NOTICE is hereby given of a regular meeting of the Nederland City Council to be held on Monday,
September 11, 2023, 4:30 p.m., at the Nederland City Hall, 207 North 12th Street, Nederland,
Texas, for the purpose of considering the following agenda items. The City Council reserves the
right to retire into Executive Session concerning any of the agenda items whenever it is considered
necessary and legally justified pursuant to Texas Government Code, Chapter 551.
Members of the public can participate remotely via Zoom Teleconferencing. Citizens may join
the Zoom Meeting by clicking on the Virtual Council Meeting https link on the City of Nederland’s
website or calling the Zoom Call in Number and entering the Meeting ID# on the City of
Nederland’s website.

3. CONSENT AGENDA—All consent agenda items listed are considered to be routine by the
City Council and will be enacted by one motion. There will be no separate discussion of these
items unless a councilmember so requests, in which event the item will be removed from the
Consent agenda and considered separately.
a. Minutes – August 28, 2023 regular meeting
4. REGULAR AGENDA
a. Consider action approving Resolution No. 2023-17, amending the City of Nederland
Citizen Participation Plan for the City’s Community Development Block Grant Disaster
Recovery Program.
b. Conduct a Public Hearing regarding the City of Nederland’s Texas Community
Development Block Grant Non-Housing Application to the Texas General Land Office,
Disaster Recovery Program – for damages to the City from Hurricane Harvey (Phase 2 –
street repairs of Hilldale Drive and Hill Terrace Drive).
c. Consider action approving Resolution No. 2023-18, dedicating funds to the City of
Nederland’s Texas Community Development Block Grant Non-Housing Application to
the Texas General Land Office, Disaster Recovery Program – for damages to the City
from Hurricane Harvey (Phase 2 – street repairs of Hilldale Drive and Hill Terrace Drive).
d. Discussion and possible action regarding the request for a Specific Use Permit for the
property located at 2015 Avenue B (lots 4, 5, 6, Block 3 of Ingwersen Subdivision) for a
parking lot for the Apostolic Tabernacle of Texas, Inc. (church) in a property zone R-1
(single-family residential).
e. Consider action setting a Joint Public Hearing for the purpose of receiving comments
regarding the request for a Specific Use Permit for the property located at 1003 Nederland
Avenue for a massage establishment in a property zoned C-3 (highway commercial).

f. Discussion and possible action appointing individuals to the Food Truck Regulation
Committee.
g. Consider action authorizing the emergency purchase of materials for water line repairs.
h. Consider action declaring surplus miscellaneous signs and metal from the Public Works
Department.
i. Consider action engaging the RWL Group for consultant services related to the bid for
windstorm insurance and to provide consulting services related to other City insurance
and risk management matters.
j. Consider action authorizing the solicitation of proposals for Windstorm Insurance.
k. Consider action approving final payment and release of retainage of the “Nederland
Swimming Pool Deck Rehabilitation” project.
l. Fiscal Year 2023-2024 Budget:
i. Consider action approving Ordinance No. 2023-18, an appropriations ordinance
adopting a budget in accordance with Article VII of the Charter of the City of
Nederland.
ii. Consider action approving Ordinance No. 2023-19, utility rates and regulations.
iii. Consider action setting the maintenance and operations portion of the tax rate at
$0.351080 per $100 assessed valuation for the fiscal year 2023-2024.
iv. Consider action setting the interest and sinking fund portion of the tax rate at
$0.116527 per $100 assessed valuation for the fiscal year 2023-2024.
v. Consider action approving Ordinance No. 2023-20, adopting the tax rate for the
fiscal year beginning October 1, 2023 and ending September 30, 2024.
vi. Consider action approving an amendment to the Clothing Allowance Standard
Operating Procedure.
vii. Consider action approving the 2023-2024 Wage & Classification Plan.
5. EXECUTIVE SESSION (No Public Discussion on These Items)
The City Council will announce that it will go into Executive Session, pursuant to Chapter 551
of the Texas Government Code, to discuss matters as specifically listed on the agenda, or as
authorized by law.
