Minutes-Approved 12-5-2023CITY OF NEDERLAND ZONING BOARD OF APPEALS MINUTES 5:00 p.m. December 5, 2023 1. MEETING The meeting was held December 5, 2023, at the City of Nederland D. Bob Henson Office Building, 1903 Atlanta Avenue, Nederland, Texas and was called to order at 5:00 p.m. by the Chairman. MEMBERS PRESENT: Emmett Hollier, Michael Whitehead, Kevin Smith, and Mike Louvier MEMBERS ABSENT: CITY STAFF PRESENT: OTHERS PRESENT: Paul Hussey George Wheeler, Chief Building Official and Beth Merren, Inspections Department Secretary Bradley Bennett, Kay DeCuir, Debra Frantz, Robert Klinger, and Brandon Monk 2. APPROVAL OF MINUTES A motion was made by Kevin Smith and seconded by Michael Whitehead to approve the minutes of the October 24, 2023 meeting. All voted aye. 3. VARIANCES a. Bradley Bennett, owner of Highway Furniture and Mattress and proposed buyer of 708 Nederland Avenue, described as Lots 1-4, Block 1 of Oakley Addition, requested a variance to Section 19.2, Table 19.1 "Off street parking and loading requirements" of the City Zoning Ordinance. to allow eight (8) off street parking spaces being less than required by Table 19.1. After a full discussion, a motion was made by Mike Louvier and seconded by Michael Whitehead to approve the variance contingent upon the need to readdress the variance should the approved eight (8) spaces not be enough to accommodate the parking needs. All voted aye. b. Julio Ceasar Cabrera, owner of 1136 Kent Avenue, described as Lot 3, Block 1 of Humphrey Heights 1 Addition, requested a variance to Section 12.2 "Schedule of residential height and area regulations" of the City of Nederland Zoning Ordinance to leave constructed a carport that encroaches five (5)ft into the five (5)ft side yard setback requirement. After a full discussion, a motion was made by Michael Whitehead and seconded by Kevin Smith to approve a two (2) ft. variance three (3) ft. encroachment and to move the existing posts twenty-four (24") inches from the property line and cut the overhang to be flush with the sidewall of the existing carport.
