, Fire, and Parks & Recreation Departments. b. Consider action re-appointing Don Albanese, Bret Duplant, and Mitch Macon to the Nederland Economic Development Corporation Board of Directors. c. City of Nederland Non-Profit Partnership Grant Program: i. Consider action approving an Agreement for Funding with Spindletop Center MHMR. ii. Consider action approving an Agreement for Funding with the Southeast Texas Nonprofit Development Center. AGENDA October 10, 2022 Page 2 d. Discussion and possible action regarding the Nederland Non-Profit Partnership Grant Program. e. Consider action approving Ordinance No. 2022-26, denying Entergy Texas, Inc.’s Statement of Intent and Application for Authority to Change Rates filed on July 1, 2022. f. Consider action approving the re-payment of over-collected sales tax to the Texas Comptroller of Public Accounts. g. Consider action awarding bid for the Hilldale/Hill Terrace and Nederland Avenue Drainage project funded through the Texas General Land Office. h. Consider action approving Ordinance No. 2022-27, de-annexing 0.1888 acres of land out of Block 18, Range “G” Port Arthur Land Company Subdivision (a portion of Kirk Gillespie’s property located at 1815 Peterson Road). 5. EXECUTIVE SESSION (No Public Discussion on These Items) The City Council will announce that it will go into Executive Session, pursuant to Chapter 551 of the Texas Government Code, to discuss matters as specifically listed on the agenda, or as authorized by law.
